Second Reading Ordinances

1. Council Bill/Special Ordinance 3038-2018

An Ordinance amending Chapter 15, “GARBAGE AND TRASH,” of the Moline Code of Ordinances, Section 15-2100(a)(4), “Commercial and industrial buildings,” by enacting one new subsection (a) thereto pertaining to food establishments with drive-through service; and Section 15-2205, “PENALTY,” by enacting one new subsection (b) and consecutively renaming the remaining subsection.

Explanation: In an effort to reduce discarded plastic waste and similar waste materials from creating a public nuisance within the City and to further efforts of keeping such waste from reaching the river or other local water resources, the City Council wishes to amend the Code of Ordinances to add a requirement for a refuse container to be placed within the drive-through lane of any food establishment with drive-through service. This ordinance will require any new food establishment with drive-through service to install a refuse container within its drive- through lane prior to opening of the establishment and any food establishment with current drive-through service to install the container within 18 months of the effective date of the ordinance. Such food establishments will be notified of this requirement.

2. Council Bill/Special Ordinance 3039-2018

An Ordinance amending Chapter 20, “MOTOR VEHICLES AND TRAFFIC,” of the Moline Code of Ordinances, Appendix 10 thereof, “PARKING PROHIBITED AT ANY TIME,” by including 25th Street, on the east side, from Avenue of the Cities north to the alley located between Avenue of the Cities and 19th Avenue.

Explanation: A request for no parking at the above designated location was reviewed and approved by the Traffic Committee on October 2, 2018.

Resolutions

3. Council Bill/Resolution 1133-2018

A Resolution authorizing the Human Resources Manager to accept a proposal from USI Insurance for cyber liability insurance for a period from October 23, 2018 through December 31, 2019.

Explanation: USI Insurance is the current broker for the City’s cyber liability insurance. USI Insurance obtained a proposal from Lloyd’s of London to provide coverage from October 23, 2018 through December 31, 2019. The premium will be $17,703.17 for an approximate 14-month period. This extended period will allow the City to get this policy on the same cycle as all other lines of liability insurance coverage. Of note, cyber liability coverage was enhanced from $1,000,000 to $3,000,000, providing the City with additional coverage for an increasingly risky area of business. The self-insured retention (SIR) will be decreased from $25,000 per claim to $10,000 per claim with no increase to the premium cost. Additional documentation attached.

4. Council Bill/Resolution 1134-2018

A Resolution Supporting a grant application to the Illinois Housing Development Authority for the Illinois Affordable Housing Trust Fund Single Family Rehabilitation Program, Round 2 with Roof Only Option Program for a total amount of $960,000; and Authorizing City staff to do all things necessary to apply for the Illinois Affordable Housing Trust Fund Single Family Rehabilitation Program, Round 2 with Roof Only Option Program Grant.

Explanation: The City has a list of households waiting to participate in the Community Housing Services Program and staff is currently working through forty plus active applications, which demonstrates a need for additional resources for owner-occupied housing rehabilitation in the City. The Illinois Affordable Housing Trust Fund Single Family Rehabilitation (SFR), Round 2 with Roof Only Option (SRR-R) Program will assist low- income and very low-income homeowners with repairs to their homes and will also remove health and safety hazards by repairing or replacing costly maintenance items. The City is requesting $960,000 for the SFR/SFR-R Program. Each eligible property would receive assistance up to a maximum of $45,000, and this grant will support the City’s continued partnership with neighboring communities.

5. Council Bill/Resolution 1135-2018

A Resolution authorizing the Mayor and City Clerk to execute a contract with Quality Control Restoration, LLC for Fire Station #2 Roof for the amount of $28,194.00.

Explanation: Bids were publicly opened and read on September 7, 2018, with Quality Control Restoration, LLC submitting the lowest responsible and responsive bid in the amount of $28,194.00. Funds are budgeted to replace the roof at Fire Station #2. Additional documentation attached.

Fiscal Impact: $28,000.00 is budgeted in 447-0851-439.08-05, Building Improvements. Public Notice/Recording: N/A

6. Council Bill/Resolution 1136-2018

A Resolution authorizing the Mayor and City Clerk to execute a Contract with Brandt Construction Co. for Project #1281, Radar Road Water Main Extension, Phase 1.

