City of Moline Plan Commission met Oct. 26.

Here are the minutes provided by the commission:

Present: Billy Allison, Zach Campbell, Victoria Graves, Cal Lee, Craig Loken, Craig Mack, Jeff Nelson, Butch Trevor & Cindy Wermuth

Absent: Bill Fitzsimmons, Brendan John

Staff: David Silverman (City Attorney), Dan Bolin (City Attorney)-electronically, Seán Foley, Ryan Hvitløk, Irene Muñoz, Janine Hollembaeck Parr

Others: Gail Thompson, Jodi Fisk

1. Call to Order

Chairman Mack called the meeting to order at 4:00 pm.

2. Approval of Minutes from October 12, 2022

Chairman Mack introduced new commissioner Craig Loken. City Clerk, Janine Hollembaeck Parr administered Mr. Loken’s oath of office.

Commissioner Graves expressed concern over the minutes being too detailed, a sort of quasi verbatim narrative, Commission Nelson agreed. Desire for broader, higher level summary minutes is sought while maintaining the tracking of issues. Attorney Silverman noted there should only be one official record. City Clerk Hollembaeck Parr stated audio recordings are kept for 18 months for good practice.

Motion made by Commissioner Jeff Nelson, seconded by Commissioner Victoria Graves to table approval of the October 12th minutes until next meeting. Motion carries unanimously.

4. New Business

a. Discussion on Accessory Dwelling Units (ADU) Ordinance

Discuss comments sent by Commissioner to Attorney Silverman for input on the draft ADU ordinance.

Mr. Hvitløk stated the Mayor’s public input gathering meeting on the Accessory Dwelling Units (ADU) Ordinance is scheduled for November 14th 6:00 p.m. at the Moline Library in the Bronze room. It was noted the input meeting will be publicized through social media and the City’s website.

Attorney Silverman stated he received comments from commissioners regarding the ADU draft ordinance. Commissioner Graves shared her prepared notes and concerns regarding the ADU Ordinance with the commission. Attorney Silverman discussed the ordinance revisions in response to the commissioners’ comments and re-iterated the ordinance is currently still a draft. Discussion was had over junior ADUs and conversion ADUs. Attorney Silverman discussed how the ADU rental process will tie in the building permit issuance process, and purchasers and buyers should be given a copy of the ordinance. He also noted the fire marshal should be included in the review. Within a two-week timeframe, a revised draft ordinance with the changes will be ready. Mr. Hvitløk will research and obtain statistics on affordable housing for the next meeting, which he will add to the public input meeting data to be gathered on November 14th.

b. Discussion on Electric Vehicle (EV) Readiness Ordinance

Attorney Dan Bolin stated city staff asked for a review of ordinances comparable communities are adopting for electric vehicles. Draft text amendments were presented for the commissioners’ review and feedback. Attorney Bolin noted the Building Official should review the ordinance as well and is looking for commissioners’ feedback on EV on public city property (omitting property in the right-of-way).

Discussion was had over the purpose of being EV ready. Commissioner Nelson, noted the importance of looking at dispensers and charging units in regards to Level 1, 2,& 3 chargers. Attorney Bolin, specifically asked, following council guidance for the commission, to look at whether the 20% number (proposed designated parking spaces for EV) is too high and to provide him feedback.

c. Plan Commission Training – November 9th, 2022

Chairman Mack stated EV ordinances will be added to our agenda for November 9th to further discuss the proposal. Attorney Silverman will send revised comments to Mr. Foley or Mr. Hvitløk to distribute to the commission before the November 9th meeting. A summary from the November 14th Mayor’s public input gathering meeting will be put in the December 7th agenda for review. Mr. Hvitløk stated a summary will be provided to the commissioners of what was learned at the November 14th meeting. November 9th is the landscaping (nonconformities Sections 35-3111 and 35-3112) public hearing; a short discussion of ADUs from Attorney Silverman’s revised draft ordinance; followed by one hour and half training. The formal public hearing for ADUs will be on the December 7th. Discussion will be held on December 14th regarding the EV, and tentatively the 2nd week of January will be the formal public hearing for the EV ordinance. Election of officers will take place at the same meeting. Commissioners will receive a refined version of the EV ordinance on December 14th.

5. Old Business

Discussion commenced for the first time over the proposed revisions to Section 35-1203 of the Zoning and Land Development Code revising certain definitions related to nonconformities and amending Article 3, Division 1, specifically Sections 35-3111 and 35-3112. Concern was expressed; solely bringing landscaping up to code for interior remodels, while omitting other parts of Article V improvement standards, will continue a blight factor. Additional feedback from the commission will be added during a future (date yet to be determined) public hearing.

∙ A cannabis dispensary special use permit application has been received that Attorney Bolin is reviewing, proposed for the John Deere Road corridor.

∙ A special use permit application was received for an auto repair business, near 4th avenue and the border of East Moline.

Motion made by Commissioner Wermeuth seconded by Commissioner Loken to adjourn. Motion carried unanimously.
