Second Reading Ordinances:

1.Council Bill/General Ordinance 3052-2017 An Ordinance amending Chapter 21, “Nuisances In General,” of the Moline Code of Ordinances, Section 21-1100, “Defined,” by enacting one new subsection (22) pertaining to garbage and debris; and Chapter 32, “Vegetation,” of the Moline Code of Ordinances, Section 32-1100, “Weed Abatement,” by repealing subsections (e) and (f)(1) in their entirety and enacting in lieu thereof new subsections (e) and (f)(1) relating to the same subject matter.

Explanation: City staff seeks to amend Chapter 21 of the Code of Ordinances to include garbage and debris as a nuisance and Chapter 32 to include garbage and debris in the City’s public notice regarding weeds, grass and shrubbery nuisance violations and abatement. Said amendments will add clarification to the Code and comply with current practices.

2. Council Bill/General Ordinance 3053-2017

An Ordinance amending Chapter 8, “Buildings And Other Construction And Building Services,” of the Moline Code of Ordinances, Section 8-4101, “Amendments To Moline Property Maintenance Code,” by enacting one new subsection (p) pertaining to method of service and consecutively renaming the remaining subsections of Section 8-4101.

Explanation: City staff seeks to amend Chapter 8 of the Code of Ordinances to include service by regular United States mail for notices of violations of the Moline Property Maintenance Code. This amendment will add clarification to the Code of Ordinances and comply with current practices.

3. Council Bill/Special Ordinance 4053-2017

A Special Ordinance requesting the County Clerk to not extend 2017 taxes for payment of all principal and interest on City of Moline General Obligation Corporate Purpose Bonds.

Explanation: Annually, the City of Moline instructs the County Clerk not to extend property taxes for municipal bonds. Principal and interest on all City General Obligation Bonds are paid from other revenue sources. The 2017 abatement ordinance must be filed with the County Clerk by the last day of January 2018. Additional documentation attached.

Fiscal Impact: This ordinance must be passed and filed or the County Clerk will extend additional property taxes for 2017 collectible 2018 tax bills.

4. Council Bill/Special Ordinance 4054-2017

A Special Ordinance authorizing the delivery to and sale of alcoholic liquors for City-approved special events at The Q.

Explanation: There has been interest in using the Grand Hall and public space at The Q for special events. The Illinois Liquor Code, 235 ILCS 5/6-15, prohibits the sale and delivery of alcoholic liquors to any municipal building unless authorized by ordinance of the corporate authorities. Approval of this ordinance will provide that authorization.

5. Council Bill/Special Ordinance 4055-2017

A Special Ordinance setting the annual meetings schedule for 2018; and authorizing City staff to do all things necessary to notify the media of the 2018 annual meetings schedule.

Explanation: Pursuant to City ordinance, an annual meetings schedule of the City Council’s proposed regular meetings for the next calendar year must be prepared and provided to any local media that has filed an annual request for said schedule. This ordinance will set the 2018 City Council Board/Committee Meetings Schedule and authorize the required notification. Additional documentation attached.

6. Council Bill/Special Ordinance 4056-2017

A Special Ordinance adopting a City of Moline policy entitled Policy Prohibiting Sexual Harassment.

Explanation: The Illinois General Assembly recently enacted Public Act 100-0554, dated November 16, 2017, which mandates that all Illinois governmental units adopt an ordinance or resolution establishing a policy to prohibit sexual harassment. The policy is to be adopted by January 15, 2018. Per the Act, all prior existing sexual harassment policies enacted by the City of Moline shall be superseded upon adoption of the new policy. Resolutions

7. Council Bill/Resolution 1191-2017

A Resolution authorizing the Mayor and City Clerk to execute an Agreement with USI Insurance for liability, property and workers’ compensation insurance for a period of one year commencing on December 31, 2017.

Explanation: USI Insurance is the current broker for the City’s liability, property and workers’ compensation insurance. USI has submitted an Agreement to provide coverage from December 31, 2017, through December 31, 2018. At $788,982, the proposal is 0.80% ($6,257) more than the amount budgeted for 2018. The increase from 2017 is 3.1% and is due, in part, to the increase in employment practices liability, property and workers’ compensation premium expenses. Of note, the cyber liability coverage was enhanced in 2017 for a premium of $11,753 and is not included in these figures, because that policy does not expire until May 23, 2018. The cyber policy will be adjusted to a calendar year starting in 2019. Additional documentation attached.

8. Council Bill/Resolution 1192-2017

A Resolution approving and accepting proposed changes to prior contract language as agreed to by and between the negotiators for the City of Moline and the International Association of Fire Fighters (IAFF), Local 581, relating to wages, hours of work and certain other conditions of employment for the contract term January 1, 2018, through December 31, 2018; and authorizing the Mayor and City Clerk to execute an Agreement incorporating said changes with the International Association of Fire Fighters (IAFF), Local 581, relating to wages, hours of work and certain other conditions of employment.

Explanation: As a result of negotiations, the negotiators for the City of Moline and the International Association of Fire Fighters (IAFF), Local 581, have agreed to certain proposed changes to the immediately prior contract language as set forth on the attachment marked Exhibit A. IAFF Local 581 is scheduled to vote on ratification on Monday, December 18, 2017. Pending their ratification, the negotiators for the City of Moline submit same for Council approval and acceptance and authority for the Mayor and City Clerk to sign a new Memorandum of Understanding for the contract term January 1, 2018, through December 31, 2018, incorporating the changes. Additional documentation attached.

9. Council Bill/Resolution 1193-2017

A Resolution approving the remote electronic attendance of Second Ward Alderman David Parker, Jr., at the Committee-of-the-Whole and City Council meetings of January 9, 2018, due to other City business.

