1. Council Bill/General Ordinance 3027-2017

An Ordinance amending Chapter 35, “Zoning And Land Development,” of the Moline Code of Ordinances, by enacting thereto an amendment of the Zoning Map, incorporated therein as Section 35-3103 (City of Moline; 1536 24th Avenue).

Explanation: The Plan Commission held a public hearing on September 13, 2017, to hear a request from Mike VanAcker to rezone property located at 1536 24th Avenue from R-2 One-Family Residence District to NC Neighborhood Center District in order to maintain the property as a parking lot and to have the ability to add a storage garage. The Plan Commission, after public hearing, made a motion to make a recommendation to the City Council to amend the zoning for 1536 24th Avenue. Additional documentation attached.

2. Council Bill/Resolution 1160-2017

A Resolution authorizing the use of General Fund Contingency to donate $2,500 to the Moline School District to assist in replacing school supplies and classroom materials that were lost in a fire.

Explanation: On Sunday, September 24, 2017, a fire started at Franklin Elementary School. The fire started in a classroom that was heavily damaged, and the adjoining rooms and hallways sustained smoke and water damage. Teachers and students lost all supplies and materials that were inside the building. The City of Moline would like to donate $2,500 out of the 2017 General Fund Contingency to help recoup some items lost.

Fiscal Impact: $2,500 from the General Fund Contingency

3. Council Bill/Resolution 1161-2017

A Resolution authorizing the Mayor and City Clerk to execute an Agreement between Bi-State Regional Commission and the Governments of East Moline, Milan, Moline, Rock Island, Silvis, and Rock Island County, Illinois, for contractual services related to the preparation and monitoring of a contract for Enterprise Zone application assistance and requiring each of the municipalities to pay a share of the cost for said Agreement

Explanation: The Cities of East Moline, Moline, Rock Island and Silvis, the Village of Milan, and the County of Rock Island applied to designate an area as an Enterprise Zone for certification by the Illinois Department of Commerce and Economic Opportunity; however, the application was not granted. The member communities of the Quad City Enterprise Zone now wish to retain a firm for contractual services related to the holding and administration of a contract for a new Enterprise Zone application assistance and technical support. The City’s share of the cost for said services is $25,749. Bi-State will be responsible for administering the contract. Additional documentation attached. This item will also appear on the City Council Agenda on October 17, 2017, under “Items Not on Consent.”

4. Council Bill/General Ordinance 3028-2017

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Appendix 10 thereof, “Parking Prohibited At Any Time,” by including 46th Street, on both sides, at a distance of 75 feet north of 21st Avenue for a distance of 200 feet north.

Explanation: Traffic Committee reviewed request and recommends approval.

5. Council Bill/General Ordinance 3029-2017

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Section 20-5128, “Impoundment For Unpaid Violations,” by repealing subsection (h) in its entirety and enacting in lieu thereof one new subsection (h) dealing with the same subject matter.

Explanation: The boot fee for vehicles with unpaid violations does not cover the costs associated with enforcing this policy. Staff recommends increasing the fee to One Hundred Fifty Dollars ($150.00).

Fiscal Impact: Increase of $1,500

6. Council Bill/General Ordinance 3030-2017

An Ordinance amending Chapter 17, “Licenses And Business Regulations,” of the Moline Code of Ordinances, Section 17-7111, “Applications For Relocator’s Licenses,” by repealing subsection (a) in its entirety and enacting in lieu thereof one new subsection (a) dealing with the same subject matter.

Explanation: During the 2017 fee review, staff decided to move the due date of January 1st to May 1st of every year. This change is to streamline due dates of licenses to be the same and make the City of Moline more business friendly.

7. Council Bill/General Ordinance 3031-2017

An Ordinance amending Chapter 17, “Licenses And Business Regulations,” of the Moline Code of Ordinances, Section 17-8116, “Suspension Or Revocation; Grounds,” by repealing subsection (5) in its entirety and enacting in lieu thereof one new subsection (5) dealing with the same subject matter. Explanation: During the 2017 fee review, staff decided to update the language regarding the suspension and revocation of false alarm permits.

