1. Council Bill/Special Ordinance 3037-2018
A General Ordinance amending Chapter 21, “NUISANCES IN GENERAL,” of the Moline Code of Ordinances, Section 21-2102, “DEFINITIONS,” by enacting five new subsections (a)(22), (a)(23), (b)(11), (b)(12), and (b)(13).
Explanation: City Staff seeks to amend Chapter 21, “NUISANCES IN GENERAL,” of the Moline Code of Ordinances to add provisions concerning the Methamphetamine Control and Community Protection Act, 720 ILCS 646/1 et seq., and Prostitution as defined in 720 ILCS 5/11-14 et seq. 2. Council Bill/Special Ordinance 4053-2018
A Special Ordinance declaring the property at 402-404 4th Avenue, Moline, as surplus; and authorizing the Mayor and City Clerk to execute an Agreement for Sale of Real Estate, and do all things necessary to convey the City-owned property at 402-404 4th Avenue, Moline, to JMR Real Estate LLC.
Explanation: The property at 402-404 4th Avenue was previously used as the COP West police facility. However, the City no longer uses this facility for these purposes and has no other use for said property. The City published a request for proposals for the purchase and rehabilitation of 402-404 4th Avenue on August 22, 2018, and JMR Real Estate LLC (“Buyer”) submitted the sole proposal. Buyer has offered to purchase 402-404 4th Avenue for $15,000.00 and promises to complete interior and exterior repair and restoration of the building on said property by December 31, 2018, with possible extension of the completion date as may be agreed to in writing by the parties, but not later than March 31, 2019. Staff recommends accepting this proposal so this project can begin as soon as possible and result in the repair and restoration of the property. Buyer will be responsible for paying its pro-rated share of the 2018 taxes from the date of closing until December 31, 2018, and all future taxes thereafter. Additional documentation attached.
Fiscal Impact: Lower property maintenance expenses and increase the future property tax base.

3. Council Bill/Resolution 1130-2018
A Resolution authorizing the City Engineer to execute a Highway Permit with Rock Island County, Illinois, for the installation of the water main under County Highway 16, also known as 78th Avenue, as part of Project #1281 Radar Road Water Main Extension.
Explanation: The City is installing a water main under County Highway 16, also known as 78th Avenue, as part of Project #1281 Radar Road Water Main Extension, budgeted for 2018. A portion of the proposed water main will be located in the 78th Avenue Right-of-Way, and is under the jurisdiction of Rock Island County, therefore a Highway Permit is required. 4. Council Bill/Resolution 1131-2018
A Resolution authorizing the Mayor and City Clerk to adopt the Policy Statement of Design Principles for Design and Construction within the Moline Downtown Urban Redevelopment Zone for the City of Moline.
Explanation: The City Council supports a Policy Statement of Design Principles for Design and Construction within the Moline Downtown Urban Redevelopment Zone. The redevelopment zone is the area located south of the Mississippi River, north of 7th Avenue, east of 16th Street, west of 23rd Street between 7th Avenue and the railroad, and west of 25th Street/University Drive from the railroad to the Mississippi River. 5. Council Bill/Resolution 1132-2018
A Resolution authorizing the Mayor and City Clerk to accept an Assignment of Purchase Agreement between West Wind Corners Inc. and Jimmy Wang and Allison Lai for property located at 4808 27th Street, Moline, in the amount of $310,000, and to approve the terms of the Purchase Agreement; and authorizing City staff to do all things necessary to complete the transfer of the property to the City pursuant to the terms of the Assignment and the Agreement.
Explanation: The property located at 4808 27th Street, Moline, currently contains a vacant commercial building. The City of Moline wishes to acquire the property for eventual expansion of the South Slope Treatment Plant. Jimmy Wang and Allison Lai, as sellers, recently executed a Purchase Agreement with West Wind Corners Inc. for the purchase of the property for $310,000. West Wind Corners Inc. has agreed to sell, assign and transfer its full rights and interest in and to the Purchase Agreement to the City, thereby conveying the property to the City pursuant to the terms of the Assignment and the Agreement. Fiscal Impact: Sufficient funds are reserved in WPC fund.

6. Council Bill/Special Ordinance 3038-2018
An Ordinance amending Chapter 15, “GARBAGE AND TRASH,” of the Moline Code of Ordinances, Section 15-2100(a)(4), “Commercial and industrial buildings,” by enacting one new subsection (a) thereto pertaining to food establishments with drive-through service; and Section 15-2205, “PENALTY,” by enacting one new subsection (b) and consecutively renaming the remaining subsection.
Explanation: In an effort to reduce discarded plastic waste and similar waste materials from creating a public nuisance within the City and to further efforts of keeping such waste from reaching the river or other local water resources, the City Council wishes to amend the Code of Ordinances to add a requirement for a refuse container to be placed within the drive-through lane of any food establishment with drive-through service. This ordinance will require any new food establishment with drive-through service to install a refuse container within its drive through lane prior to opening of the establishment and any food establishment with current drive-through service to install the container within 18 months of the effective date of the ordinance. Such food establishments will be notified of this requirement.

7. Council Bill/Special Ordinance 3039-2018
An Ordinance amending Chapter 20, “MOTOR VEHICLES AND TRAFFIC,” of the Moline Code of Ordinances, Appendix 10 thereof, “PARKING PROHIBITED AT ANY TIME,” by including 25th Street, on the east side, from Avenue of the Cities north to the alley located between Avenue of the Cities and 19th Avenue.
Explanation: A request for no parking at the above designated location was reviewed and approved by the Traffic Committee on October 2, 2018.

8. Council Bill/Special Ordinance 3040-2018
An Ordinance amending Chapter 20, “MOTOR VEHICLES AND TRAFFIC,” of the Moline Code of Ordinances, Appendix 6 thereof, “YIELD INTERSECTIONS,” by repealing Fourteenth Street’s preference over Twenty-Fifth Avenue.
Explanation: On September 18, 2018, Committee-of-the-Whole approved a motion to replace the yield signs at the above designated location with stop signs.
