1. Council Bill/General Ordinance 3006-2017
An Ordinance Amending Chapter 4, “Alcoholic Liquor,” Of The Moline Code Of Ordinances, By Repealing Section 4-3322, “Option Vi Off-Site Retailer’s Special Use,” In Its Entirety And Enacting In Lieu Thereof One New Section 4-3322, “Option Vi Off-Site Retailer’s Special Use,” Dealing With The Same Subject Matter.
Explanation: Pursuant to a request by local businesses, the Local Liquor Control Commissioner and City staff recently met with said businesses to review potential changes to the City’s alcoholic liquor code. Following review, the Commissioner and staff determined that amending the Off-Site Retailer’s Special Use option for licensees to provide alcoholic liquors at off-site special events will promote local business and contribute to the vitality of the City. This amendment will mirror the state law as to special use permits.

2. Council Bill/Special Ordinance 4017-2017
A Special Ordinance authorizing the Mayor and City Clerk to execute an Intergovernmental Agreement to establish and operate the Illinois Quad Cities Communications Center (“QComm911”) between and among the City of Moline, the City of East Moline, the Village of Milan and the City of Silvis, Illinois.
Explanation: Legislative changes enacted in 2015 mandated decreasing the number of public safety answering points in any one county through consolidation. Moline, East Moline, Milan and Silvis have collaborated to establish QComm911 to be housed in the Milan Municipal Building. The Intergovernmental Agreement establishes the communications center, incorporates By-Laws, and details services, oversight and cost sharing by the parties. Additional documentation attached.

A Resolution authorizing the Mayor and City Clerk to accept one (1) Permanent Utility and Drainage Easement more particularly described herein to allow water improvements to proceed on 2912 28th Avenue A.

4. Council Bill/Resolution 1085-2017
A Resolution authorizing the Mayor and City Clerk to accept one (1) Right of Entry more particularly described herein to allow construction to proceed on Project #1262, I-74 Utility Conflict Resolution.
Explanation: Right of Entry is necessary and has been executed by Riverstone Group Inc., 190 22nd Street, to allow construction to proceed on Project #1262, I-74 Utility Conflict Resolution. Additional documentation attached.

5. Council Bill/Resolution 1086-2017
A Resolution accepting the actuarial valuation report submitted by MWM Consulting Group for the year ending December 31, 2016, for the City of Moline’s Other Post Employment Benefits Under GASB#45.
Explanation: Other post employment benefits (OPEB) is an accounting concept created by the Governmental Accounting Standards Board (GASB) by pronouncements designed to address expenses that governments are legally bound to pay after an employee retirees. For many years, most city governments have provided their employees with some form of retiree health care but have not addressed the benefits’ long term costs. This has created a financial liability. Since 2008, the City of Moline has been required to disclose the amount of the liability. This amount is determined by the use of an actuarial calculation based on the plan provisions, the employee data, and the actuarial methods and assumptions described in the report.

