Hampton Township reverses denial of building permit

The Hampton Township Board of Appeals met Aug. 25 to reverse a denial of building permit.

Here are the meeting's minutes, as provided by the board:

267 CHARTER TOWNSHIP OF HAMPTON BOARD OF APPEALS AUGUST 25, 2016

The regular meeting of the Charter Township of Hampton Board of Appeals was called to order at 7:15 p.m. by Chairperson Noble in the Boardroom of the Hampton Township Administrative Offices.

PRESENT: Wisniewski, Brey, Goetz, Noble ABSENT: Neering ALSO PRESENT: Sheppard, Dewyse, Hebner, Rybak, and 1 person in audience

Motion by Wisniewski seconded by Goetz that the minutes of the July 21, 2016, meeting be approved as printed and that the reading of the minutes be waived. Motion carried.

COMMUNICATIONS: No Communications

UNFINISHED BUSINESS: Thomas Couture, 211 Princeton St, appeared before the board to request a variance of sixteen (16) feet from the rear yard setback and a variance of six (6) feet from the side yard setback to construct a 14’ X 24’ (336 sq. ft.) detached garage that was tabled from the last meeting.

Discussion was held on the following: the alley behind the houses was found, by the assessor, to be abandoned by the Bay County Road Commission in 1950. This would give an additional 10’ in the rear for the applicant. The alley also gives a 25’ strip of non-buildable area behind the houses on Princeton. The applicant worked with the building inspector to try to work out all possible scenarios. This would not be setting a precedent for the entire township just the college town area. The applicant’s situation is unique to this area. The board can always add a positive drainage condition.

At this time the meeting was open to the public: Mr. Couture asked about the firewall needed.

At this time the meeting was closed to the public.

Motion by Wisniewski seconded by Brey, that the Board of Appeals of the Charter Township of Hampton, hereby reverses the denial of a building permit to Thomas Couture, 211 Princeton St., under notice of Appeal No 16-03, for the reason that there is either unnecessary hardship (or) there is practical difficulty in carrying out the strict letter of Ordinance No 36A, and said applicant has demonstrated the existence of the conditions set forth in Chapter XXIII Section 10 thereof. The reasons being the unique shape and size of the lot, the alley with restrictions to the non-buildable area and there is no other location or position for the garage to be constructed on the applicant’s lot. Subject to the following condition: drainage must be approved by the building inspector if requested.

AYES: Wisniewski, Brey Goetz, Noble NAYS: None ABSENT: Neering Motioned carried

NEW BUSINESS: There was no new business

OPEN TO THE PUBLIC: Hebner noted that Huntington Bank would be appearing before the board to construct a drive up ATM in the Kroger parking lot.

Motion by Goetz seconded by Wisniewski that the meeting adjourn. Motion carried. Meeting adjourned at 7:30 p.m.
