Moline City Council met June 13.

Here is the minutes as provided by the council:

Council Meeting: The City Council meeting came to order at 7:11 p.m. The Council met in regular session in

the Council Chambers at City Hall.

Pledge: The Council and audience recited the Pledge of Allegiance.

Invocation: Alderman Parker gave an Invocation.

Roll Call: Roll call was taken with Mayor Acri, Aldermen Rodriguez, Parker, Wendt, Potter, Turner,

Schoonmaker, Waldron and Berg present. Absent: None.

Items on Consent:

Approval of Minutes

Committee-of-the-Whole and Council meeting minutes of June 6, 2017.

Second Reading Ordinances

1. Council Bill/General Ordinance 3007-2017

A General Ordinance amending Chapter 35 “ZONING AND LAND DEVELOPMENT” of the Moline

Code of Ordinances, Section 35-3301, “BULK STANDARDS,” by repealing Table 35-3301.1, in its

entirety and enacting in lieu thereof one new Table 35-3301.1 dealing with the same subject matter; and

by amending Section 35-3108, “PRINCIPLE AND MAJOR ACCESSORY STRUCTURE BULK

STANDARD EXCEPTIONS,” by enacting one new subsection (b)(5) dealing with the same subject

matter.

2. Council Bill/General Ordinance 3008-2017

An Ordinance amending Chapter 2, “ADMINISTRATION,” of the Moline Code of Ordinances, Section

2-3201, “MAYOR,” by repealing subsection (g)(2), pertaining to mayoral health insurance participation,

in its entirety.

3. Council Bill/Special Ordinance 4020-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute an Agreement for Sale of Real

Estate and do all things necessary to convey the City-owned property at 1818 5th Avenue, Moline, to

Hnguyuen, LLC.

4. Council Bill/Special Ordinance 4021-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic; and

authorizing the use of public right-of-way in conjunction with the annual Ride the River bicycle ride,

sponsored by River Action, scheduled for Sunday, June 18, 2017.

Resolutions

5. Council Bill/Resolution 1099-2017

A Resolution declaring the following Article 36 seized and forfeited vehicle as surplus property: 2006

Toyota Scion XB VIN# JTLKT324264103461.

6. Council Bill/Resolution 1100-2017

A Resolution authorizing the Chief of Police/Public Safety Director to execute an Intergovernmental

Training Use Agreement allowing the police tactical unit to conduct training drills at the Marseilles

Training Center in Marseilles, Illinois, on August 9, 2017, and indemnifying the Illinois Department of

Military Affairs from any loss or liability that might occur during the training.

7. Council Bill/Resolution 1101-2017

A Resolution Accepting the Comprehensive Annual Financial Report prepared by Baker Tilly Virchow

Krause, LLP, for the Fiscal Year January 1, 2016 through December 31, 2016, for all municipal funds.

8. Council Bill/Resolution 1102-2017

A Resolution authorizing the Mayor and City Clerk to execute a Revenue Reciprocal Agreement on

Exchange of Information between the City of Moline and the Illinois Department of Revenue.

9. Council Bill/Resolution 1103-2017

A Resolution accepting the Quit Claim Deed from the United States of America for real estate located on

a portion of Bass Street Landing and legally described herein; and authorizing the Mayor, City Clerk,

and City staff to do all things necessary to complete the acceptance of the property from the United States

of America.

10. Council Bill/Resolution 1104-2017

A Resolution authorizing the Utilities General Manager to approve Change Order #6 with Williams

Brothers Construction Inc., for the North Slope Wastewater Plant Improvements Project, in the amount

of $120,615.

11. Council Bill/Resolution 1105-2017

A Resolution authorizing the Utilities General Manager to purchase two polymer feed systems for the

South Slope Wastewater Treatment Plant, in the amount of $31,870.

12. Council Bill/Resolution 1106-2017

A Resolution authorizing the Mayor and City Clerk to approve a Water and Sewer Extension Agreement

with Wolff Washes, LLC, for water and sanitary sewer mains installed along 61st Street Drive, north of

44th Avenue.

13. Council Bill/Resolution 1107-2017

A Resolution authorizing the Mayor and City Clerk to execute a Review and Purchase Agreement with

Hawkeye Land Company of Illinois related to the I-74 Utility Relocation Project.

14. Council Bill/Resolution 1108-2017

A Resolution authorizing the Mayor and City Clerk to execute a Review and Purchase Agreement with

Hawkeye Land Company of Illinois related to the Illinois Department of Transportation’s I-74 Bridge

Project.

15. Council Bill/Resolution 1109-2017

A Resolution authorizing the Mayor and City Clerk to execute a Joint Agreement with the Illinois

Department of Transportation Related to the Storm Sewers on the I-74 Bridge Project.

Omnibus Vote: Alderman Parker, seconded by Alderman Berg, moved to approve and adopt, by omnibus

vote, these items. Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker,

Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

Items Not on Consent:

Resolutions

16. Council Bill/Resolution 1110-2017

A Resolution authorizing the Mayor and City Clerk to execute a Contract with Fischer Excavating Inc.,

for Project #1269, 9th Avenue, 27th to 29th Street.

Approved: Alderman Waldron, seconded by Alderman Potter, moved to approve Council Bill 1110-2017.

Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker, Wendt, Potter, Turner,

Schoonmaker, Waldron and Berg; nays: none.

First Reading Ordinances

17. Council Bill/Special Ordinance 4023-2017

A Special Ordinance granting a variance to Chapter 34, “WATER AND SEWERS,” of the Moline Code

of Ordinances, Section 34-3300, to permit the owner of 1626 26th Avenue to replace a private septic tank

at the property in lieu of extending the public sanitary sewer main until such time as a sanitary sewer

main is immediately adjacent to said property, at which time the owner shall be required to connect

within three (3) years from the date that the main or other collections system becomes adjacent or when

the septic system fails, whichever occurs first.

Motion for Consideration: Alderman Parker, seconded by Alderman Berg, moved to consider council bill

4023-2017. Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker, Potter,

Turner, Schoonmaker, Waldron and Berg; nays: none. Alderman Wendt abstained for business reasons.

A motion to approve the variance was made by Alderman Parker, seconded by Alderman Berg. Motion failed

with Aldermen Rodriguez, Parker, Potter, Turner, Schoonmaker, Waldron and Berg voting nay. Alderman

Wendt abstained for business reasons. Council confirmed that the prior variance from 2011 would remain in

place.

18. Council Bill/Special Ordinance 4024-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute a Quit Claim Deed conveying any

interest the City has in a previously vacated right of way to Moline Forge Inc.

19. Council Bill/Special Ordinance 4025-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic; and

authorizing the use of public right-of-way in conjunction with the Micro Brew Mile & 6K Road Race,

sponsored by Children’s Therapy Center of the Quad Cities, scheduled for Saturday, June 17, 2017.

Motion for Consideration: Alderman Parker, seconded by Alderman Rodriguez, moved to consider council

bill 4025-2017. Motion carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker,

Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

Adopted: Alderman Parker, seconded by Alderman Wendt, moved to adopt Council Bill 4025-2017. Motion

carried on roll call with the following vote: ayes: Aldermen Rodriguez, Parker, Wendt, Potter, Turner,

Schoonmaker, Waldron and Berg; nays: none.

Council, Staff and Citizen Comments:

Alderman Parker inquired regarding closing streets for special events. He questioned whether the Council

could vote on street closures as part of the consent agenda, since City staff knows what events are coming up.

Maureen Riggs, City Attorney, responded they could not, because Special Ordinances require two readings.

Alderman Berg thanked J.D. Schulte, Public Works Director, and his crew, for their work concerning the traffic

congestion on John Deere Road. She was on John Deere Road several times this weekend, and City crews were

out in the heat assisting with the traffic flow.

J.D. Schulte, Public Works Director, shared that he is contemplating reducing manpower on John Deere Road

this weekend. The dedicated, left-hand turn lane on 70th Street has helped with the traffic flow. Mr. Schulte

will be meeting with IDOT on Friday morning to discuss some pavement markings differentiating the dedicated

through lane and the dedicated turn lane. With those changes, Mr. Schulte feels comfortable eliminating some

staff time on John Deere Road this weekend. Per Mr. Schulte, City staff will return to the area to assist if

necessary in the future.

Alderman Waldron requested a presentation from City staff regarding the future plans for the Capital

Improvement Program (CIP). This presentation should include the Parks and Library Departments, as well. He

would like to see if City staff intends to do more sidewalks (residential or commercial) or preventative

maintenance. Alderman Waldron directed staff to give examples of amounts spent in the past. This item will

be added as an informational item on the Committee-of-the-Whole Agenda next Tuesday, June 20, 2017. Scott

Hinton requested two weeks to work on it. Mayor Acri directed staff to begin work on this, including monetary

amounts concerning CIP plans, and bring back some preliminary information next week with further

information to follow at a later meeting.

Lori Wilson, Parks Recreation Director, announced that the Parks Department installed signage to close Ben

Butterworth Parkway for resurfacing next Monday, June 19, 2017. This will be followed by press releases and

social media notifications. The resurfacing will be a quick, 10-day project, which includes only one weekend

closure. Ms. Wilson confirmed that the Park Board decided to keep the current width of the pedestrian path due

to the astronomical price of widening it.

Alison Fleming, Human Resources Manager, reminded the Council that she put fliers at all of their desks

inviting them to the Employee Appreciation Picnic tomorrow at Riverside Park.

Ray Forsythe, Planning & Development Director, shared that the Joint Review Board meeting is next week.

This meeting will include the annual report of TIF districts. Mayor Acri will be in attendance as the City

representative. Council is welcome to attend, as well. City staff will provide the Council with handouts that

evening concerning the Joint Review Board meeting.

Ray Forsythe, Planning & Development Director, thanked everyone for bearing the heat at the Fifth Avenue

Building tour this afternoon.

Alderman Parker thanked J.D. Schulte, Public Works Director, and his staff for stepping in the last several

months in the City Administrator role. Mr. Schulte has done a great job leading the City and has given Doug

Maxeiner a great transition in his position as the new City Administrator. Alderman Parker also thanked

Maureen Riggs, City Attorney, and Ray Forsythe, Planning & Development Director, for their work in the

interim.

Executive Session:

There was no executive session.

On motion of Alderman Parker, seconded by Alderman Berg, Council adjourned at 7:47 p.m.

The next regularly scheduled City Council meeting is on June 20, 2017.