6. Council Bill/Resolution 1087-2017
A Resolution authorizing the Mayor and City Clerk to execute a $100,000.00 Revolving Loan Fund Agreement with Moline Promenade, LLC and to execute any necessary agreements referenced therein, and authorizing all appropriate City officers and staff to do all things necessary to complete each of the City’s responsibilities pursuant to said Agreement.
Explanation: The City of Moline approved Resolution No. 1101-2016 on August 2, 2016, authorizing the Mayor and City Clerk to execute a $100,000.00 Revolving Loan Fund Agreement with Moline Promenade, Inc. d/b/a Element Hotel. On March 27, 2017, the City was notified that the incorrect entity was listed on the loan application, and the applicant requested a name change on the approved loan from Moline Promenade Investors, Inc., to Moline Promenade Investors, LLC. 7. Council Bill/Resolution 1088-2017
A Resolution authorizing the Mayor and City Clerk to execute an Acknowledgment and Consent to the Collateral Assignment of TIF Property Tax Rebates of the Development Agreement for the Chase Bank Building Project.
Explanation: The City of Moline executed a Development Agreement with Moline 501, L.L.C. and Moline Chase L.L.C. (Developer) to facilitate the redevelopment of property located at 501 15th Street on September 27, 2016, through Special Ordinance No. 4054-2016, granting TIF assistance to the Developer. Developer’s lender, Blackhawk Bank & Trust, has agreed to make a loan to Developer for the development and construction of the Project. As further security for the loan to Developer, Developer seeks to assign all payment rights from the Development Agreement to the Bank until such time as all obligations of Developer to the Bank with respect to the loan have been satisfied, and the Bank and Developer are requesting that the City consent to such assignment. 8. Council Bill/Resolution 1089-2017
A Resolution approving the remote electronic attendance of Aldermanat-Large Sonia Berg, at the Committee-of-the-Whole and City Council meetings of May 23, 2017, due to her travel out of town as part of her current employment.
Explanation: Section 2-2200(e) of the Moline Code of Ordinances provides that any member of the City Council may attend and participate in any open or closed meeting of the City via electronic attendance provided that such attendance is in compliance with the rules set forth within said section and any other applicable laws. Alderman-at-Large Sonia Berg, (“Berg”) will be traveling out of town for purposes of her employment on May 23, 2017. Pursuant to Section 2-2200(e), absence due to employment purposes meets one of the prerequisites under which electronic attendance is allowed. A quorum must also be established and physically present at the meeting site following the roll call for each meeting to allow the electronic attendance to proceed at the meeting. During Berg’s remote electronic attendance, she shall be allowed to participate in the same capacity as those City Council members physically present at the meetings.

9. Council Bill/Resolution 1090-2017
A Resolution amending the Revolving Loan Fund Program Guidelines as recommended by City staff and the Revolving Loan Fund Committee.
Explanation: The City of Moline previously established the self-funded Revolving Loan Fund Program (RLFP) with adopted Guidelines (Resolution No. 1159-2014). The intent of the RLFP is to promote and create the expansion of businesses that create jobs. City staff and the Revolving Loan Fund Committee (RLFC) recommend further amending the Guidelines to provide greater detail of the composition and responsibilities of the RLFC. 10. Council Bill/Resolution 1091-2017
A Resolution authorizing the Mayor and City Clerk to approve Amendment #1 for the Local Agency Agreement for Federal Participation for Motor Fuel Tax Section 15-00264-00-BR, Sylvan Slough Pedestrian Bridge.
Explanation: The City of Moline will receive Federal transportation funds through the Illinois Department of Transportation in an amount not to exceed $1,137,600.00 to replace the existing pedestrian bridge over the Sylvan Slough. In September 2016, the City Council approved the Local Agency Agreement (LAA) with the Illinois Department of Transportation to accept the Federal funds and to acknowledge that the City will budget and use Motor Fuel Tax (MFT) funds to provide the required 20% local match. Approving this Amendment allows the Federal funds to also be used to fund construction inspection services. Additional documentation attached. 11. Council Bill/Resolution 1092-2017
A Resolution authorizing the Mayor and City Clerk to approve a Construction Engineering Services Agreement for Federal Participation for Motor Fuel Tax Section 15-00264-00-BR, Sylvan Slough Pedestrian Bridge.
Explanation: Missman, Inc. proposes to provide construction inspection services for the Sylvan Island Bridge project for the estimated amount of $111,409.48. The final contract value will be determined by actual hours worked and will follow the Illinois Department of Transportation’s Cost Plus Fixed Fee Method of Compensation. The Federal grant will fund 80% of the cost with the remaining 20% coming from the City’s Motor Fuel Tax (MFT) allocation. Additional documentation attached. 12. Council Bill/Special Ordinance 4018-2017
A Special Ordinance authorizing the Mayor and City Clerk to execute a Development and Economic Incentive Agreement between the City of Moline and Midwest Palms, LLC for the development project and to execute any necessary agreements referenced therein, and authorizing all appropriate City officers and staff to do all things necessary to complete each of the City’s responsibilities pursuant to said Agreement.
Explanation: Midwest Palms, LLC seeks to enter into a Development and Economic Incentive Agreement with the City to facilitate the development of the project consisting of the following properties: 1320 and 1322 49th Street. The project will consist of Developer purchasing the property and constructing 16 market rate condominium/townhouses. Developer is seeking assistance from the City due to the additional costs of utility infrastructure as an extension is required with individual connections for each unit. The City wishes to support the development by granting certain incentives. Additional documentation attached.
