Second Reading Ordinances:

1. Council Bill/General Ordinance 3048-2017

An Ordinance dissolving the Special Tax Allocation Fund for the Bethany Property Redevelopment Project Area (Tax Increment Financing District No. 4) and terminating the designation of the Tax Increment Financing District No. 4 Redevelopment Project Area as a redevelopment project area.

Explanation: The City Council adopted on September 27, 2005, Ordinance Numbers 3061-2005, 3062-2005 and 3063-2005, which approved and adopted the City of Moline Tax Increment Redevelopment Plan and Project Area for the Bethany Property Redevelopment Project Area (commonly referred to as “TIF No. 4”), designated the Tax Increment Redevelopment Project Area for TIF No. 4, and adopted Tax Increment Financing for TIF No. 4. The project is now complete and the property has been redeveloped into a viable senior and assisting living development and all financial obligations have been fulfilled.

2. Council Bill/General Ordinance 3050-2017

An Ordinance amending Chapter 2, “Administration,” of the Moline Code of Ordinances, by repealing Section 2-2200, “Days, Time And Place Of Regular Meetings; Adjourned Meetings,” subsections (a) and (b) in their entirety, and enacting in lieu thereof new subsections (a) and (b) relating to the same subject matter.

Explanation: Sections 2-2200(a) and (b) of the Moline Code of Ordinances sets forth the days, time and place of the City’s Committee-of-the-Whole and City Council meetings. The City Council has requested that the meetings start time be changed from 5:30 p.m. to 6:00 p.m., effective on the first meetings date of 2018.

3. Council Bill/Special Ordinance 4052-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic; and authorizing use of public right-of-way in conjunction with the Resolution Run 5K, sponsored by YouthHope, to be held on Monday, January 1, 2018.

Explanation: This 5K event has been reviewed and approved by the Special Events Committee for Monday, January 1, 2018. This will be the second year for this event and the sponsor estimates the number of persons to attend to be 400; that number is an increase from last year’s estimate of 250.

Resolutions

4. Council Bill/Resolution 1180-2017

A Resolution authorizing the Interim Chief of Police to execute a Police K9 Sale of Animal and Waiver of Liability Agreement transferring ownership of Police K9 Luna, a Belgian Malinois, from the City of Moline to Officer Jonathan Genisio, her handler.

Explanation: The Police Department has determined that Police K9 Luna, a Belgian Malinois, is no longer fit to perform police duties and is being retired from public service. Public Act 099-0817, the Public Dog Retirement Act (effective date 01/01/2017), provides in part that a dog so retired shall be offered by the law enforcement agency to the officer who had custody and control of the animal during its service. Officer Jonathan Genisio, Police K9 Luna’s handler, has expressed his desire to take over ownership and care of the canine. The Police K9 Sale of Animal and Waiver of Liability Agreement releases and forever discharges the City from any and all claims relating to the canine after transfer ownership. 5. Council Bill/Resolution 1181-2017

A Resolution authorizing approval of a sole source purchase from JWC Environmental for a Monster Wash Press Compactor System for the amount of $32,750.

Explanation: The wash press for the main wet well at South Slope failed in July 2017. Staff initiated a search for replacement parts; however, none were found to be readily available, and they would need to be fabricated at a cost exceeding $40,000. When staff considered replacement, JWC Environmental was found to be the only known manufacturer that is able to custom build a new wash press unit with compatibility to South Slope’s step screen. The cost for the unit is $32,750. Additional documentation attached.

6. Council Bill/General Ordinance 3049-2017

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Section 20-4205, “Altered Speed Limits,” Appendix 35 thereof, “40 MPH speed limit,” by adding 34th Street, from 4th Avenue to 12th Avenue.

Explanation: A request to reduce the speed limit from 40 m.p.h. to 30 m.p.h. was made to Traffic Committee and was denied. During the review, it was determined that the 40 m.p.h. speed limit was never codified in the Code of Ordinances, and the Traffic Committee recommends that this be done.

First Reading Ordinances:

7. Council Bill/General Ordinance 3051-2017

An Ordinance making Appropriations for Corporate Purposes for the Fiscal Year beginning January 1, 2018, and ending December 31, 2018.

Explanation: This is the annual Appropriation Ordinance which is required to be passed by State statute. This Ordinance allows the City to expend funds during the fiscal year 2018.

Fiscal Impact: This Ordinance is necessary as an authorization granted by the City Council to make expenditures and to incur obligations during the fiscal year 2018
