1. Council Bill/Special Ordinance 4018-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute a Development and Economic Incentive Agreement between the City of Moline and Midwest Palms, LLC for the development project and to execute any necessary agreements referenced therein, and authorizing all appropriate City officers and staff to do all things necessary to complete each of the City’s responsibilities pursuant to said Agreement.

Explanation: Midwest Palms, LLC seeks to enter into a Development and Economic Incentive Agreement with the City to facilitate the development of the project consisting of the following properties: 1320 and 1322 49th Street. The project will consist of Developer purchasing the property and constructing 16 market rate condominium/townhouses. Developer is seeking assistance from the City due to the additional costs of utility infrastructure as an extension is required with individual connections for each unit. The City wishes to support the development by granting certain incentives. Additional documentation attached.

2. Council Bill/Resolution 1093-2017

A Resolution authorizing the Mayor and City Clerk to execute a Contract with Sterling Commercial Roofing, Inc., for the Removal and Replacement of the Municipal Services Salt Dome Roof at 3635 4th Avenue, in the amount of $60,875.00. (Rodd Schick, Municipal Services General Manager)

Explanation: Bids were opened and publicly read on May 2, 2017, for the removal and replacement of the Municipal Services Salt Dome Roof with the following results:

3. Council Bill/Resolution 1094-2017

A Resolution declaring the following municipal real property as surplus property: 1818 5th Avenue, Moline, Illinois.

Explanation: The property at 1818 5th Avenue, Moline, is owned by the City and is currently a parking lot. The City has no use or future plans for this parking lot and wishes to declare it as surplus in order to negotiate a sale of the property. The City was also approached by Hnguyuen, LLC, wishing to acquire the property for redevelopment of the adjacent property into five retail spaces. City staff desires to negotiate a sale with the interested party.

4. Council Bill/Resolution 1095-2017

A Resolution authorizing the Mayor and City Clerk to execute a Contract with Hoerr Construction Inc., for Project #1271, 2017 Sewer Lining Program, in the amount of $166,089.00.

Explanation: Bids were opened and publicly read on May 9, 2017, for Project #1271 with the following results:

5. Council Bill/Resolution 1096-2017

A Resolution amending Resolution No. 1080-2017 authorizing the Mayor and City Clerk to approve a Local Agency Agreement for Federal Participation for Motor Fuel Tax Section 14-00256-00-RS, Resurfacing with Sidewalk Improvements.

Explanation: City Council previously approved the Local Agency Agreement for Federal Participation for Motor Fuel Tax Section 14-00256-00-RS, Resurfacing with Sidewalk Improvements. The Federal funds require a 20% local match. Illinois Department of Transportation (IDOT) requires City to state the amount of the match which is $220,000.00 and which was not previously stated in Resolution No. 1080-2017. This amendment adds the actual amount per IDOT requirements. Approving the amended Resolution for this Agreement provides acknowledgement to IDOT that the City has sufficient funds available to fund the local match, all participating construction costs above the maximum federal contribution, and all non-participating construction costs. 6. Council Bill/Resolution 1097-2017

A Resolution authorizing the Mayor and City Clerk to apply for a State Highway permit from the Illinois Department of Transportation and to execute the necessary forms in conjunction with the Micro Brew Mile & 6K Road Race, sponsored by Children’s Therapy Center of the Quad Cities, scheduled for Saturday, June 17, 2017.

Explanation: This annual event sponsored by the Children’s Therapy Center of the Quad Cities will be held in downtown Moline and will require temporary lane closure of a State highway within the City. A resolution authorizing the Mayor and City Clerk to apply for a State Highway permit from the Illinois Department of Transportation (IDOT) for temporary lane closure during the event was approved by the City Council on March 28, 2017, and submitted to IDOT for review. IDOT recently advised City staff that a change to the event’s route to include a designated detour will be required due to a current lane closure by the State that will remain in effect during the event. This resolution contains the route change. Approval of this resolution is necessary to re-submit application to IDOT for approval of the State Highway permit.

