Second Reading Ordinances

1. Council Bill/General Ordinance 3040-2017

An Ordinance levying and assessing taxes for the City of Moline, Illinois, for the tax levy year 2017, collectible in 2018, and enacting an ordinance relating to the same subject matter.

Explanation: Annually, the City of Moline levies a tax on all real property within the City. It is collectible the following year and utilized as a revenue source for the budget. The recommended 2017 Tax Levy is $15,620,000. No public hearing is required as the levy is less than 105% of the previous year.

Fiscal Impact: The levy must be passed and filed with the County Clerk in order to extend property taxes for the municipal portion of the property tax bill and will fund a portion of the 2018 budget.

Public Notice/Recording: This ordinance must be filed with the County Clerk by the last Tuesday in December.

2. Council Bill/General Ordinance 3041-2017

An Ordinance levying a special Ad Valorem Tax within the City of Moline, Illinois, Special Service Area #5 of the City of Moline, Illinois, for the tax levy year 2017, collectible in 2018, and enacting an ordinance relating to the same subject matter.

Explanation: On November 15, 2005, the City Council adopted Ordinance No. 4068-2005 establishing a Special Service Area. As provided by the Special Service Area Act, the services are to be provided through a levy of an annual property tax. For 2017, a levy of $132,465 is required to fund the 2018 budget. No public hearing is required as the levy is less than 105% of the previous year.

Fiscal Impact: Special services provided will be paid by the property owners within the established Special Service Area #5.

Public Notice/Recording: This ordinance must be filed with the County Clerk by the last Tuesday in December 2017.

3. Council Bill/General Ordinance 3042-2017

An Ordinance levying a special Ad Valorem Tax within the City of Moline, Illinois, Special Service Area #6 of the City of Moline, Illinois, for the tax levy year 2017, collectible in 2018, and enacting an ordinance relating to the same subject matter.

Explanation: On July 15, 2008, the City Council adopted Ordinance No. 4034-2008 establishing Special Service Area #6. As provided by the Special Service Area Act, the services are to be provided through a levy of an annual property tax. For 2017, a levy of $269,225 is required to fund the 2018 budget. No public hearing is required as the levy is less than 105% of the previous year.

Fiscal Impact: Special services provided will be paid by the property owners within the established Special Service Area #6.

Public Notice/Recording: This ordinance must be filed with the County Clerk by the last Tuesday in December.

4. Council Bill/Resolution 1174-2017

A Resolution authorizing the Mayor and City Clerk to execute a Fourth Amendment to the Intergovernmental Agreement between the City of Moline, Illinois, and Rock Island County Metropolitan Mass Transit District (MetroLINK).

Explanation: MetroLINK instituted a program to encourage the use of natural gas as a fuel to power certain of its vehicles and vehicles of other entities and executed an Intergovernmental Agreement (“Agreement”) with the City to locate a compressed natural gas (“CNG”) fueling station and fueling equipment at the City’s Public Works fuel island at 3635 4th Avenue, Moline (“station”) on March 5, 2002, for a term of seven years with an option for renewal of an additional seven years. Subsequent amendments to the Agreement have extended the renewal term for a ten-year period commencing December 18, 2012, with an automatic renewal of an additional ten years and modified certain other terms. City fleet now has twenty-three vehicles and pieces of equipment operating on CNG and fueling at the station maintained by MetroLINK. The parties agree that the future viability and reliability of the station is as important for the City as it is for MetroLINK, as the City is now the primary user of the station. MetroLINK is planning to invest in upgrades and replace an existing dispenser that is at the end of its useful life. The City believes adding an additional dispenser is in the City’s best interest to ensure that its vehicles and equipment can refuel as efficiently as possible. The parties agree that the City should share in the cost of maintaining this station after MetroLINK’s upgrades and improvements have been completed. Additional documentation attached.

Fiscal Impact: Funds available to be used towards cost sharing of maintenance and improvements in account 448-0867-437.07-03, with $76,565.62 currently available.

5. Council Bill/Resolution 1175-2017

A Resolution authorizing the Planning and Development Department to apply to the Illinois Housing Development Authority for a 2018 Abandoned Residential Property Municipality Relief Program, Round 3 Grant in the amount of $75,000 for the City; and authorizing City staff to do any and all things necessary to apply for the 2018 Abandoned Residential Property Municipality Relief Program, Round 3 Grant.

Explanation: As demonstrated by the City’s past and current code enforcement activities, there is a continued need for additional code enforcement compliance of abandoned residential structures and additional resources needed to assist with the removal of deteriorated structures within the City. Staff would like to apply for the 2018 Abandoned Residential Property Municipality Relief Program, Round 3 Grant in the amount of $75,000. The funding will provide assistance for eligible uses with abandoned residential properties. Additional documentation attached.

6. Council Bill/Resolution 1176-2017

A Resolution authorizing the Mayor and City Clerk to execute and make certain certifications and assurances related to the Illinois Department of Transportation’s Enhancement Program grant requirements and conditions to design and construct a multi-use trail in the City of Moline; supporting a grant application to the Illinois Department of Transportation for the Enhancement Program grant; and authorizing staff to do any and all things necessary to prepare and submit said grant application to the Illinois Department of Transportation for the Enhancement Program grant.

