Moline City Council met November 7.

Here is the minutes provided by the Council:

Council Meeting: The City Council meeting came to order at 8:11 p.m. The Council met in regular session in the Council Chambers at City Hall.

Pledge: The Council and audience recited the Pledge of Allegiance.

Invocation: Alderman Berg gave an Invocation.

Roll Call: Roll call was taken with Mayor Acri, Aldermen Rodriguez, Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg present. Absent: None.

Items on Consent:

Approval of Minutes & 2016 Police Pension Report:

Committee-of-the-Whole and Council meeting minutes of October 24, 2017, and the 2016 Police Pension Report.

Second Reading Ordinances-

1.Council Bill/Special Ordinance 4045-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic, and authorizing the use of public right-of-way in conjunction with the Moline Hungry Turkey 5K and 10K run/walk, sponsored by All Community Events, to be held on Sunday, November 26, 2017.

2. Council Bill/Special Ordinance 4046-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic, and authorizing use of public right-of-way in conjunction with the Lighting on the Commons, sponsored by the Commons Property Owners Group, to be held on Saturday, November 18, 2017.

Resolutions-

3. Council Bill/Resolution 1169-2017

A Resolution authorizing the Mayor and City Clerk to accept a Quit Claim Deed between Moline Forge Inc., and the City of Moline.

4. Council Bill/Resolution 1170-2017

A Resolution authorizing the Mayor and City Clerk to accept one (1) Permanent Utility and Drainage Easement, more particularly described herein, to allow construction to proceed on Project #1211, 40th Street Reconstruction, south of 32nd Avenue.

5. Council Bill/Resolution 1171-2017

A Resolution authorizing the Mayor and City Clerk to execute two (2) Deeds of Dedication for Street Right-of-Way, more particularly described herein, to allow construction to proceed on 36th Street, north of 22nd Avenue.

6. Council Bill/Resolution 1172-2017

A Resolution authorizing approval of a sole source purchase from Marshall Bond Pumps for a Crisafulli stormwater pump in the amount of $24,675.

7. Council Bill/Resolution 1173-2017

A Resolution authorizing the Interim Chief of Police to execute a Hold Harmless Agreement between the Police Department and Heritage Wesleyan Church for use of the building located at 1 Blackwell Boulevard, Moline, Illinois, from November 1, 2017, through December 31, 2019, to conduct tactical training drills.

Omnibus Vote: Alderman Parker, seconded by Alderman Wendt, moved to approve and adopt, by omnibus vote, these items. Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

First Reading Ordinances-

8. Council Bill/General Ordinance 3039-2017

An Ordinance amending Chapter 35, “Zoning and Land Development,” of the Moline Code of Ordinances, by amending the Zoning Map, incorporated therein as Section 35-3103 (Dan Dolan, 7th and JD, LLC; 600 John Deere Road).

Motion for Consideration: Alderman Parker, seconded by Alderman Wendt, moved to consider Council Bill 3039-2017. Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

Adopted: Alderman Parker, seconded by Alderman Wendt, moved to adopt Council Bill 3039-2017. Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

9. Council Bill/General Ordinance 3040-2017

An Ordinance levying and assessing taxes for the City of Moline, Illinois, for the tax levy year 2017, collectible in 2018, and enacting an ordinance relating to the same subject matter.

10. Council Bill/General Ordinance 3041-2017

An Ordinance levying a special Ad Valorem Tax within the City of Moline, Illinois, Special Service Area #5 of the City of Moline, Illinois, for the tax levy year 2017, collectible in 2018, and enacting an ordinance relating to the same subject matter.

11. Council Bill/General Ordinance 3042-2017

An Ordinance levying a special Ad Valorem Tax within the City of Moline, Illinois, Special Service Area #6 of the City of Moline, Illinois, for the tax levy year 2017, collectible in 2018, and enacting an ordinance relating to the same subject matter.

12. Council Bill/General Ordinance 3043-2017

An Ordinance amending Chapter 5, “Amusements,” of the Moline Code of Ordinances, Section 5- 1102, “License Required,” by adding one new subsection (c) relating to the same subject matter.

Motion for Consideration: Alderman Parker, seconded by Alderman Wendt, moved to consider Council Bills 3043-2017, 4047-2017 and 4048-2017. Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

Adopted: Alderman Parker, seconded by Alderman Turner, moved to adopt Council Bill 3043-2017. Motion carried on roll call with the following vote: ayes: Aldermen Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: Alderman Rodriguez.