7. Council Bill/Resolution 1098-2017

A Resolution approving the remote electronic attendance of Aldermanat-Large Sonia Berg, at the Committee-of-the-Whole and City Council meetings of June 6, 2017, due to her travel out of town as part of her current employment.

Explanation: Section 2-2200(e) of the Moline Code of Ordinances provides that any member of the City Council may attend and participate in any open or closed meeting of the City via electronic attendance provided that such attendance is in compliance with the rules set forth within said section and any other applicable laws. Alderman-at-Large Sonia Berg, (“Berg”) will be traveling out of town for purposes of her employment on June 6, 2017. Pursuant to Section 2-2200(e), absence due to employment purposes meets one of the prerequisites under which electronic attendance is allowed. A quorum must also be established and physically present at the meeting site following the roll call for each meeting to allow the electronic attendance to proceed at the meeting. During Berg’s remote electronic attendance, she shall be allowed to participate in the same capacity as those City Council members physically present at the meetings.

First Reading Ordinances-

8. Council Bill/General Ordinance 3007-2017

A General Ordinance amending Chapter 35 “Zoning and Land Development” of the Moline Code of Ordinances, Section 35-3301, “Bulk Standards,” by repealing Table 35-3301.1, in its entirety and enacting in lieu thereof one new Table 35-3301.1 dealing with the same subject matter; and by amending Section 35-3108, “Principle and Major Accessory Structure Bulk Standard Exceptions,” by enacting one new subsection (b)(5) dealing with the same subject matter.

Explanation: On May 10, 2017, the Plan Commission, upon review of the Zoning and Land Development Code, recommended that the maximum building height in the B-4 Zoning District be increased from 45 ft/stories to 70 ft/stories and that generators, heating, cooling, ventilation, communications, utility and related equipment also be included in the maximum height exceptions. City staff and the Moline Plan Commission have also received written and verbal communications from the Metropolitan Airport Authority of Rock Island County regarding their desire to protect airspace and current/future airport operations, and to communicate and coordinate with developers in advance to ensure regulatory compliance near the airport.

9. Council Bill/General Ordinance 3008-2017

An Ordinance amending Chapter 2, “Administration,” of the Moline Code of Ordinances, Section 2-3201, “Mayor,” by repealing subsection (g)(2), pertaining to mayoral health insurance participation, in its entirety.

Explanation: Section 2-3201(g)(2) of the Moline Code of Ordinances includes participation in the City’s health benefit plan as part of the mayor’s compensation. The City seeks to eliminate said requirement as a cost saving measure to the City. Per Section 2-3105 of the Code, the fees, salary or compensation of any City officer elected or appointed for a definite term shall not be increased or diminished during the term; therefore, this change in compensation would become effective at the start of the next mayoral term on May 4, 2021.

10. Council Bill/Special Ordinance 4020-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute an Agreement for Sale of Real Estate and do all things necessary to convey the City-owned property at 1818 5th Avenue, Moline, to Hnguyuen, LLC.

Explanation: The property at 1818 5th Avenue, Moline, is owned by the City and is currently a parking lot. The City was approached by Hnguyuen, LLC (Purchaser), wishing to acquire the property for redevelopment of the adjacent property into five retail spaces. City staff obtained an appraisal of the lot which is 65’ x 140’ and 9,100 sq. ft., and the appraisal came in at $37,500. The Purchaser has agreed to purchase the property for the appraised price pursuant to the terms of the Agreement for Sale of Real Estate. Additional documentation attached.

11. Council Bill/Special Ordinance 4021-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic; and authorizing the use of public right-of-way in conjunction with the annual Ride the River bicycle ride, sponsored by River Action, scheduled for Sunday, June 18, 2017.

Explanation: This is an annual event. This year’s event has been reviewed and approved by the Special Events Committee for Sunday, June 18, 2017.
