1. Council Bill/General Ordinance 3019-2017

An Ordinance amending Chapter 28, “Streets And Sidewalks,” of the Moline Code of Ordinances, by repealing Section 28-2303 in its entirety.

Explanation: Council reviewed the City permit fee for newspaper dispensing devices at the Committee-of-theWhole Meeting on September 19, 2017. City staff recommends eliminating said fee since it is no longer collected, and the newspaper dispensing devices have become obsolete.

2. Council Bill/General Ordinance 3021-2017

An Ordinance amending Chapter 11, “Fire Prevention And Protection,” of the Moline Code of Ordinances, Section 11-1101.1, “Fees,” by repealing subsection (d) in its entirety and enacting in lieu thereof one new subsection (d) dealing with the same subject matter.

Explanation: The pyrotechnic inspection and permit fees were approved by City Council on August 27, 2002, to ensure public safety at pyrotechnic events by regulating, inspecting, and enforcing City ordinances. Staff recommends increasing the $45.00/hour rate to $55.00/hour for on-site personnel costs.

Fiscal Impact: Increase $400 annually

3. Council Bill/General Ordinance 3022-2017

An Ordinance amending Chapter 11, “Fire Prevention And Protection,” of the Moline Code of Ordinances, Section 11-1101.1, “Fees,” by repealing subsection (g) in its entirety and enacting in lieu thereof one new subsection (g) dealing with the same subject matter.

Explanation: The language in the Quantity Ranges chart of Chapter 11, Section 11-1101.1 of the Moline Code of Ordinances was ambiguous. The appropriate changes have been made

7. Council Bill/Resolution 1157-2017

A Resolution authorizing the Mayor and City Clerk to adopt the Rules and Regulations for Motorized Food Vendors in the City of Moline.

Explanation: The City Council supports food trucks a/k/a motorized food vendors within the City of Moline, and in an effort to streamline the licensing and approval process, staff has compiled the Rules and Regulations for Motorized Food Vendors within the City. Additional documentation attached.

8. Council Bill/Resolution 1158-2017

A Resolution declaring various items of antiquated and unused weapons and firing range parts and equipment as surplus property, and authorizing the City Administrator to dispose of same.

Explanation: The Police Department currently has several antiquated weapons and firing range parts and equipment that were purchased decades ago and are no longer used. The items are detailed on Exhibit A. City staff is requesting that the items be declared as surplus property and disposed of by the City Administrator or his designee through the legal disposal process that is most advantageous to the City, whether sealed bid, auction, negotiation, or otherwise. 9. Council Bill/Resolution 1159-2017

A Resolution authorizing the purchase and installation of an IDAS Digital 2-Way Radio System from Reliable Communications Corporation, for the amount of $140,586.75.

Explanation: Public Works has budgeted to replace the existing 2-way radio system, which is scheduled to be taken out of service within the next year. After considerable investigation, it has been determined that a Digital Ultra-High Frequency 6.25 KHZ radio system is the most cost effective solution. The National Association of State Procurement Officials (NASPO) has established government contract pricing for ICOM radios and equipment. Reliable Communications Corporation in Davenport, Iowa, currently holds said contract. Additional documentation attached.

10. Council Bill/Special Ordinance 4043-2017

A Special Ordinance declaring the City-owned property at 1151 26th Street Moline surplus and authorizing the Mayor and City Clerk to execute an Agreement for Sale of Real Estate and do all things necessary to convey the property to Moline Community Development Corporation, an Illinois Not-For-Profit Corporation.

Explanation: As a result of City Council goal setting, the Moline Community Development Corporation (MCDC) was created in 2008. Part of MCDC’s mission is to provide quality housing for low to moderate income families and to foster neighborhood improvement. The City recently took possession of an abandoned, single-family home at 1151 26th Street after it was donated by then owner Wells Fargo Bank N.A. Wells Fargo, when donating the property, also gave the City $7,500.00 to be used towards the demolition or rehabilitation of the property. To provide momentum to MCDC’s efforts, MCDC is interested in rehabilitating the single-family home on the lot and selling it to a qualified family. MCDC has offered to purchase the property for $1.00. Under the terms of the proposed Agreement, the $7,500.00 donated to the City by Wells Fargo would be given to the MCDC to use in the rehabilitation. The rehabilitation and sale of the single-family home at this location will restore the blighted property and increase the property tax base in the future. Additional documentation attached.