Explanation: City Planning and Engineering staff are developing a grant application for the purpose of making a funding request through the Illinois Department of Transportation’s (IDOT’s) ITEP program in an amount not to exceed $2,000,000 that would be matched by local funds in an amount of approximately 20% ($400,000) of the actual funding request, although property-related expenditures are to be matched at 50% so the total local match could exceed $400,000. The funding request would be used to support activities related to design and construction of a multi-use trail that would connect to the new trail facility on the new I-74 Mississippi River Bridge and then follow an alignment southward to the intersection of 27th Street and 38th Avenue. The multiuse trail concept would be an implementation of the River to River Corridor Plan, which established the concept of developing a multi-use trail along the 19th/27th Street corridor that would connect the Mississippi Riverfront trail system with the Rock Riverfront trail system as well as provide a connection to neighborhoods, business districts, and points of interest along the trail alignment.

Fiscal Impact: Local match not to exceed $600,000. Motor Fuel Tax funds are expected to be used for the local match.

7. Council Bill/Resolution 1177-2017

A Resolution authorizing the Mayor and City Clerk to enter into an agreement with Ottosen, Britz, Kelly, Cooper, Gilbert & DiNolfo, Ltd., of Naperville, Illinois, for professional legal services related to collective bargaining for a period of one year commencing November 15, 2017.

Explanation: Staff believes it would be in the City’s best interest to work with Ottosen, Britz, Kelly, Cooper, Gilbert & DiNolfo, Ltd., of Naperville, Illinois, for collective bargaining with the IAFF union. This law firm is experienced with negotiations and has concentrated in the representation of local governments, including previous work with City Administrator Maxeiner. 8. Council Bill/General Ordinance 3044-2017

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Section 20-5124, “Unauthorized Persons Using Persons With Disabilities Parking Spaces; A Violation,” Appendix 24, “Persons With Disabilities Parking Spaces,” by adding one on-street stall at 1721 7th Street.

9. Council Bill/General Ordinance 3045-2017

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Appendix 10 thereof, “Parking Prohibited At Any Time,” by adding 60th Street, on both sides, from Coal Town Road, at a distance of 675 feet north.

Explanation: Traffic Committee reviewed request and recommends approval.

10. Council Bill/General Ordinance 3046-2017

An Ordinance amending Chapter 31, “Taxation,” of the Moline Code of Ordinances, Article I., “Hotel-Motel Taxes,” by repealing Sections 31-1101(a) and 31-1102A in their entirety and enacting in lieu thereof new Sections 31-1101(a) and 31-1102A dealing with the same subject matter.

Explanation: The City of Moline enacted the Hotel-Motel Use Tax September 10, 2013. The City of Moline levied and imposed a tax of seven percent (7%) of the rent charged for the privilege of renting and use of a hotel or motel room within the City of Moline. The City of Moline wants to levy and impose the seven percent (7%) tax to include any person who rents a hotel or motel room for more than thirty (30) consecutive days or to a person who works and lives in the same hotel or motel effective January 1, 2018.

Fiscal Impact: Estimated $90,000 increase in revenues

11. Council Bill/General Ordinance 3047-2017

An Ordinance amending Chapter 35, “Zoning and Land Development,” of the Moline Code of Ordinances, by amending the Zoning Map, incorporated therein as Section 35-3103 (City of Moline; 2423 16th Street and 1535 25th Avenue).

Explanation: The Plan Commission initiated a rezoning of property located at 2423 16th Street and 1535 25th Avenue from R-2 One-Family Residence District to NC Neighborhood Center District. The Plan Commission, after public hearing on October 11, 2017, voted to recommend approval to City Council.

12. Council Bill/Special Ordinance 4049-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic; and authorizing use of public right-of-way in conjunction with the Rotary Ramble 5K, sponsored by the Rock Island Rotary, to be held on Sunday, December 3, 2017. Explanation: This 5K event has been reviewed and approved by the Special Events Committee for Sunday, December 3, 2017. The estimated number of persons to attend is 200.

13. Council Bill/Special Ordinance 4050-2017

A Special Ordinance establishing an Enterprise Zone in the City of East Moline, Illinois; City of Moline, Illinois; City of Rock Island, Illinois; City of Silvis, Illinois; Village of Milan, Illinois; and Rock Island County, Illinois.

Explanation: The Cities of East Moline, Moline, Rock Island and Silvis, the Village of Milan, and the County of Rock Island (“Jurisdictions”) created and amended from time to time the original Quad Cities Enterprise Zone, which included territories located in their jurisdictions, and will terminate on March 28, 2018. The Jurisdictions desire to come together for the purpose of applying for certification for a new enterprise zone by the Illinois Department of Commerce and Economic Opportunity. 14. Council Bill/Special Ordinance 4051-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute a Development Agreement between the City of Moline and I.H. Mississippi Valley Credit Union for the sale and redevelopment of Lots 1 and 2 of Riverbend Commons First Addition; and authorizing City staff to do all things necessary to effectuate the terms of the Agreement.

Explanation: I.H. Mississippi Valley Credit Union (IHMVCU) is seeking to construct its headquarters on City-owned property located at 2500 River Drive. In order to incentivize IHMVCU to construct its headquarters in Moline, the City has agreed to sell the property for $2,925,000, which includes upfront payment for certain public improvements, and to provide a financial incentive in the form of TIF rebates. Additional documentation attached.