Explanation: Bids were opened and publicly read on October 9, 2018 for Project #1281 with the following

results:

7. Council Bill/Resolution 1137-2018

A Resolution authorizing an appropriation of $40,000 in additional façade funds from the 2018 General Fund Contingency.

Explanation: The Design Committee currently has four project applications to consider for the remainder of 2018. These four projects would improve important commercial buildings on major thoroughfares in the City of Moline. The additional $40,000, would allow the City to award money to all of these projects.

Fiscal Impact: Decrease of $40,000 to General Fund Contingency. Public Notice/Recording: N/A

8. Council Bill/Resolution 1138-2018

A Resolution authorizing the purchase of five (5) 2019 Peterbuilt 520 Chassis and NewWay Automated Refuse Collection Bodies from Elliott Equipment Company for the amount of $1,087,710.

Explanation: Funds are budgeted for the purchase of five (5) new automated refuse collection trucks for use by the Public Works, Sanitation Division. Staff previewed several different manufacturer’s equipment. Specifications were developed, and a Request for Proposal was published. The most responsive and responsible proposal was received from Elliott Equipment Company, Davenport, Iowa for the amount of $217,542 per truck. This price reflects a $90,000 trade offer for the City’s old units. The total purchase price for the five (5) trucks is $1,087,710. The expected life of the current refuse trucks has been extended about a year and they are reaching the end of their useful and reliable life. Additional documentation attached.

Fiscal Impact: $1,300,000 is budgeted in Account #448-0867-437.07-03

9. Council Bill/Special Ordinance 3040-2018

An Ordinance amending Chapter 20, “MOTOR VEHICLES AND TRAFFIC,” of the Moline Code of Ordinances, Appendix 6 thereof, “YIELD INTERSECTIONS,” by repealing Fourteenth Street’s preference over Twenty-Fifth Avenue.

Explanation: On September 18, 2018, the Committee-of-the-Whole approved a motion to replace the yield signs with stop signs at the above designated location.

10. Council Bill/Special Ordinance 3041-2018

An Ordinance amending Chapter 20, “MOTOR VEHICLES AND

TRAFFIC,” of the Moline Code of Ordinances, Appendix 5 thereof “ALL-WAY STOP INTERSECTIONS,” by including Fourth Street and Berg Twenty-Eighth Avenue.

Explanation: On September 18, 2018, the Committee-of-the-Whole approved a motion to install an all-way stop

intersection at the above designated location. Fiscal Impact: N/A

Resolutions

11. Council Bill/Resolution 1139-2018

A Resolution authorizing approval of Change Order #2 with Langman Construction Company for Project #1284, 32nd Street Reconstruction, 15th – 18th Avenues, in the amount of $26,776.66.

Explanation: Change Order #1 for $20,497.70 was approved by the City Council at the June 5, 2018, City Council meeting. This change order included additional storm sewer work which was not included in the contract. The work is now complete, and Change Order #2 for $26,776.66 is required to close out the contract. Change Order #2 reflects actual quantities constructed and is largely comprised of additional storm sewer work. Additional documentation attached.

First Reading Ordinances

12. Council Bill/Special Ordinance 4055-2018

A Special Ordinance granting a temporary modification to Section 28-3200(a) and Section 35-4218 of the Moline Code of Ordinances to delay the construction of sidewalks for property located at 1122 5th Avenue with the condition that the applicant install a new sidewalk along the 11th Street (alley) frontage from the end of the existing sidewalk to 6th Avenue and correct any damaged panels of the existing sidewalk and be required to install ADA compliant ramps at the 6th Avenue intersection.

Explanation: The Boys and Girls Club desires to develop property at 1122 5th Avenue by constructing a green house on the portion bordered by 5th Avenue, 6th Avenue, and the alley. While this is a corner lot, a sidewalk is required to be installed on both 5th and 6th Avenues. The Boys and Girls Club is seeking a temporary modification to delay installation of public sidewalks due to the cost. This special ordinance would delay construction of sidewalks along the 5th Avenue and 6th Avenue frontages, with the condition that the applicant install a new sidewalk along the 11th Street (alley) frontage from the end of the existing sidewalk to 6th Avenue. The applicant would also correct any damaged panels of the existing sidewalk and be required to install ADA compliant ramps at the 6th Avenue intersection.
