Mayor Freeman led the City Council and all those present in the Pledge of Allegiance to the Flag.

Mayor Freeman called the meeting to order and directed City Clerk Wanda Roberts-Bontz, to call the roll. The following Aldermen were present: Larry Toppert, Gary Almblade, Nancy Mulcahey, Jayne O’Brien Rhea Oakes, Maria Tapia and Jose Rico.

ORDINANCE 21-18: AN ORDINANCE OF THE CITY OF EAST MOLINE APPROVING THE OUTSIDE RATES FOR THE WATER AND SEWER RATE STUDY FROM HDR ENGINEERING, INC.

ORDINANCE 21-19: AN ORDINANCE ADOPTING THE BUDGET FOR ALL CORPORATE PURPOSES OF THE CITY OF EAST MOLINE, ILLINOIS, IN LIEU OF THE APPROPRIATION ORDINANCE FOR THE FISCAL YEAR COMMENCING ON THE FIRST DAY OF JANUARY, 2022 AND ENDING ON THE THIRTY-FIRST DAY OF DECEMBER, 2022.

Alderman Almblade thanked Mr. Maxeiner, City Administrator and Ms. Whiting, Finance Director for the Tax Levy helping the City of East Moline and glade they are both onboard for the City to assist. Mayor Freeman thanked Alderman Almblade for his comments.

RESOLUTIONS

PUBLIC COMMENT:

Kai Swanson, President of the Rock Island County Forest Preserve Commission – Mr. Swanson informed the City Council that it was a pleasure to speak to the City Council tonight as an Elected Official himself. I know you do not nearly get enough credit you deserve with the amount of work that you do. Mr. Swanson thanked the City Council for their service.

FIRST AND FOREMOST, we are all stewards of the environment, and it is up to us to protect wildlife – particularly threatened vital pollinators like the Rusty-patch bumblebee and the American bumblebee, not to mention the Indiana Bat and Northern-Long-eared Bat. Mike Petersen, the superintendent at Illiniwek Park, has done more for species stabilization in our community in the past decade than anyone I can think of in our entire history of our community. His track record speaks for itself.

SECONDLY: A long-shot development is conjecture. But real-world experience and statistical evidence indicate that Parks make a community more desirable, attracting families, visitors, and businesses alike. Economic benefits multiply and property values increase.

It begs the question: Why has the land sat vacant for so long? Because developers haven’t been able to make the math work. Mathematics will not change in the coming decades – at least not without a heavy, heavy subsidies from the city – and something else that won’t change is the urgency of protecting our dwindling natural resources. What WILL change is that this million-dollar grant from the Clean Energy Foundation will not be there to make this project feasible.

My Third point is strictly economic: A preserve with bike and hiking trails drawing visitors to our community – while giving our residents yet more reason to fall in love with the Quad Cities – is the “highest and best use” of this property. Ask the appraisers who’ve been brought in over the years to help make the failed case for residential development. Ask the excavators and contractors who’ve looked at this land for the past decade and said, “No thanks.” There’s a reason East Moline is banking $160,000.00 per year in Hotel/Motel taxes – it’s because you as a council have been thinking about Destination Management and Marketing the way they do at Visit Quad Cities. And you’ve been paving the way for attractions like the Bend, the Rust Belt, Mecum Auction. An attraction like this Forest Preserve will add to that 160,000.00 dollars.

In closing, I’d ask you to consider that Illiniwek and Loud Thunder Forest Preserves were created in 1944. Unless there’s a member of the council who is older than 77, creating a protected forest of this size is literally a once-in-a-lifetime opportunity. Just think of what Illiniwek and Loud Thunder have done to enrich our community over the past 77 years. I hope that when this chapter in the history of our community gets written, yours will be among the names of those who looked over the horizon, and saw a brighter, healthier future for our grandchildren, and their grandchildren. Please vote yes.

Mayor Freeman stated to Kai Swanson as he said Elected Official as usually being Elected Officials no matter if it is either County or Municipalities. Once you criticize the City Council on your social media. Do you have anyone from the Navy here tonight? That’s going to inspect our torpedo’s that what you said we are going to kill this deal. As you stated on Facebook toward the City Council of East Moline. Mayor Freeman said that he takes offensive from one Elected official to another and did not appreciate it. Mayor Freeman stated he did not care about you voicing your opinion. If that is what you feel that is your heart, there are people out there that is their heart. Mayor Freeman stated that he takes offence to Mr. Swanson statement that we are going to torpedo this particular deal. Mayor Freeman wanted to note that. Kai Swanson stated that he thanked Mayor Freeman for his comments.

Chad Pregracke, East Moline – Mr. Pregracke stated that he appreciated the opportunity to speak to the City Council. Mr. Pregracke drove up to this City Council Meeting from the Tornado’s that ripped through Kentucky approximately six hours away.

Mr. Pregracke stated that he has been doing a lot down at McLaughlin. Working with Mr. Kammler, Engineering Director and Mr. Maxeiner, City Administrator wanted to let everyone know they have a great team here with the City of East Moline, and I appreciate all of that moving forward. Mr. Pregracke thanked Mayor Freeman for the great job. All of you guys spend your time here, it is not exactly fun all the time, no matter what you do, you cannot make everyone happy.