13. Council Bill/Special Ordinance 4047-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute an Amendment to Development Agreement between the City of Moline and The Mills at Riverbend Commons, LLC, for development of the Riverbend Commons project and to execute any necessary agreements referenced therein; and authorizing all appropriate City officers and staff to do all things necessary to complete each of the City’s responsibilities pursuant to said Agreement.

Adopted: Alderman Parker, seconded by Alderman Wendt, moved to adopt Council Bill 4047-2017. Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

14. Council Bill/Special Ordinance 4048-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute the Fourth Amendment to Site License Agreement (“Agreement”) between the City of Moline (“City”) and New Cingular Wireless PCS, LLC, (“New Cingular”) where said Agreement leases a portion of the space on the City’s water tower, located at 1531 17th Avenue, so that New Cingular may install updated antennas, associated cables and other communications instruments.

Adopted: Alderman Parker, seconded by Alderman Wendt, moved to adopt Council Bill 4048-2017. Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

Miscellaneous Business:

Alderman Wendt made a motion to direct staff to work with the Plan Commission to review the City’s Zoning Code to find ways to make it more flexible, in particular, to look at options including, but not limited to, allowing special use permits in O-1 Districts, as well as the possibility of retail. Seconded by Alderman Waldron. Motion passed unanimously.

Alderman Schoonmaker noted his objection to the early meeting Committee-of-the-Whole and Council meeting start time of 5:30 p.m. This early start time makes it difficult for him to do his private sector job and his job as alderman. The start time was changed after the election. Alderman Schoonmaker made a motion to consider changing the meeting start time from 5:30 p.m. to 6:00 p.m., effective January 1, 2018. Motion passed unanimously.

Alderman Berg made a motion to have meetings every week with the exception of holiday weeks. Motion failed for lack of a second.

Mayor Acri directed City staff to review the 2018 meeting calendar to ensure that the City does not have meetings scheduled wherein there are two Tuesdays in a row without a meeting.

Alderman Schoonmaker mentioned that he has noticed increased gang graffiti in the 41st Street and 12th Avenue area. Interim Chief of Police John Hitchcock confirmed that he would address this issue.

Council, Staff and Citizen Comments:

Alderman Berg shared that there was a great article concerning Officer Moody and his goodwill. She asked Interim Chief of Police John Hitchcock to thank him for his goodwill. She also expressed her appreciation to the Moline Police Officer that saved a litter of kittens from a drain.

Alderman Parker expressed his appreciation to Interim Fire Chief Jeff Snyder and his crew for the Fire Ops 101 at the Rock Island Arsenal. It was well run and attended.

Alderman Turner echoed Alderman Berg’s appreciation of Officer Moody and his goodwill. She also said that she received a call from a gentleman whose mom is 89 years old. It was discovered that his mom had a leaking commode in her basement, which resulted in a $1,500 water bill. Alderman Turner spoke with Tony Loete concerning this matter, and she directed staff to come back to the Committee with an informational item concerning charging for treatment costs in cases like this sometime in December 2017.

Alderman Rodriguez thanked Public Works Director J.D. Schulte and his staff for fixing the security lights at Stephens Park.

Mayor Acri mentioned that there is a Veterans’ Breakfast this Saturday, November 11, 2017, sponsored by Hy-Vee on Avenue of the Cities beginning at 6:00 a.m. Mayor Acri will attend this event, and the Fire Department is going to have a Fire Truck there displaying a flag. Mayor Acri encouraged the aldermen to join her at this event to support the veterans.

Executive Session:

Alderman Parker, seconded by Alderman Wendt, moved for Executive Session, for the purpose of discussion of Collective Negotiating Matters-5 ILCS 120/2(C)(2) and Price Setting for Sale or Lease of Real Property-5 ILCS 120/2(C)(6). Motion carried on roll call with the following vote: Ayes: Aldermen Rodriguez, Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

City Council convened in Executive Session at 8:35 p.m.

Alderman Turner moved to adjourn Executive Session, seconded by Alderman Wendt. Motion passed unanimously.

Council reconvened in open session at 10:05 p.m.

On motion of Alderman Potter, seconded by Alderman Wendt, Council adjourned at 10:05 p.m.

The next regularly scheduled City Council meeting is on November 14, 2017.
