same subject matter. Explanation: On November 15, 2005, the City Council adopted

Special Service Area Act, the services are to be provided through a levy of an annual
property tax. For 2016, a levy of $145,335.00 is required to fund the 2017 budget.
Fiscal Impact: Special services provided will be paid by the property owners within
the established Special Service Area #5. Public Notice/Recording: This ordinance

Fiscal Impact: Special services provided will be paid by the property owners within

N/A 4. Council Bill/Resolution 1161-2016 A Resolution authorizing the Mayor and
City Clerk to execute an Intergovernmental Agreement between the City of Moline,
Illinois, the City of Rock Island, Illinois, and the City of Davenport, Iowa, and
area Public Housing Agencies for the purpose of collaborating on the development
of and sharing the cost for, an Assessment of Fair Housing study. Explanation: The
Cities of Moline, Rock Island, and Davenport, are entitlement cities receiving community
development formula grant funds through the Department of Housing and Urban Development
(HUD), and pursuant to HUD requirements, each community is required to complete
an Assessment of Fair Housing (AFH). As a result, the Cities have formerly entered
into an Intergovernmental Agreement to conduct the AFH. The cost is estimated to
be in the range of $80,000. The City of Moline will be responsible for $13,350 of
that cost, split between two years. Additional documentation attached. Fiscal Impact:

N/A 5. Council Bill/Resolution 1162-2016 A Resolution authorizing the Mayor and
City Clerk to execute an agreement with United Healthcare Services Inc. (United
Healthcare) to provide administrative services and reinsurance for medical and prescription
drug claims for a one year period commencing on January 1, 2017. Explanation: United
Healthcare currently provides claims administrative services and reinsurance for
the City’s health benefits plan. Expected fixed costs for 2017, including reinsurance,
for these services increased by 10.34%. Additional documentation attached. Fiscal
Impact: Budgeted in the Health Fund Public Notice/Recording: N/A 6. Council Bill/Resolution
1163-2016 A Resolution authorizing the Mayor and City Clerk to execute an agreement
with Midwest Group Benefits to provide administrative services for dental, vision
and flexible benefit claims for a one year period commencing on January 1, 2017.
Explanation: Midwest Group Benefits currently provides claims administrative services
for the City’s dental, vision and flexible benefits plans. There will be no increase
in the administrative costs for these services. Additional documentation attached.

Bill/Resolution 1164-2016 A Resolution authorizing the Mayor and City Clerk to execute
an Intergovernmental Agreement for cooperative effort to establish a consolidated
Public Safety Answering Point (“PSAP”) between and among the City of Moline, City
of East Moline, Village of Milan and City of Silvis. Explanation: The City of Moline,
the City of East Moline, the Village of Milan, and the City of Silvis are municipal
corporations organized pursuant to Art. VII of the Illinois Constitution or pursuant
to the Illinois Municipal Code (65 ILCS 5/1-1-1 et seq.). Public Act 99-0006, signed
on July 2, 2015, amended the Emergency Telephone Systems Act, 50 ILCS 750/1 et seq.
(“the Act”), to consolidate and upgrade 9-1-1 systems. As a result of the Act, the
number of PSAPs in a county must be reduced. The Intergovernmental Cooperation Act,
5 ILCS 220/1 et seq., permits public agencies to exercise, combine, transfer, and
enjoy jointly any powers, privileges, functions or authority they may have except
where expressly prohibited by law. Moline, East Moline and Milan have been directed
by their respective governing bodies to work together to implement a consolidated
PSAP, and Silvis has participated in discussions as to joining the consolidated
PSAP with the other three communities. A feasibility study will be performed to
determine staffing levels and to determine the proportional share of costs to be
allocated among the parties based on call volume. The parties also agree to share
the cost of the feasibility study and all other costs of implementation based on
each party’s pro rata share as determined by the study. Additional documentation

Agenda 8. Council Bill/General Ordinance 3030-2016 An Ordinance levying and assessing
taxes for the City of Moline, Illinois, for the tax levy year 2016 collectible 2017,
and enacting an ordinance relating to the same subject matter. Explanation: Annually,
the City of Moline levies a tax on all real property within the City. It is collectible
the following year and utilized as a revenue source for the budget. The recommended
2016 Tax Levy is $15,289,920. No public hearing required as the levy is less than
105% of the previous year. Fiscal Impact: The levy must be passed and filed with
the County Clerk in order to extend property taxes for the municipal portion of
the property tax bill and will fund a portion of the 2017 budget. Public Notice/Recording:
Record with County Clerk. Resolutions 9. Council Bill/Resolution 1165-2016 A Resolution
authorizing the Mayor and City Clerk to execute a proposal from GovHR USA, Northbrook,
Illinois, to begin a search for candidates for the position of City Administrator
of City Administrator for the City of Moline. Explanation: City Administrator Lewis
J. Steinbrecher submitted his resignation effective November 8, 2016. The City of
Moline has satisfactory relationship with GovHR USA, having utilized the same company
when it was called The PAR Group for several past successful recruitments. Additional