Mr. Pregracke stated this is a great opportunity exactly what Kai Swanson was saying, backing him up. It really is, I realize that development is very important to balance a budget that you are talking all of that. I realize the reason why you do not want it. I have walked through those woods. It is not a normal patch of woods. It is a special place, there are trees that I do not know what they are. I walked through them many years ago, it would be great to protect it. I cannot say enough. Look at Illiniwek park 10 years ago there was people there now it is a weekend it is hard to find a parking spot. My wife goes there every day. On weekends she goes to Dorrance Park, there are less people. There is a trend, that trend is only more people going to places exactly like what is being talked about here. I really hope that you vote to drive it home and make it happen. I think that will actually help the other developments around it, I really do. I think there is a balance that we have it is really a special thing hope that you vote on it and since someone else is paying. I think it is a win-win. That is how I see it. I am apprehensive, I know you guys do not see it necessarily that way. I do not want any problems. This one was worth the drive up here to save. I really hope it happens. It will be here for future generations. Responsible to leave here better, do what we can. This is a great opportunity for you all.

Drew Pustelnick, East Moline – Mr. Pustelnick stated to someone that lives in a house adjacent to where the Forest Preserve may be one day. I can testify that it is a very special piece of land. Most of my childhood was spent hopping over the fence with my brother and walking through the wood’s days on end, all summer long. Like Chad Pregracke said that there are trees there that are huge, there is streaks flowing through it and there is wildlife you cannot see anywhere else around here. That is the last real chunk of forest in East Moline. That is as it was years ago. That has not been developed or touched. I would really like to see it come to life. I think it is a special forest. Do not pass up on an opportunity like this one, it would be very short sided for future generations. I hope you vote yes.

Tim Knanishu, REEDEM – Mr. Knanishu stated both Kai Swanson and Chad Pregracke made some excellent points. Looking at the standpoint of preserving nature is important. From the standpoint I am going to address it is if the City concurs with the action that is being requested from the Forest Preserve basically removes prime developmental along an interstate out of consideration for future use. It is really a simple question. Do we want to see some development there or do you want to see a Forest Preserve? That is your decision, and I am glad I am not sitting in your shoes.

RESOLUTION 21-84: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAST MOLINE, ILLINOIS, CONSENTING TO THE PURCHASE OF PARCELS OF LAND WITHIN THE CORPORATE LIMITS OF THE CITY OF EAST MOLINE BY THE ROCK ISLAND COUNTY FOREST PRESERVE DISTRICT.

A motion was made by Alderman Rico, seconded by Alderman Toppert, to approve Resolution 21-84 as presented. Upon roll call the following voted in favor: Tapia, Rico, Toppert, Mulcahey and Oakes. Opposed: Almblade and O’Brien. Motion carried. 5 – 2

Mayor Freeman stated that he still has the right to Veto this vote that has come through here. Based on Illinois Statute, I will be looking at the point, reading it through everything and take it under consideration.

Alderman Mulcahey asked if Mayor Freeman could tell her what Statute that is? Mayor Freeman stated he would send it out to the Alderman tomorrow. Mayor Freeman did not send it today because he figured everybody would have it before he got here today.

Mr. Maxeiner stated that as a point of order. Anytime a Resolution or an Ordinance is considered, and action is taken upon. It goes to the Mayor for his signature if he signs it goes into effect. If he does not sign it and does not take action on it. It goes into effect after the next meeting if he does not sign it. If the Mayor veto’s that it comes back to this City Council for a 2/3 majority to override that Veto. A 2/3 majority is five votes. So that is where it stands at the moment.

RESOLUTION 21-85: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAST MOLINE, ILLINOIS, APPROVING THE ENGINEERING SERVICES AGREEMENT WITH SHIVE HATTERY FOR THE 24th/25th STREET ALLEY UTILITY REPLACEMENT PROJECT.

A motion was made by Alderman Almblade, seconded by Alderman Toppert, to approve Resolution 21-85 as presented. Upon roll call the following voted in favor: Tapia, Rico, Toppert, Almblade, Mulcahey, O’Brien and Oakes. Motion carried.

RESOLUTION 21-86: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAST MOLINE, ILLINOIS, AUTHORIZING A REVISED SEWER EASEMENT DELINEATING A PUBLIC EASEMENT FOR THE MUNICIPAL SEWER SYSTEM.

A motion was made by Alderman Almblade, seconded by Alderman O’Brien, to approve Resolution 21- 86 as presented. Upon roll call the following voted in favor: Tapia, Rico, Toppert, Almblade, Mulcahey, O’Brien and Oakes. Motion carried.

RESOLUTION 21-87: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAST MOLINE, ILLINOIS, APPROVING A CHANGE ORDER TO THE CONTRACT WITH HOERR CONSTRUCTION, INC. FOR THE 2021 SEWER LINING PROGRAM.

