Second Reading Ordinances

1. Council Bill/Special Ordinance 4024-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute a Quit Claim Deed between the City of Moline and Moline Forge Inc.

Explanation: As part of Project No. 1270, Alley North of 4th Avenue, West of 43rd Street, the City needs to convey previously vacated property to proceed. The City is quit claiming and conveying any and all interest in vacated right-of-way at that part of previously vacated Railroad Avenue (which would now be called 2nd Avenue), 40 feet in width, located between the west line of vacated 42nd Street and east line of 41st Street in Hunt’s 4th Addition to Midway, City of Moline, Rock Island County, Illinois, to Moline Forge, Inc. 2. Council Bill/Resolution 1111-2017

A Resolution authorizing the Utilities General Manager to purchase a Flygt pump for the Coal Creek Lift Station, in the amount of $15,700.

Explanation: One of the four pumps has failed at the Coal Creek Sanitary Sewer Lift Station. The quote to repair the pump is $11,388.44. Replacement of the pump with warranty costs $15,700. Under normal weather conditions, the lift station can function properly with three working pumps. The fourth pump serves as a backup and is only used in extreme rain events. Due to the uncertainty of extreme weather and potential liability created by such, and because the cost to repair the pump versus replacement is minimal, Staff recommends replacement of this pump.

After considerable investigation for the best technology available, Electric Pump has been determined to be the only supplier of Flygt pumps meeting the requirements for the present and future needs of the City. Additional documentation attached.

Fiscal Impact: A portion of the funds are budgeted in 320-1837-433.04-25, and the remainder is available in WPC reserves

3. Council Bill/Resolution 1112-2017

A Resolution authorizing the City Administrator and Chief of Police to execute an Intergovernmental Agreement between the City of Moline and the Quad City Metropolitan Enforcement Group for the period July 1, 2017 through June 30, 2018, setting forth the terms for the police department’s continued participation in this multi-jurisdictional law enforcement effort.

Explanation: The Quad City Metropolitan Enforcement Group (MEG) is a multi-jurisdictional law enforcement unit that combats illegal drug trafficking and the use and distribution of controlled substances. The police department has participated as a member of MEG since its formation in 1977. Previously, an updated agreement was only intermittently executed; however, the Department of Justice now requires MEG to annually renew its agreements with agencies. Additional documentation attached.

4. Council Bill/Resolution 1113-2017

A Resolution authorizing the Mayor and City Clerk to execute an Assignment Pledge and Security Agreement of Property Tax and Sales Tax Rebate Payments of Development and Economic Incentive Agreement for the Dolan Commons development project.

Explanation: The City of Moline entered into a Development Agreement with Dolan Commons, LLC (Developer), to facilitate the redevelopment of property located at 2701, 2715, and 2727 Avenue of the Cities, Moline, on September 13, 2016, granting property tax and business district sales tax assistance to the Developer. Developer’s lender, Northwest Bank & Trust Company, has agreed to make a loan to Developer, the proceeds of which have been used by Developer for the acquisition of the property and will be used for the redevelopment and construction of the project. As further security for the loans to Developer, Developer seeks to assign all payment rights under Lot 3 of the development agreement, consisting of redevelopment of the existing Aldi building site, to the Bank until such time as all obligations of Developer to the Bank with respect to the loans have been satisfied. First Reading Ordinances:

5. Council Bill/Special Ordinance 4026-2017

A Special Ordinance repealing Special Ordinance No. 4031-2016 which declared the prevailing rate of wages to be paid workers on public works projects, and ascertaining and declaring the prevailing rate of wages to be paid to certain laborers, mechanics and other workers performing public works for the City of Moline within Rock Island County.

Explanation: State statute requires the City annually adopt an ordinance setting prevailing wage to be paid on City projects. This Special Ordinance repeals Special Ordinance No. 4031-2016 which declared the prevailing wages for 2016. Additional documentation attached.

6. Council Bill/Special Ordinance 4027-2017

A Special Ordinance authorizing the Mayor and City Clerk to execute an Extension Agreement between Financial District Properties HQO, L.L.C., and the City of Moline.

Explanation: In September 2016, Financial District Properties HQO, L.L.C. (“Borrower”) was given an extension to make the final payment of their loan to the City to June 30, 2017. The current balance of the loan that is due and owing is $3,398,631.40. The Borrower proposes paying the remaining balance of the loan from the sale of property by it or of Unit 100 of the Kone Centre Condominiums, owned by Financial District Properties, KP, L.L.C. There is a signed purchase agreement for the sale of such property. However, the closing will not occur before June 30, 2017. The Borrower has requested an extension to August 22, 2017. This would give adequate time for the closing to occur. To grant this extension, the City is requiring that payment of its loan be listed on the closing or settlement statement for the closing of the property. Further, the City would not assign the current property tax rebates until its loan is paid in full. Additionally, if payment in full is not made on or before August 22, 2017, then by agreement of the parties, the City will add an additional $200,000.00 to the balance of the loan then due and payable. Further, Borrower agrees to pay any direct costs incurred by the City due to this extension. All other terms of all loan documents would remain in full force and effect.