20, “MOTOR VEHICLES AND TRAFFIC,” of the Moline Code of Ordinances, Section 20-5124,

Ordinance 3034-2016 An Ordinance amending Chapter 31, “TAXATION,” of the Moline
Code of Ordinances, by enacting one new Article XI, “MUNICIPAL GAS USE TAX.” Explanation:
The City contracted with Azavar Audit Solutions in May 2014 to conduct a comprehensive
municipal audit. As a result of this audit, Azavar discovered a loophole whereby
the City is losing municipal revenue each year. In order to capture the lost gas
tax revenue, staff is proposing to adopt a gas use tax on the use of gas from alternatives
gas supplier’s customers who purchase therms transported from out-of-state. The
municipal gas use tax will not apply to any business certified by the Illinois Department
of Commerce and Economic Opportunity under Chapter 35 ILCS § 120/1f. Additional

Council adopted Special Ordinance No. 4068-2005 establishing Special Service Area
#5 (Bass Street Landing); and WHEREAS, as provided by the Special Service Area Act,
the services for a Special Service Area are to be provided through a levy of an
annual property tax not to exceed the amount necessary to produce a maximum annual
tax of $250,000; and WHEREAS, for 2016, a levy of $145,335 is required to fund the
City’s fiscal year 2017 budget. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF MOLINE, ILLINOIS, as follows: Section 1 - Findings. The City Council
of the City of Moline, Illinois (the “City”), finds and declares as follows: (a)
Pursuant to the provisions of the 1970 Constitution of the State of Illinois (the
“Constitution”), the City of Moline, Illinois, is authorized to create special service
areas in and for the City. (b) Special Service Areas are established by home rule
units pursuant to Section 6(1) of Article VII of the Constitution, which provides:
“The General Assembly may not deny or limit the power of home Rule units…(2) to
levy or impose additional taxes upon areas within their boundaries in the manner
provided by law for the provision of special services to those areas and for the
payment of debt incurred in order to provide those special services; and, are established
pursuant to the provision of the Special Service Area Tax Law of the State of Illinois,
35 ILCS 200/27-5 et seq., as amended (the “Law”), and pursuant to the Property Tax
Code of the State of Illinois, 35 ILCS 200/1-1, as amended.” (c) At its regular
meeting on November 15, 2005, the City Council adopted Special Ordinance No. 4068-2005
establishing Special Service Area #5. (d) The Special Service Area #5 will benefit
from the municipal services to be provided including, without limitation: engineering,
soil testing and appurtenant work, storm water management facilities, storm drainage
systems and storm sewers, site clearing and tree removal, public water facilities,
sanitary sewer facilities, erosion control measures, roads, streets, curbs, gutters,
street lighting, traffic controls, parking lots, Council Bill/General Ordinance

and, equipment and materials necessary for the maintenance thereof, landscaping,
tree installation, vegetation maintenance and control, costs for land and easement

removal, cul-de-sac creation and maintenance, public right-of-way creation and maintenance,
public property maintenance to a higher standard than throughout the City generally,
provision of amenities, (collectively, the “Services). (e) As provided in the Special
Service Area Act, the Services are to be provided through the levy of a direct annual
ad valorem tax (the “Taxes”) upon all taxable property within the territory, the
maximum of such taxes to be extended in any year for special services within the
proposed special service area shall not exceed the amount necessary to produce a
maximum annual tax levy of $250,000. (f) The establishment of the Special Service
Area #5 in the City for the purpose of providing the Services within the Territory,
and the levy of the Taxes for the purposes described in subsection (d) was considered
at a public hearing held on December 6, 2005, by the City Council of the City. (g)
Notice of the hearing was given by publication on November 20, 2005, not less than
15 days prior to the public hearing in the Dispatch, a newspaper qualified to carry
legal notices, published in the City of Moline, Illinois, and having a general circulation
within the City. (h) Mailed notice of the hearing was given by depositing the notice
in the United States first class mail, postage prepaid, not less than 10 days prior
to the time set for the hearing addressed to the person or persons in whose name
the general taxes for the last preceding year were paid on each lot, block, tract
or parcel of land lying within the Territory; and, in those cases where taxes for
the last preceding year were not paid, the notice was sent to the person or persons
last listed on the tax rolls prior to that year as the owner or owners of the property.
(i) The hearing notice complied with all of the applicable requirements of the Special
Service Area Act. (j) No petition objecting to the establishment of the Special
Service Area #5 or the levying of the Taxes, signed by at least 51% of the electors
residing within the Territory and by at least 51% of the owners of record of the
land included within the boundaries of the Territory, was filed with the City Clerk
during the Petition Period. (k) The City has satisfied all of the requirements of
the Special Service Area Act that are conditions to the establishment of the Special
Service Area #5 and the levy of the Taxes. Council Bill/General Ordinance No. 3031-2016

