An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Section 20-5124, “Unauthorized Persons Using Persons With Disabilities Parking Spaces; A Violation,” Appendix 24, “Persons With Disabilities Parking Spaces,” by removing one on-street stall at the following locations: 1918 9th Street; and 1628 28th Avenue.

4. Council Bill/General Ordinance 3010-2018

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Appendix 10 thereof, “Parking Prohibited At Any Time,” by removing the following locations: 8th Avenue, on the north side, adjacent to the City parking lot between 16th Street and 17th Street; and 8th Avenue, on the south side, from 16th Street east to the police department drive.

5. Council Bill/General Ordinance 3011-2018

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Appendix 10 thereof, “Parking Prohibited At Any Time,” by including 8th Avenue, on the north side, beginning 50’ east of 16th Street for a length of 40’.

6. Council Bill/General Ordinance 3012-2018

An Ordinance amending Chapter 35 “Zoning And Land Development” of the Moline Code of Ordinances, Table 35-3408 “Principal Commercial Land Uses,” “Land Use Regulations”

Explanation: The Plan Commission reviewed the zoning code as part of the City Council’s request and found what they believe to be an error in the land use table. The amendment will remove Sales and Service, In-Vehicle land uses as a special use in the O-1 District and add it as a special use in the B-1 District.

Resolutions

7. Council Bill/Resolution 1048-2018

A Resolution authorizing Information Technology staff to renew software support and maintenance package with Lucity. Inc.

Explanation: Funds are budgeted to renew Lucity, Inc’s software and support maintenance package. The City of Moline has utilized Lucity (formerly GBA Master Series) for the last 12 years as an enterprise work order and asset management system that links to the City’s Geographic Information System (GIS). It is utilized in the Water, WPC, Parks & Engineering divisions. The Water & WPC divisions heavily rely on Lucity for day to day administration of work orders between personnel in the office and field, as well as essential preventative maintenance management for City infrastructure.

Staff Recommendation: Approval

Fiscal Impact: $18,431.52 is budgeted in Account #443-0425-417.04-21

8. Council Bill/Resolution 1049-2018

A Resolution authorizing the Mayor and City Clerk to execute an agreement to accept funding and to do all things necessary to execute all assurances and certifications to the Illinois Housing Development Authority for the Abandoned Residential Property Municipal Relief Program Round 3 in the amount of $40,000.00; and authorizing the Planning and Development Department to begin work upon the execution of the agreement between the City and the Illinois Housing Development Authority to accept funding for the Abandoned Residential Property Municipal Relief Program Round 3 in the amount of $40,000.00, and to do all things necessary to implement said program requirements.

Explanation: The City of Moline Planning and Development Department previously applied for and has received a $40,000.00 Abandoned Residential Property Municipal Relief Program (APP) Grant from the Illinois Housing Development Authority. This grant will assist with the maintenance or demolition of abandoned residential properties within the City of Moline. These grant funds may be used for securing, maintaining, demolishing, or rehabilitating abandoned homes. This grant will assist with the removal of dangerous and dilapidated residential homes throughout the community. Additional documentation attached.

Resolutions

9. Council Bill/Resolution 1050-2018

A Resolution authorizing the Mayor and City Clerk to apply to the Illinois Department of Transportation for a highway permit and to execute the necessary forms in conjunction with the Quad Cities Distance Classic Half Marathon & 5K Races, sponsored by the Cornbelt Running Club, scheduled for Sunday, May 13, 2018.

Explanation: This annual event sponsored by the Cornbelt Running Club includes areas of the City of Moline and requires temporary lane closures within the City. Section 4-408 of the Illinois Highway Code authorizes the Illinois Department of Transportation (IDOT) to issue permits to local municipalities to temporarily close portions of State highways along event routes for such public purposes. Local approval of use of these routes is necessary before permission can be sought from IDOT.

First Reading Ordinances

10. Council Bill/General Ordinance 3013-2018

An Ordinance amending Chapter 21, “Nuisances In General,” of the Moline Code of Ordinances, by repealing Section 21-1100, subsection (19)(e), “Graffiti,” in its entirety and enacting in lieu thereof one new subsection (19)(e) dealing with the same subject matter.

Explanation: Code Section 21-1100(19)(e), “Graffiti,” provides that a property owner shall remove graffiti illegally placed upon his or her property upon written notice by the City and the removal shall be complete within 15 days of the notice date. The City wishes to change the graffiti removal period from 15 days to seven days to shorten the length of time graffiti is present as a nuisance on a property. The City’s written notice will be amended to reflect this change and to include language from subsection (19)(e) that the property owner may request assistance from the City, in writing, for the graffiti removal based on the owner’s inability to perform removal. The attached Exhibit A contains red-lined versions of the ordinance and the current notices used. Additional documentation attached.

11. Council Bill/General Ordinance 3014-2018

An Ordinance amending Chapter 35, “Zoning And Land Development,” of the Moline Code of Ordinances, Section 35-4218, “Sidewalks.”

Explanation: Staff proposes three amendments to the Code of Ordinances related to sidewalks. Revision to Section 35-4218 reflects the City Council’s direction on new sidewalk installations for new development and for infill locations.

12. Council Bill/General Ordinance 3015-2018

An Ordinance amending Chapter 28, “Streets And Sidewalks,” Section 28-3104, “Duty Of Abutting Owner To Maintain.”

Explanation: Staff proposes three amendments to the Code of Ordinances related to sidewalks. Revisions to Section 28-3104 eliminate unenforceable requirements placed on abutting property owners.

13. Council Bill/General Ordinance 3016-2018

An Ordinance amending Chapter 28, “Streets And Sidewalks,” Section 28-3200, “When Required; Engineer’s General Responsibility; Temporary Certificate Of Occupancy; Variances.”

Explanation: Staff proposes three amendments to the Code of Ordinances related to sidewalks. Revisions to 28- 3200 eliminate conflicts with the revised Section 35-4218.

14. Council Bill/General Ordinance 3017-2018

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Appendix 2 thereof, “Left Turn Restriction Intersection,” by removing 41st Street at 16th Avenue, westbound turning southbound, on school days when children are present.

Explanation: Washington Elementary Staff requested removal of the left turn restriction at the intersection of 41st Street and 16th Avenue. Traffic Committee reviewed request and recommends approval.

15. Council Bill/General Ordinance 3018-2018

An Ordinance amending Chapter 20, “Motor Vehicles And Traffic,” of the Moline Code of Ordinances, Appendix 2A thereof, “Right Turns Only,” by including 41st Street and 16th Avenue, westbound turning northbound, on school days when children are present.

Explanation: Washington Elementary Staff requested a right turn only sign to be placed at the intersection of 41st Street and 16th Avenue to alleviate congestion during school hours. Traffic Committee reviewed request and recommends approval.

16. Council Bill/Special Ordinance 4007-2018

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic and authorizing the use of public right-of-way in conjunction with the Annual QC Kiwanis Bags Tournament, sponsored by Moline Kiwanis, to be held on Saturday, April 28, 2018.

Explanation: The Special Events Committee has reviewed and approved this annual event to be held on Saturday, April 28, 2018. The estimated number of persons to attend is 150-200.
