Explanation

1. An Ordinance amending the Zoning and Land Development Code of the City of Moline, Illinois, by enacting thereto an amendment of the Zoning Map, incorporated therein as Section 35-3310 (AMERCO Real Estate Company, 5000 Avenue of the Cities). (Ryan Berger, Land Development Manager)

Explanation: This ordinance approves a request for rezoning from B-3 (One-Family Residence District) to B-4 (Highway / Intensive Business District) on a tract of land located at 5000 Avenue of the Cities. The Plan Commission voted to recommend approval (3-2: ayes: Commissioner Trevor, Wermuth and Wetzel; nays: Commissioner Graves and Nelson) at its February 26th meeting.

2. A Resolution authorizing the Mayor and City Clerk to execute and attest to a contract with Denler Inc. for Motor Fuel Tax (MFT) Section 20-00000-01-GM, 2020 Joint & Crack Sealing Program, for the amount of $81,700. (Joe Kuhlenbeck, Building Official)

Explanation: Bids were opened and publicly read on February 4, 2020, for Motor Fuel Tax (MFT) Section 20-00000-01-GM with the following results:

Explanation: Bids were opened and publicly read on February 18, 2020, for Motor Fuel Tax (MFT) Section 20-00000-02-GM with the following results:

4. A Resolution authorizing the Chief of Police, on behalf of the City of Moline to execute a Memorandum of Understanding between the Federal Bureau of Investigations and the Quad Cities Bomb Squad, in which the Moline Police Department is a participant, formalizing the manner in which non-Federal officers, certified as bomb technicians through the FBI Hazardous Devices School (HDS), assigned to one of the five bomb squads within the Springfield Division, will have deputized authority while acting under direction and authority of the FBI. (Darren Gault, Chief of Police)

Explanation: The Moline Police Department wishes to execute a Memorandum of Understanding as a participating agency in the Quad Cities Bomb Squad to share available personnel, equipment, resources, and expertise in the Springfield Division of the FBI, to conduct Render Safe Procedures (RSP) on suspected IEDs and explosive disposal, and in some instances, investigation of explosive related incidents, as part of the counter terrorism initiative of the Springfield Division of the FBI. 5. A Resolution authorizing the Mayor and Chief of Police to execute an Equitable Sharing Agreement and Certification amendment between the Federal Government and the Moline Police Department setting forth the requirements for participation in the Equitable Sharing Program and certifying all receipts and expenditures of federal forfeiture funds, property and interest during the last fiscal year. (Darren Gault, Chief of Police)

Explanation: The Federal Government requires that the police department annually enter into a formal agreement and provide certification of receipts and expenditures of federal forfeiture funds and property. Following Council approval and electronic submission of this annual report, it was discovered funds received in the amount of $585 were allocated to the general ledger incorrectly in April 2019 and therefore not reported on the original ESAC report. The general ledger has been corrected and an amendment of the FY19 annual certification report to include receipt of these funds is hereby requested. Additional documentation attached.

GENERAL INFORMATION

Owner/Applicant: Amerco Real Estate Company

Requested Action: Rezoning from B-3 (Community Business District) to B-4

(Highway / Intensive Business District)

Location: 5000 Avenue of the Cities

Size of Tract: Approximately 11.5 acres

Existing Land Use: Vacant. Prior K-Mart.

Existing Zoning: B-3 (Community Business District)

Surrounding Land Use: North: B-3 East: B-3 South: R-6 West: R-2

BACKGROUND

The subject property is currently vacant but was previously K-Mart. The applicant is currently using the parking lot for U-haul moving services. Under the current B-3 zoning outdoor storage is permitted within the Sales and Services, Outdoor display land use. However, the applicant is also proposing indoor storage units. The indoor storage land use is not permitted in the B-3 zone but is permitted in the B-4 zone.

ANALYSIS AND REVIEW CRITERIA (see Sec. 35-2203 and Approval Criteria)

The subject property is located on Avenue of the cities near the 53rd Street intersection mostly surrounded by B-3 zoning.

Given the uniformity of the zoning designations and land uses in this area, it does not appear that the existing B-3 zoning was in error at the time of adoption. However, this area has seen notable change of character in recent years.

The use of the previous K-Mart site functioning as a “big box commercial” is similar to uses that are zoned as B-4. Additionally, that part of Avenue of the Cities used to be IDOT Highway jurisdiction and still is in neighboring communities. The size of the site is also substantially larger than others zoned as B-3. The average B-3 site is about 1 acre while the average B-4 zoned site is about 3 acres. The subject site is 11 acres making it more cohesive with the B-4 zone.

CONSISTENCY WITH THE COMPREHENSIVE PLAN

The site is located on the Avenue of the Cities. The Avenue of the Cities is called out in the Comprehensive Plan as having unique planning issues and a separate section is included that summarizes the significant findings and recommendations of past planning efforts. Recently the Avenue of the Cities Corridor Plan was added to the appendix of the Comprehensive Plan and the site under consideration is specifically discussed.

Within that corridor plan an additional outlot is proposed in the parking lot to enhance the level of commercial activity along the Avenue (see page 23 of that plan). In response, Uhaul will be providing two oulot locations facing the Avenue of the Cities. Additionally there is a proposed bike repair station to encourage the shared use between pedestrians, bicycles, transit, and cars discussed also discussed in the plan.

Chapter 10 of the Comprehensive Plan further states that the Future Land Use Plan of the site should be Commercial. Rezoning the site from a B-3 to a B-4 would be consist with that Future Land Use designation.

Finally, the proposed rezoning seems consistent with the following Goals as indicated in Chapter 7 of the Comprehensive Plan:

Goal #3: Business Development and Retention.

STAFF RECOMMENDATION

Staff recommends that Plan Commission approve the request to rezone the subject property from B-3 to B-4.