Explanation: Alderman Parker has indicated that he will be tending to other City business as a board member for the Moline Housing Authority on January 9, 2018, but would like to attend the Committee-of-the-Whole and Council meetings electronically. Per Section 2-2200(e) of the Code of Ordinances, any member of the City Council may attend and participate in any open or closed meeting of the City via remote electronic attendance provided that such attendance is in compliance with the rules set forth within said section and any other applicable laws. Absence due to other City business meets one of the prerequisites under which electronic attendance is allowed. A quorum must be established and physically present at the meeting site following the roll call for the meeting to allow the electronic attendance to proceed at the meeting. No costs to the City are anticipated for Alderman Parker’s remote electronic attendance, which will be via teleconference. During Alderman Parker’s remote electronic attendance, he shall be allowed to participate in the same capacity as those City Council members physically present at the meetings.

10. Council Bill/Resolution 1194-2017

A Resolution authorizing the Utilities General Manager to approve Change Order #8 with Williams Brothers Construction Inc., for the North Slope Wastewater Treatment Plant Improvements Project, in the amount of -$5,803.93.

Explanation: Change Order #8 consists of 17 individual changes to the North Slope Wastewater Plant Improvements Project and includes many miscellaneous additions or deletions. Said change order reflects adjustments to meet field conditions encountered during construction or enhancements to the efficiency, functionality or longevity of the completed project that are summarized in the attached documentation. Change Order #8 decreases the current contract amount of $38,005,085.23 to $37,999,281.30. Additional documentation attached.

11. Council Bill/Resolution 1195-2017

A Resolution authorizing approval of a sole source purchase from Swaploader U.S.A. LTD., for a Hooklift Hoist and Accessories in the amount of $109,009.60.

Explanation: In 2016, Fleet Services budgeted to purchase a hooklift hoist and attachments for installation on four (4) new cab and chassis units for Streets Division. The continued use of SwapLoader U.S.A. LTD., Hooklift Hoist and Accessories will maintain the versatility of the City’s Fleet by allowing the reuse of existing attachments. The City’s use of SwapLoader U.S.A. LTD., Hooklift Hoist and Accessories began in 1996, and since then, the City has been allowed to purchase these items at dealer pricing. Staff requested and received a quote from SwapLoader U.S.A. LTD., for four (4) hooklift hoists and accessories in the amount of $109,009.60. Additional documentation is attached.

Second Reading Ordinances

12. Council Bill/General Ordinance 3054-2017

An Ordinance amending Chapter 23, “Parks And Recreation,” of the Moline Code of Ordinances, Section 23-2102, “Rules Of Conduct Applicable To All Parks,” by enacting one new subsection (c)(22) and one new subsection (d)(7) pertaining to the feeding of waterfowl in City Parks.

Explanation: Section 23-2102 of the Moline Code of Ordinances does not restrict the feeding of waterfowl in City parks. Park staff wishes to amend Section 23-2102 by enacting one new subsection (c)(22) to add a restriction that no person shall be permitted to provide and distribute food to any species of waterfowl within any City park. A new subsection (d)(7) would also be enacted to set a penalty provision for violation of Section 23- 2102(c)(22) so that any person violating said section would be subject to a fine of not less than $25 plus court costs and not more than $100 plus court costs. The Park & Recreation Board approved these changes at its August 24, 2017 meeting, with the exception of a fine of not less than $25 plus court costs and not more than $750 plus court costs. However, the City Council voted on December 12, 2017, to change the maximum fine from $750 plus courts costs to $100 plus court costs.

Resolutions

13. Council Bill/Resolution 1196-2017

A Resolution authorizing the Human Resources Manager to execute a policy with UnitedHealthcare-BP to provide reinsurance coverage for medical and prescription drug benefit claims for a one-year period commencing on January 1, 2018.

Explanation: A request for proposals was published, and UnitedHealthcareBP provided the proposal most advantageous to the City. UnitedHealthcareBP will provide specific and aggregate reinsurance for the City’s medical and prescription drug benefit plans for active employees and their dependents, as well as retirees under 65 and retirees’ dependents under 65. The City’s insurance is secondary to Medicare for medical claims of retirees 65 and older and retirees’ dependents 65 and older. This group will be shifted to a fully insured prescription drug plan (Employer Group Waiver Plan – EGWP) in 2018 with no change in benefits. Due to this transition, they are not being included in the reinsurance policy, because the exposure to the City is low. Expected annual costs for reinsurance total $275,117. The proposal reflects a 13% increase from 2017 rates, but is 20% ($70,693) less than the amount budgeted for 2018. Additionally, the fully insured prescription drug plan is estimated to save the Retiree Health Fund $120,327 in 2018. Additional documentation attached.

First Reading Ordinances

14. Council Bill/General Ordinance 3055-2017

An Ordinance amending Chapter 31, “Taxation,” of the Moline Code of Ordinances, Article I., “Hotel-Motel Taxes,” by repealing Sections 31-1101(a) and 31-1102A in their entirety and enacting in lieu thereof new Sections 31-1101(a) and 31-1102A dealing with the same subject matter.

Explanation: In November, 2017, the City of Moline approved a change to the ordinance to levy and impose the seven percent (7%) tax to include any person who rents a hotel or motel room for more than thirty (30) consecutive days or to a person who works and lives in the same hotel or motel effective January 1, 2018. Some Moline hotels have already negotiated contracts for long term stays and these hotels will be negatively affected by the ordinance change. This amendment would grandfather existing contracts for stays in excess of 30 days and not require payment of the tax for any contracts that were executed prior to December 5, 2017, for such stays. This exception expires on June 30, 2018. Consideration Requested.