11. Council Bill/General Ordinance 3026-2017

An Ordinance amending Chapter 4, “Alcoholic Beverages,” of the Moline Code of Ordinances, Section 4-1100, “Definitions,” by repealing subsection (11), “Minor,” in its entirety and enacting in lieu thereof one new subsection (11) dealing with the same subject matter; Section 4-5101, “Preparation Of Alcoholic Liquor,” by repealing said section in its entirety and enacting in lieu thereof one new Section 4-5101 dealing with the same subject matter; Section 4-5104, “Consumption,” by repealing subsection (b) in its entirety and enacting in lieu thereof one new subsection (b) dealing with the same subject matter; and Section 4-5110, “Responsibility Of Owner Or Occupant Of Premises,” by repealing said section in its entirety and enacting in lieu thereof one new Section 4-5110 dealing with the same subject matter.

Explanation: Pursuant to a request by local businesses, the Local Liquor Control Commissioner and City staff recently reviewed the City’s limitation on minors working at liquor licensed establishments. Due to the low unemployment rate, it is difficult for liquor licensed establishments to find employees. Many local residents over 18 years of age, but under 21 years of age, work in liquor licensed establishments in Iowa, where it is permissible, instead of in Moline, which is more restrictive than Illinois law provides, and allows only persons 21 years of age and older to tend bar or pour, draw, mix, sell or serve alcoholic beverages. Given this, it would be in the City’s best interest to allow persons 18 years of age and older to work in liquor licensed establishments in the City. Consideration Requested.

12. Council Bill/General Ordinance 3027-2017

An Ordinance amending Chapter 35, “Zoning And Land Development,” of the Moline Code of Ordinances, by enacting thereto an amendment of the Zoning Map, incorporated therein as Section 35- 3103 (City of Moline; 1536 24th Avenue).

Explanation: The Plan Commission held a public hearing on September 13, 2017, to hear a request from Mike VanAcker to rezone property located at 1536 24th Avenue from R-2 One-Family Residence District to NC Neighborhood Center District in order to maintain the property as a parking lot and to have the ability to add a storage garage. The Plan Commission, after public hearing, made a motion to make a recommendation to the City Council to amend the zoning for 1536 24th Avenue. Additional documentation attached.

13. Council Bill/Special Ordinance 4044-2017

A Special Ordinance granting a variance to Chapter 34, “Water And Sewers,” Section 34-3403, “Environmental Remediation Wastewaters,” of the Moline Code of Ordinances, to negotiate an Environmental Remediation Wastewaters (ERW) discharge fee, and authorizing the Director of Public Works to negotiate an Environmental Remediation Wastewaters (ERW) discharge fee with the Illinois Department of Transportation for the construction of the I-74 Bridge.

Explanation: The I-74 Bridge construction requires dewatering and removal of groundwater, and the groundwater in question has been classified as Environmental Remediation Wastewater (ERW), which requires treatment. The City has a Publicly Owned Treatment Works and wastewater collection system capable of receiving the ERW, and Section 34-3403 of the Moline Code of Ordinances defines the requirements and fees associated with the discharge of ERW to the City’s Publicly Owned Treatment Works (POTW). The volume of ERW expected to be discharged from the bridge construction is significant, and in the spirit of intergovernmental cooperation as permitted by state law, staff would like to negotiate a fee for the discharge instead of strictly adhering to the normal fee schedule for such discharge given the amount and given the importance of the project from which the discharge is resulting. Additional documentation attached. The fee defined within Section 34-3403 was intended for smaller volumes of ERW.
