City of Colona City Council met Dec. 11.

Here is the minutes provided by the council:

CALL TO ORDER: 6:30 p.m.

ROLL CALL:

Mayor Lack, Attorney Wright, Aldermen Hillman, Feliksiak,

Swemline, Holman, Shady-Dahl, Jones, Clerk Winegar answered present. Alderman King, Tapscott were absent.

STAFF PRESENT:

M. Winters, Office Manager

C. Lenth, Public Works Director

M. Swemline, Police Chief

PUBLIC COMMENTS: None

MAYOR'S REPORT: None

APPROVAL OF MINUTES:

» Alderman Hillman made the motion to approve the council meeting minutes of October 28, 2019. Alderman Feliksiak seconded. Roll call: Aldermen Hillman, Feliksiak, Swemline, Holman, Shady-Dahl, Jones, voted yes. Aldermen King, Tapscott were absent. Motion passed with 6 affirmative votes, 2 absent.

CONSENT AGENDA: 

Alderman Swemline made the motion to approve consent agenda items:

1. Payment of bills for period October 29 - November 11, 2019 

2. Payment of manual bills for period October 29 - November 11, 2019 

3. Payroll for period October 26 - November 10, 2019

4. Treasurer's Report for October 2019 

Alderman Shady-Dahl seconded. Roll call: Aldermen Feliksiak, Swemline, Holman, Shady-Dahl, Jones, Hillman voted yes. Aldermen King, Tapscott were absent. Motion passed with 6 affirmative votes, 2 absent.

COMMITTEE REPORTS: 

Public Works Committee: (Alderman Swemline chair; Aldermen Jones, Feliksiak, members; C. Lenth, staff). A copy of these minutes is available at City Hall and on the

City's website.

1. Alderman Hillman made a motion to approve payment of $7,755,10 out of O&M Depreciation, 530-531-4160, Maintenance for repair of broken water main. Alderman Swemline seconded. Roll call; Aldermen Swemline, Holman, Shady Dahl, Jones, Hillman, Feliksiak voted yes. Aldermen King, Tapscott were absent. Motion passed with 6 affirmative votes, 2 absent. Alderman Holman questioned why we are voting on paying for this water main break because we have had water main breaks in the City before and just repair them. Chris Lenth said in those cases the City workers repair them; however, in this case we had to call in an outside contractor to fix it. Alderman Holman asked if anyone had checked with the insurance company to see if it may be covered. Mayor Lack instructed the Office Manager to check into the possibility the insurance may cover this break. 

2. Alderman Swemline made a motion to approve the use of the Clubhouse at no charge for a Girl Scout dance on October 23, 2020. Alderman Hillman seconded. An oral vote was called for receiving all ayes from the aldermen in attendance. Alderman Shady-Dahl asked if the dance had anything to do with Halloween; the response was no.

CLERKS REPORT: None

OLD BUSINESS:

> Mayor Lack began the discussion on whether or not the City would prepare an ordinance on the sale of cannabis in the City by informing the council that he had received sample ordinances covering the 3 percent sales tax, types of businesses, and recommended distances from schools, residences, etc. Alderman Shady-Dahl asked if there were somewhere to learn more about this issue. She asked when the deadline is for passing an ordinance on this subject. The Mayor replied that it was January, 2020; however, he had heard the deadline was being moved back. Alderman Jones suggested that a town meeting be held to get the residents' input before deciding on the council's course of action. Chief Swemline said that in the training he attended, if a city bans the sale of cannabis, they forfeit any and all sales taxes paid. Alderman Shady-Dahl asked how it would be transported. Chief Swemline replied in air tight containers. The Mayor concluded the discussion by stating the council will revisit the issue in the future now that the deadline has been moved.

NEW BUSINESS:

Alderman Holman made the motion to approve Ordinance 0-19-12, Amending Title 5, - Police Regulations, Chapter - 3 Minors, Paragraph 5-3-2: Cigarette or Tobacco Sales. Aldermen Swemline seconded. Roll call: Aldermen Holman, Shady-Dahl, Jones, Hillman, Feliksiak, Swemline voted yes. Aldermen King, Tapscott were absent. Motion passed with 6 affirmative votes, 2 absent.

ADJOURN: 

Alderman Swemline made a motion to adjourn. Alderman Hillman seconded. An oral vote was called with all ayes received. Motion passed. Meeting adjourned at 6:54 p.m.