8. Council Bill/General Ordinance 3032-2017

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Section 20-5128, “Impoundment For Unpaid Violations,” by repealing subsection (a) in its entirety and enacting in lieu thereof one new subsection (a) dealing with the same subject matter.

Explanation: During the 2017 fee review, staff decided to increase the accumulated outstanding parking tickets from fifty dollars ($50.00) to one hundred dollars ($100.00), because parking ticket prices have risen over the years. Raising the outstanding ticket amount allows a citizen to have four (4) outstanding tickets, instead of only two (2) and being charged the boot fee of one hundred fifty dollars ($150.00) plus the outstanding ticket amount.

9. Council Bill/General Ordinance 3033-2017

An Ordinance amending Chapter 22, “Offenses - Miscellaneous,” of the Moline Code of Ordinances, Section 22- 1105, “Tobacco Products, Tobacco Accessories, Smoking Herbs And Alternative Nicotine Products,” by repealing subsection (d) in its entirety and enacting in lieu thereof one new subsection (d) dealing with the same subject matter.

Explanation: During the 2017 fee review, staff decided to move the tobacco dealer’s license due date of the anniversary of issuance each year to May 1st each year thereafter. This change is to streamline due dates of licenses to be the same and make the City of Moline more business friendly.

10. Council Bill/General Ordinance 3034-2017

An Ordinance amending Chapter 18, “Special Business Licenses And Events,” of the Moline Code of Ordinances, Section 18-1101, “Application,” by repealing Section 18-1101 in its entirety and enacting in lieu thereof one new Section 18-1101 dealing with the same subject matter.

Explanation: During the 2017 fee review, staff decided to update the language regarding Youth Club/Dance licenses. The language has been updated to change the location requirements making it easier for youth clubs and dance businesses to open in the City of Moline.

11. Council Bill/General Ordinance 3035-2017

An Ordinance amending Chapter 4, “Alcoholic Beverages,” of the Moline Code of Ordinances, Section 4-3208, “License Fees,” by repealing subsection (e) in its entirety and enacting in lieu thereof one new subsection (e) dealing with the same subject matter. Explanation: During the 2017 fee review, staff decided to update the fee structure of liquor license Class J.

12. Council Bill/General Ordinance 3036-2017

An Ordinance amending Chapter 5, “Amusements,” of the Moline Code of Ordinances, Article I, “Amusement Devices,” by repealing Article I in its entirety and enacting in lieu thereof one new Article I entitled “Video Gaming.”

Explanation: During the 2017 fee review, staff had three recommendations of fees to eliminate. The first recommendation was to eliminate the fees on bowling alleys, tennis courts, and racquetball courts. The second recommendation was to remove the regulation of all coin-operated devices of all types. The third elimination was for amusement arcade licenses; this was originally implemented to reduce truancy and juvenile delinquency, which is no longer an issue in our community concerning said amusements.

Fiscal Impact: Decrease of $18,820 annually

13. Council Bill/General Ordinance 3037-2017

An Ordinance amending Chapter 34, “Water And Sewers,” of the Moline Code of Ordinances, by amending Section 34-2119, “Application For Service,” by repealing said section in its entirety and replacing it with one new Section 34-2119 dealing with the same subject matter; by amending Section 34-2120, “No Service At New Location Until Payment Of Delinquent Charges,” by repealing said section in its entirety and replacing it with one new Section 34-2120 dealing with the same subject matter; and by amending Section 34-3205 “Partial Payments,” by repealing said section in its entirety and replacing it with one new Section 34-3205 dealing with the same subject matter.

Explanation: Council reviewed user fees at the Committee-of-the-Whole Meeting on September 26, 2017. City staff recommended eliminating the utility service deposit.

14. Council Bill/General Ordinance 3038-2017

An Ordinance amending Chapter 34, “Water And Sewers,” of the Moline Code of Ordinances, Section 34-2124, “Owners To Protect Meters”, by repealing subsection (a) in its entirety and replacing it with one new subsection (a) dealing with the same subject matter.

Explanation: Council reviewed user fees at the Committee-of-the-Whole Meeting on September 26, 2017. City staff recommended adding a meter service fee.