an Intergovernmental Agreement between the City of Moline, Illinois, the City of

Agencies for the purpose of collaborating on the development of and sharing the
cost for, an Assessment of Fair Housing study. ____________________ WHEREAS, the
Cities of Moline, Rock Island, and Davenport formerly entered into an Intergovernmental
Agreement to conduct an Assessment of Fair Housing (AFH) and now area public housing
agencies will be included; and WHEREAS, the Cities of Moline, Rock Island, and Davenport,
are entitlement cities receiving community development formula grant funds through
the Department of Housing and Urban Development (HUD), and pursuant to HUD requirements,
each community is required to complete an AFH; and WHEREAS, pursuant to Title VIII
of the Civil Rights Act of 1968 (Fair Housing Act) the Department of Housing and
Urban Development mandates such assessment be updated once every five years; and
WHEREAS, the Cities of Moline, Rock Island and Davenport and area public housing
agencies will prepare a Request for Qualifications and Request for Proposals in
efforts to retain a consultant to prepare an AFH; and WHEREAS, this analysis will
look at both private and public housing markets and the social, political, and economic
factors that affect the selection of housing in Moline, Rock Island and Davenport
and adjacent areas served by certain participating public housing agencies, the
analysis will include a brief history of fair housing practices in Moline, Rock
Island and Davenport, and will examine the demographics of the community, barriers
and impediments to fair housing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MOLINE, ILLINOIS, as follows: That the Mayor and City Clerk are hereby
authorized to execute an Intergovernmental Agreement between the City of Moline,
Illinois, the City of Rock Island, Illinois, and the City of Davenport, Iowa, and
area Public Housing Agencies for the purpose of collaborating on the development
of and sharing the cost for, an Assessment of Fair Housing study; provided, however,
that said Agreement is in substantially similar form and content to that attached
hereto and incorporated herein by this reference thereto as Exhibit A and has been

