All items under the consent agenda will be enacted by one motion. There will be no separate discussions of these items unless a Council Member so requests, in which case, the item will be moved from the Consent Agenda and considered as the first item after the Omnibus Vote.

Approval of Minutes & Appointments Made:

Committee-of-the-Whole and Council meeting minutes of August 1, 2017, and appointments made during Committee-of-the-Whole on August 8, 2017.

Second Reading Ordinances-

1. Council Bill/General Ordinance 3013-2017

An Ordinance amending Chapter 9, “Body Art Code,” of the Moline Code of Ordinances, by repealing said chapter in its entirety and enacting in lieu thereof one new Chapter 9, “Body Art Code,” relating to the same subject matter.

Explanation: The Moline Code of Ordinances currently prohibits a convicted felon from obtaining a body art technician license and a body art establishment license. Per resident request, City staff has reviewed this prohibition and determined that it is unnecessary. City Council discussed this matter further at the July 11, 2017, Committee-of-the-Whole meeting and directed staff to loosen the restrictions on felons but to also add in the restrictions from the East Moline ordinance as to body art establishments. Upon further review of the Chapter, staff determined other changes should be made to the Code to reflect actual practice and to mirror the State code. This amendment reflects all of these changes. In sum, the changes are:

•Updated the training requirement for body art technicians to reflect the actual training courses required

• Per Council’s direction, revised the technician and establishment license requirements to indicate that a license may be denied for certain or multiple felonies, and drug or alcohol addiction

• Removed the provision for conditional technician and establishment licenses to be issued while awaiting results from background checks

• Reinstituted a license fee for the body art establishment license of $100

• Changed the age from 21 to 18 to obtain a tattoo without parental permission to reflect the Illinois State code requirement

• Revised the Health Officer requirements for the licensing and inspection of body art

• Revised the revocation section as to body art establishment licenses to reflect the East Moline ordinance per Council’s direction

• Amended the penalty provisions to impose a fine of not less than $250 for a first violation of the ordinance, $500 for a second offense and $750 for a third or subsequent offenses

• Made other minor changes

Resolutions

2. Council Bill/Resolution 1135-2017

A Resolution authorizing municipal and non-municipal comparables for the classification and compensation study being performed by GovHR USA, LLC (GovHR).

Explanation: GovHR will utilize municipal and non-municipal comparables to conduct a survey to assist in establishing pay rates for the City. Approval of the listed municipal and non-municipal comparables is requested to ensure the best possible selection of entities for the classification and compensation study. GovHR will also review sourced wage and job description survey data, to include data compiled by the Illinois Department of Employment Security, and will utilize applicable data in their analysis. First Reading Ordinances:

3. Council Bill/General Ordinance 3014-2017

An Ordinance amending Chapter 2, “Administration,” of the Moline Code of Ordinances, by repealing Section 2-2200, “Days, Time And Place Of Regular Meetings; Adjourned Meetings,” subsections (a) and (b) in their entirety and enacting in lieu thereof new subsections (a) and (b) relating to the same subject matter.

Explanation: Sections 2-2200(a) and (b) of the Moline Code of Ordinances sets forth the days, time and place of the City’s Committee-of-the-Whole and City Council meetings. The City Council has requested that the meetings start time be changed from 6:30 p.m. to 5:30 p.m., and adoption of this ordinance would effect that change.

4. Council Bill/General Ordinance 3015-2017

An Ordinance amending Chapter 24, “Personnel,” of the Moline Code of Ordinances, by repealing Section 24-2202, “Probationary Period,” in its entirety and enacting in lieu thereof one new Section 24-2202, “Probationary Period,” relating to the same subject matter; Section 24-2203, “Residency,” by repealing subsections (b)(1), (b)(3) and (b)(6) in their entirety and enacting in lieu thereof new subsections (b)(1), (b)(3) and (b)(6) relating to the same subject matter; and Section 24-2300, “Dismissal,” by repealing subsection (a) in its entirety and enacting in lieu thereof one new subsection (a) relating to the same subject matter.

Explanation: In reviewing the current personnel code as to non-bargaining unit employees, it was noticed that the City’s current practices do not reflect the general employment status given to most non-bargaining unit public employees in other municipalities. This amendment would change the employment status of new nonbargaining unit employees to be at-will and thereby delete the reference probationary periods for those employees as unnecessary and would require the City Clerk to reside in the City.

5. Council Bill/Special Ordinance 4030-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute a Development and Economic Incentive Agreement between the City of Moline and GRD EM Industrial, LLC, for the development project, and to execute any necessary agreements referenced therein, and authorizing all appropriate City officers and staff to do all things necessary to complete each of the City’s responsibilities pursuant to said agreement.

Explanation: GRD EM Industrial, LLC (Developer) seeks to enter into a Development and Economic Incentive Agreement for the old Mills Chevrolet site located at 1610 39th Avenue. The Developer is intending to rehabilitate the existing building into five retail/commercial spaces that includes a long-term lease with the two existing Moline companies and develop two commercial buildings, one at the corner of John Deere Road and 16th Street and the second building on the east of the John Deere Road frontage that will include an environmental cleanup/No Further Remediation, as well as a new curb cut onto 16th Street. The City wishes to support the redevelopment by granting certain incentives. Additional documentation attached.

Fiscal Impact: -$975,000 Rebate (will be offset by increased sales tax)

6. Council Bill/Special Ordinance 4031-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic; and authorizing the use of public right-ofway in conjunction with the Young Life 5K road race to be held on Saturday August 19, 2017.

Explanation: Young Life has held this event in the City of Moline annually since 2010, with the exception of 2016. The organization anticipates an increase in participants this year from previous years held. This year’s event has been reviewed and approved by the Special Events Committee for Saturday, August 19, 2017. Consideration is requested due to the timing of the event. Consideration Requested.
