Meeting Called to Order

Chairperson Nelson called the meeting to order at 4:00 p.m.

Roll Call of Members

Roll call performed; Chairperson Nelson and Commissioners Lindsey present. Commissioner Flowers absent.

Approval of Minutes

Commissioner Lindsey moved to approve the April 11, 2023, Regular Meeting Minutes; seconded by Chairperson Nelson; motion carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

Communications

Discussion was held between city staff, city corporate council and the commissioners regarding executive session minutes and recordings. City corporate council advised when discussion is required of Executive Session minutes they should be reviewed in executive session with final action taken upon return to open session. If no discussion is needed executive session minutes may be approved by omnibus vote in regular open session.

Discussion was held between city staff, city corporate council and the commissioners regarding the commissioners’ ability to appoint personnel contingent upon successful completion of all pre-employment requirements. City staff requests that this be permissible due to the strict timeline of the hiring, testing and academy process. City corporate counsel advised commissioners may appoint personnel upon successful completion of all pre-employment requirements. However, commissioners should not ratify appointments.

Chief Gault reviewed the 2022 Police Annual Report. The department was under budget and staffing continued to be a challenge. FTE’s are getting better but several in training and extended leave. Calls for service were at their highest ever in 2022. The department added a second K9 as well as a therapy K9. Offices completed a total of 7,840 hours of training.

New Business

1. Approval of Regular, Full-time Appointment (Steve Regenwether, Fire Chief)

Captain Geoff McClellan will complete his probationary period effective May 29, 2023. Staff requested approval of the regular full-time appointment of Captain Geoff McClellan effective May 29, 2023, pending no concerns develop between the date of this meeting and his effective date. Commissioner Lindsey made a motion to approve the regular full-time appointment of Captain Geoff McClellan effective May 29, 2023, pending no concerns develop between the date of this meeting and his effective date, seconded by Chairperson Nelson; carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

2. Approval of Regular, Full-time Appointment (Steve Regenwether, Fire Chief)

Lieutenant Kevin Hamilton will complete his probationary period effective May 29, 2023. Staff requested approval of the regular full-time appointment of Lieutenant Kevin Hamilton effective May 29, 2023, pending no concerns develop between the date of this meeting and his effective date. Commissioner Lindsey made a motion to approve the regular full-time appointment of Lieutenant Kevin Hamilton effective May 29, 2023, pending no concerns develop between the date of this meeting and his effective date, seconded by Chairperson Nelson; carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

3. Removal of Madison Jewell from the Firefighter/Paramedic Eligibility Register (Steve Regenwether, Fire Chief)

In her email, dated April 28, 2023, to Elizabeth McKenzie, HR Specialist, Madison Jewell, number twelve candidate, on the current firefighter/paramedic eligibility register requested she be removed for personal reasons. Staff requested removal of Madison Jewell from the current Firefighter/Paramedic Eligibility Register at her request. Commissioner Lindsey made a motion to approve the removal of Madison Jewell from the current Firefighter/Paramedic Eligibility Register, seconded by Chairperson Nelson; carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

4. Probationary Appointment of Firefighter/Paramedic Michael Moritz (Steve Regenwether, Fire Chief)

Michael Moritz, number sixteen candidate, has successfully completed the background investigation and accepted a contingent employment offer. Staff requested probationary appointment of Firefighter/Paramedic Michael Moritz effective June 7, 2023, contingent upon successful completion of all pre-employment requirements. Commissioner Lindsey made a motion to approve the probationary appointment of Firefighter/Paramedic Michael Moritz, effective June 7, 2023, contingent upon successful completion of all pre-employment requirements, seconded by Chairperson Nelson; carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

5. Probationary Promotional Appointment of Police Sergeant Aron Burns to the rank of Lieutenant (Darren Gault, Police Chief)

Sergeant Aron Burns is the next candidate on the certified Lieutenant Eligibility Register. A vacancy in this rank has existed since the retirement of Lieutenant Terry Garmon on January 27, 2023. This promotion has been delayed due to staffing challenges. Staff requested probationary promotional appointment of Sergeant Aron Burns to the rank of Lieutenant effective June 4, 2023, contingent upon manpower. Commissioner Lindsey made a motion to approve the probationary promotional appointment of Aron Burns to the rank of Lieutenant effective June 4, 2023, contingent upon manpower, seconded by Chairperson Nelson; carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

6. Probationary Promotional Appointment of Police Office Salvador Victor to the rank of Sergeant (Darren Gault, Police Chief)

Police Officer Salvador Victor is the number one candidate on the certified Sergeant Eligibility Register. A vacancy in this rank has existed since the resignation of Sergeant Nathan Medinger on October 10, 2022. This promotion has been delayed due to staffing challenges. Staff requested probationary promotional appointment of Officer Salvador Victor to the rank of Sergeant effective June 4, 2023, contingent upon manpower. Commissioner Lindsey made a motion to approve the probationary promotional appointment of Salvador Victor to the rank of Sergeant effective June 4, 2023, contingent upon manpower, seconded by Chairperson Nelson; carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

Executive Session

Commissioner Lindsey moved to adjourn into executive session for the purpose of discussion of minutes of meeting lawfully closed under the Open Meetings Act, whether for purposes of approval by body of the minutes or semi annual review of the minutes as mandated by Section 2.06, 5ILCS 120/2 (C)(21), and the appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body pursuant to Section 2 5ILCS (120/(c)(1) of the Open Meetings Act, seconded by Chairperson Nelson; carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

Action from Executive Session

Commissioner Lindsey made a motion to approve the executive session minutes of April 11, 2023, seconded by Chairperson Nelson; carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

Commissioner Lindsey made a motion to rescind the probationary appointment of Andrew Russell, number five candidate on the current Police Officer Eligibility Register, seconded by Chairperson Nelson; carried on roll call with the following vote: ayes: Chairperson Nelson and Commissioner Lindsey; nays: none.

Adjournment

With no further business to discuss, Commissioner Lindsey moved to adjourn; seconded by Chairperson Nelson; motion unanimously carried; meeting adjourned at 4:42 p.m.