RESOLUTION 21-88: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAST MOLINE, ILLINOIS, AUTHORIZING A GRANT APPLICATION FOR THE ASSISTANCE TO FIREFIGHTERS GRANT THROUGH THE FEDERAL EMERGENCY MANAGEMENT AGENCY.

RESOLUTION 21-89: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAST MOLINE, ILLINOIS, AUTHORIZING THE PURCHASE OF A REPLACEMENT CHLORINATOR FOR THE MUNICIPAL POOL FACILITY.

RESOLUTION 21-90: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EAST MOLINE, ILLINOIS, AUTHORIZING A GRANT APPLICATION FOR THE REBUILD DOWNTOWN AND MAIN STREETS CAPITAL GRANT PROGRAM THROUGH THE ILLINOIS DEPARTMENT OF COMMERCE AND ECONOMIC OPPORTUNITY.

COMMITTEE-OF-THE-WHOLE (Alderman Almblade)

Alderman Almblade had no items for discussion, all items have been covered under the Consent Agenda, Ordinances and Resolutions.

CITY STAFF COMMUNICATION:

Each City Staff member present was given the opportunity to inform the City Council and those in attendance of events in their departments:

Chief Ramsey, EMPD – Chief Ramsey informed the City Council that the East Moline Police Department Axon body camera is on the street as of December 13, 2021. All officers are wearing them. As of December 16, 2021, Officer Seth Decker graduated from the Police Training Academy. December 22, 2021 the Christmas baskets will be delivered by The East Moline Police Benevolent Association and Fraternal Order of Police (FOP).

Alderman Toppert asked Chief Ramsey if they are going to start radaring to stop speeders? Alderman Toppert was up by the school this week. Alderman Toppert was going 20 miles per hour and someone past me going at least 40 miles per hour. There was a Police Officer sitting down by the Church. The guy hit his brakes and went around another car and went on. Alderman Toppert stated we need to do something. Even if we put the cop cars out, it slows the traffic. You do not need to pull people over. They are behaving themselves a little bit more. I think someone is going to get clobbered in one of these intersections because these guys are going through way to fast. Chief Ramsey stated he will put out to do more radar details. Alderman Toppert said put cars here and there to be seen a little bit more. During traffic times a little closer to 2 – 3 p.m.

Tim Kammler, Engineering Director – Mr. Kammler informed City Council that Valley Construction has one more section of concrete to do 1st Street Court/ 2nd Street Court lingered two months past deadline. They are scheduled to pave Wednesday or Thursday this week. The asphalt we are talking to the Contractor about if it is a good ideal to put this down this year, we are lingering toward it is no. There is a stretch of warmer weather toward the end of the week. We have a lot of liquidated damages we have to sort through all that. Wanted to make sure everyone has been advised. Wished everyone a Merry Christmas and Happy Holidays and Happy New Year. Alderman Oakes asked Mr. Kammler because it is new poured concrete it is going to be ok to put our trucks on it for snow removal? Mr. Kammler stated yes. Alderman Oakes will it be cured enough to not tear up anything? Mr. Kammler stated that the concrete that is being put down here in the colder weather is an Iowa DOT mix, it is so stiff it has so many add mixers it is hard to pave with. Alderman Oakes asked about salt and weight. Mr. Kammler stated it will be fine.

Brianna Huber, Water Treatment Plant – Ms. Huber stated that everyone would be happy to know that after nine long months high service Pump number four re-installed and operating very successfully, very excited about that. We were worried that it was going to run into 2022 and would have to move the money. Happy to have all our pumps back into operation at this point. An update maybe a preview if anything. I have been working with a few vendors potentially looking at putting some of our water towers on asset management program. Maybe do a little bit better maintaining them. In terms of maintains and inspections. To make sure they are preforming to the best of their ability and we can extend the life of those assets as long as possible. It would also help to spread out the cost. You probably seen in the Capital Improvement plan we have to clean the towers every seven to eight years and this comes at a large expense. If we can get some of these towers on the Asset Management Program, we can spread that cost more evenly over the years. You might hear about that more in the future.

A motion was made by Alderman Almblade, seconded by Alderman Tapia, to go into Closed Session for: 5 ILCS 120/2 (c) 2 Collective Negotiation matters between the public body and its employees. Upon roll call the following voted in favor: Tapia, Rico, Toppert, Almblade, Mulcahey, O’Brien and Oakes. Motion carried. 7:42 p.m.

RECONVENE OPEN SESSION:

A motion was made by Alderman Oakes, seconded by Alderman Rico, to return to open session. Upon roll call the following voted in favor: Upon roll call the following voted in favor: Tapia, Rico, Toppert, Almblade, Mulcahey, O’Brien and Oakes. Motion carried. 8:00 p.m.

Mayor Freeman reported that no action was taken in Closed Session.

ADJOURNMENT:

A motion was made by Alderman Oakes, seconded by Alderman Almblade, to adjourn the City Council meeting. Upon roll call the following voted in favor: Tapia, Rico, Toppert, Almblade, Mulcahey, O’Brien and Oakes. Motion carried. 8:00 p.m.
