City of Geneseo Council met July 10.

City of Geneseo, Henry County, Illinois City Council July 10, 2018 6:00 P.M. Pledge of Allegiance Roll Call The City Council of the City of Geneseo met in a City Council meeting on Tuesday July 10, 2018 at the Council Chambers, 115 South Oakwood Avenue. Mayor Kathy Carroll-Duda called the meeting to order at 6:01pm. Aldermen Brett Barnhart, Bob Wachtel, Sean Johnson, Craig Arnold, Martin Rothschild, James Roodhouse, Paula Simosky and Jason Robinson were present. Others in attendance included, Administrator Lisa Kotter, City Clerk Loree K. Phlypo, City Attorney Derke Price, Director of Public Works Chad VanDeWoestyne, Director of Electrical Operations Lewis Opsal, Chief Casey Disterhoft, Director of IT Garrett Griswold, Inspector Rick Mills, HR Brandon Maeglin, Finance Director Jamie Matthews, Greg Ryckaert and Sharon Van De Woestyne. There was a quorum.
Chamber of Commerce Report Rhonda was not in attendance but handed out a narrative for Council. She thanked the City for the awesome July 3rd fireworks event and reminded everyone that the Porch Party Event is this weekend. For a complete list of Chamber events please go to www.geneseo.org
City Engineering Report Greg Ryckaert was in attendance and reported that the paving at the Mel Foster project is complete pending a walk through. Chicago street lift station permit should be arriving and the Hennepin Canal crossing costs are being reviewed due to the cost of the culvert. Hanford street drainage is in its final design state and then engineering can start.
Public Comment Resident Sharon Van De Woestyne at 528 W State Street reported that she feels that the City Animal Control is inadequate in that she reported that there was a stray cat in her yard and the animal control person showed up stating that they only had 2 traps and they couldn’t leave one unattended, if the resident agreed to watch the trap then they could leave it and the other one is in use. She is very disappointed in the City animal control system. Administrator Kotter thanked the resident for letting us know.

Consideration to adopt Resolution R-18-14
A Resolution for confined space entry policy/procedures. This was discussed at the Committee of the Whole with one change being, the section on discipline was added. With the adoption of this Resolution we will be OSHA compliant. Motion by Arnold, second by Roodhouse to approve Resolution R-18-14 which adopts a new confined space policy as presented.

Consideration to approve Resolution R-18-15 Which approves an agreement with the Humane Society to handle animal control services. Discussion was held at a prior meeting and the City Attorney prepared the agreement. Karen Russell from the Humane Society reported that there is a concern over the increase of required liability insurance, they carry 1 million and the agreement asks for 2 million. City Attorney Price stated that 2 million is the standard amount and with law enforcement involved it may be better to carry the 2 million, but it is completely up to the Council. Motion by Arnold, second by Rothschild to approve Resolution R-18-15 approving An Agreement with the Henry County Humane Society to provide animal control services with final wording being approved by the City Attorney and Mayor. Consideration to approve a change in the Park Reservation Fee Policy that all facility fees must be paid prior to a reservation being made and to create the refund policy as stated with a 50% retention if less than 30 days cancellation and a $10 administrative fee. Currently we don’t have a set policy on paying for a park reservation in advance and we have no cancellation policy. So, staff is suggesting with a 30 day notice we keep the $10 administrative fee and without a 30 day notice we keep 50% of the rental fee plus the $10 administrative fee. They can pay their fee online and then have to call in to reserve the date. Motion by Wachtel, second by Arnold to approve a Park Reservation policy that all facility fees must be paid prior to a reservation being made and to create a refund policy that 50% of the fees are retained plus $10 if the cancellation is 30 days or less and a $10 administrative fee if the cancellation is more than 30 days in advance. Consideration of Ordinance O-18-09 An Amendment to the Zoning Code – Placement of Structures in Easements. Plan Commission held a public hearing and have some questions to ask the City Attorney for clarification. Staff would like to see this return to the Plan Commission and the City Attorney be present for some questions. Some concerns included should all utilities in the easement be notified, will applicants be informed of their responsibility of being in a utility easement and if a structure is put in the easement that the City can gain access by any means and the homeowner bares the cost of replacement. City Attorney stated that the ordinance doesn’t need a laundry list that becomes outdated quickly. It was recommended that City Attorney Price meet with the Plan Commission board and Zoning board of Appeals to answer any questions that they may have on this item. Alderman Wachtel felt that it should be put off for a month so that Plan Commission can get their questions answered. Motion by Johnson, second by Arnold to approve Ordinance O-18-09 Amending the Zoning Code that allows a variance for placing structures in easements. ROLL CALL VOTE:

Consideration to approve Ordinance O-18-10 An Amendment to the Zoning Code – Regulations of and Application for Small Wireless Facilities. The City Attorney asked to table this item to the next City Council meeting on August 14. The City’s current height restrictions need to be reviewed and the Federal Government is still evolving requirements for this item. Motion by Arnold, second by Wachtel to table this item to the next City Council meeting.

Consideration to adopt Ordinance O-18-11 An Amendment to Sections 9-11-6:D and 9-13-1:D – Plan Commission Fee Increase. This was discussed at the Committee of the Whole. The out of pocket costs for the City are increasing and we at least want to recoup those costs. Motion by Wachtel, second by Roodhouse to approve Ordinance O-18-11 which amends the Zoning Code and increases the Plan Commission fees from $150.00 to $200.00. ROLL CALL VOTE:

Consideration of Ordinance O-18-12 An Ordinance permitting the building inspector to issue building permits in derogation of Section 10-2-9 of the Subdivision Code. The City Building Inspector doesn’t issue any permits until a development is completed and formally accepted by the City through the City Council. The City has been asked by the builder to issue a permit even though they aren’t finished with the streets. City Attorney Price put together a hold harmless agreement that the builder and developer must sign and then the Building Inspector can issue a building permit prior to work being completed. Nicor is the delay on the utility side. There are 45 lots in the first phase. Motion by Rothschild, second by Arnold to approve Ordinance O-18-12 An Ordinance permitting the building inspector to issue building permits in derogation of Section 10-2-9 of the Subdivision Code.
