Council Meeting: The City Council meeting came to order at 6:57 p.m. The Council met in regular session in the Council Chambers at City Hall.
Pledge: The Council and audience recited the Pledge of Allegiance.
Invocation: Alderman Parker gave an Invocation.
Roll Call: Roll call was taken with Mayor Acri, Aldermen Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg present. Absent: Alderman Rodriguez

Resolutions-
1. Council Bill/Resolution 1058-2018
A Resolution authorizing the Mayor and City Clerk to accept two (2) Permanent Utility and Drainage Easements more particularly described herein to allow construction to proceed on Project #1284, 32nd Street Reconstruction.
2. Council Bill/Resolution 1059-2018
A Resolution authorizing the Mayor and City Clerk to apply to the Illinois Department of Transportation for a highway permit and to execute the necessary forms in conjunction with the 2018 Komen Quad Cities Race for the Cure 5K and 1.2 Mile Walk/Run scheduled for Saturday, June 9, 2018.
3. Council Bill/Resolution 1060-2018
A Resolution authorizing the Mayor to execute an Intergovernmental Agreement between the City of Moline and the Illinois Department of Human Services setting forth the terms for acceptance of a grant award to the Police Department in the sum of $6,050.
4. Council Bill/Resolution 1061-2018
A Resolution authorizing the Utilities General Manager to execute Amendment No. 1 to the July 9, 2015, Agreement for General Services South Slope Wastewater Treatment Plant Phosphorus Planning-Related Services with Strand Associates Inc.
Omnibus Vote: Alderman Parker, seconded by Alderman Wendt, moved to approve and adopt, by omnibus vote, these items. Motion carried on roll call with the following vote: ayes: Aldermen Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.

5. Council Bill/Resolution 1057-2018
A Resolution authorizing the Mayor and City Clerk to execute a Contract with Langman Construction Inc. for Project #1287, 2018 Asphalt Project.
Approved: Alderman Parker, seconded by Alderman Berg, moved to approve Council Bill 1057-2018. Motion carried on roll call with the following vote: ayes: Aldermen Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; Alderman Schoonmaker abstained citing a business relationship.
First Reading Ordinances-
1.Council Bill/General Ordinance 3019-2018
A General Ordinance amending Chapter 35 “Zoning And Land Development” of the Moline Code of Ordinances, Section 35-3304, “Office Districts,” by repealing subsections (a) and (b) in their entirety and enacting in lieu thereof two new subsections dealing with the same subject matter; amending Table 35-3401.1 “Principal Commercial Land Uses,” “Land Use Regulations,” by adding (p) Sales and Service, limited land uses as a permitted use in ORT, B-1, NC, B-2, B-3 and B-4 Districts and as a special use in O-1 District; and amending Section 35-3408 “Principal Commercial Land Uses,” by enacting one new subsection “Sales and Service, Limited,” as subsection 35-3408(p).
Council, Staff and Citizen Comments:
Alderman Wendt explained that an Illinois Historic Preservation program freezes the assessed value of historic owner-occupied, principal residences for 8 years, followed by a four-year period during which the property’s assessed value steps up until the 12th year, when it will be at its then-current level. Alderman Wendt moved for review and certification of an incremental tax freeze. Seconded by Alderman Parker. Motion passed unanimously. Alderman Parker moved that the City modify the intersection at 15th Street and 24th Avenue from a 2-way to a 4-way stop. Seconded by Alderman Berg. City Attorney Riggs stated that erecting an unwarranted stop sign is in violation of Manual on Uniform Traffic Control Devices (“MUTCD”), which has been adopted as state and federal law. Additionally, an unwarranted traffic sign could increase City liability as courts have found that not following the MUCTD is considered to be a breach of the duty of care in negligence cases. Motion carried on roll call with the following vote: Ayes: Aldermen Parker, Wendt, Schoonmaker, Berg; nays: Aldermen Potter, Turner, and Waldron.
Alderman Schoonmaker explained that he has had some complaints about burning and asked what is being done to enforce and inform. Chief Snyder indicated that there have not been very many calls about burning and that the burn ordinance is provided on the City website. Chief Snyder explained that the only substance that should be burned is wood consistent with what you would burn in your home fireplace. Alderman Schoonmaker suggested that adding a reminder about yard waste disposal to the website banner might be helpful.
Alderman Schoonmaker complimented Parks Recreation Director Lori Wilson on the Sylvan Island project.
Public Works Director J.D. Schulte stated that Closed Loop funding for recycling carts is progressing.
Director Schulte also explained that the City is being recognized by the Historic Preservation Society for renovations made to City Hall this year.
Executive Session:
Alderman Berg, seconded by Alderman Wendt, moved for Executive Session, for the purpose of discussion of Property Acquisition-5 ILCS 120/2(C)(5). Motion carried on roll call with the following vote: Ayes: Aldermen Parker, Wendt, Potter, Turner, Schoonmaker, Waldron and Berg; nays: none.
City Council convened in Executive Session at 7:27 p.m.
Alderman Potter moved to adjourn Executive Session, seconded by Alderman Schoonmaker. Motion passed unanimously.
Council reconvened in open session at 7:40 p.m.
On motion of Alderman Waldron, seconded by Alderman Potter, Council adjourned at 7:40 p.m.
The next regularly scheduled City Council meeting is on May 8, 2018.