Attorney COLLABORATION & INTERGOVERNMENTAL AGREEMENT AMONG THE CITIES OF MOLINE
AND ROCK ISLAND, ILLINOIS, CITY OF DAVENPORT IOWA AND THE PUBLIC HOUSING AUTHORITIES
IDENTIFIED IN ATTACHMENT FOR THE 2019 – 2024 ASSESSMENT OF FAIR HOUSING This agreement
among the City of Moline, Illinois, a municipal corporation, (hereinafter “Moline”),
the City of Rock Island, Illinois, a municipal corporation, (hereinafter “Rock Island”),
and the City of Davenport, Iowa, a municipal corporation, (hereinafter “Davenport”),
and list of six Public Housing Authorities identified in Attachment A (hereinafter
PHAs) in consideration of the cost share identified, the mutual promises and covenants
exchanged herein and in accordance with all appropriate Iowa and Illinois constitutional
and statutory sections related to the enactment or adoption of intergovernmental
and collaboration agreements hereby enter into the following agreement. WHEREAS,
the City of Davenport is a consolidated plan program participant with a program
year start date of July 1 and the next 5-year consolidated plan cycle will begin
in July 2020; and WHEREAS, the City of Moline is a consolidated plan program participants
with a program year start date of January 1 and the next 5-year consolidated plan
cycle will begin in January 2020; and WHEREAS, the City of Rock Island is a consolidated
plan program participant with a program year start date of April 1 and the next
5-year consolidated plan cycle will begin in April 2018; and WHEREAS, the PHAs as
identified in Attachment A are public housing authorities with fiscal years and
next 5-year plan cycles beginning as identified in Attachment A; and WHEREAS, the
Program participants are subject to the affirmatively furthering fair housing requirements
found at 24 CFR 5.150 through 5.180 and required to submit an Assessment of Fair
Housing (AFH); WHEREAS, the AFH requires an analysis of a region’s Core Based Statistical
Area (CBSA) for the entitlements and PHA’s which includes Scott County Iowa, Rock
Island, Mercer, and Whiteside Counties in Illinois; and WHEREAS, the Program Participants
wish to collaborate to submit the AFH. NOW THEREFORE, it is agreed among the parties
hereto that: LEAD ENTITY The City of Davenport will serve as the lead entity of
the collaboration and will be responsible for submitting the regional AFH on behalf
of all the collaborating Program Participants. PROGRAM YEAR ALIGNMENT Alignment
of program year(s) and fiscal years(s) is not possible. As such, the AFH will be
submitted in accordance with the lead entity’s (City of Davenport) next 5-year consolidated
plan program year start date of July, 2020. The AFH will be submitted by October,
2019. 2 ROLES/RESPONSIBILITIES OF PROGRAM PARTICIPANTS The City of Davenport will
serve as the lead entity and as such will, after consultation with Program Participants,
issue an RFQ to obtain the services of a consultant. Each Program Participant will
be responsible for providing information, data, assisting with public input meetings,
etc. as required by the consultant and identified in the agreed upon scope of work.
WITHDRAWAL Prior to the selection of the consultant a Program Participant may withdraw
from the collaboration. However, once the consultant is chosen, scope of work identified
and financial obligation of each program participant identified, a participant will
be held responsible, as stated in the contract, for their share of the AFH. Participants
are to submit, in writing withdrawing from the regional AFH to the lead entity.
Participants are also responsible for notifying HUD of their decision to withdraw.
SPECIAL CONDITIONS In consideration of the mutual covenants and promises herein
contained, the Program Participants hereby agree as follows: 1. The recitals hereto
are incorporated herein by this reference thereto as if fully set out herein. 2.
The City of Davenport will serve as the lead entity of the collaboration and the
AFH will be submitted (by October 1, 2019) in accordance with Davenport’s next five
year plan program year start date of July 1, 2020; and 3. The City of Davenport
will pay consulting cost for which the City of Davenport will be reimbursed from
the Program Participants. At this time the cost of the AFH is estimated to be in
the range of $80,000. The cost of the AFH will be divided as follows: The three
entitlements splitting 50% of the estimated cost, or approximately $13,350 each
and the six Public Housing Authorities splitting 50%, or approximately $6,650 each.
It is anticipated that payments to the consultant may be arranged to fall over two
fiscal years for participants. If the selected consultants estimated proposal exceeds
$80,000 the collaborators retain the right to revise the scope of work to reduce
the consultant costs associated with the AFH. 4. Each section of this Agreement
and each sentence, clause or phrase contained in such section shall be considered
severable and, if for any reason, any section or sentence, clause or phrase contained
in such section is determined to be invalid or contrary to any existing or future
laws, such invalidity shall not impair the operation of or affect that portion of
this Agreement which is valid. 5. This instrument contains the sole agreement of
the parties hereto and all prior negotiations or correspondence shall be deemed
merged into this 3 Agreement; and the terms of this Agreement shall govern the rights
of the parties exclusively. 6. This Agreement shall be governed by the laws of the
State of Iowa, and the sole and exclusive venue for any disputes arising out of
this Agreement shall be any state court located within Scott County, Iowa, or federal
court located within the appropriate venue. A waiver of any part of this Agreement
shall be limited to that specific event and shall not be a waiver of the entire
Agreement. 7. The roles/responsibilities of the collaborating program participants
will be identified as part of the agreement with the consultant. 8. Program participants
will be responsible for ensuring that their jurisdiction’s analysis, priorities,
and goals are sufficient and suitable for inclusion in the AFH. In addition, program
participants will collaborate and provide input on joint goals and priorities to
be included in the AFH. The scope of the responsibilities to be carried out by the
participants, individually and jointly, will ultimately be established during negotiations
regarding the specific scope of work with the selected consultant. SECTION HEADINGS
AND SUBHEADINGS The section headings and subheadings contained in this Agreement
are included for convenience only and shall not limit or otherwise affect the terms
of this agreement. WAIVER A Program Participant’s failure to act with respect to
a breach by another Program Participant does not waive its right to act with respect
to subsequent or similar breaches. The failure of the Program Participant to exercise
or enforce any right or provision shall not constitute a waiver of such right or

99-0006, signed on July 2, 2015, amended the Emergency Telephone Systems Act, 50
ILCS 750/1 et seq. (“the Act”), to consolidate and upgrade 9-1-1 systems; and WHEREAS,
as a result of the Act, the number of PSAPs in a county must be reduced; and WHEREAS,
the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., permits public agencies
to exercise, combine, transfer, and enjoy jointly any powers, privileges, functions
or authority they may have except where expressly prohibited by law; and WHEREAS,
Moline, East Moline and Milan have been directed by their respective governing bodies
to work together to implement a consolidated PSAP; and WHEREAS, Silvis has participated
in discussions as to joining the consolidated PSAP with the other three communities;
and WHEREAS, a feasibility study will be performed to determine staffing levels
and to determine the proportional share of costs to be allocated among the parties
based on call volume; and WHEREAS, the parties also agree to share the cost of the
feasibility study and all other costs of implementation based on each party’s pro

covenants and promises herein contained, Moline, by and through its Mayor; East
Moline, by and through its Mayor; Milan, by and through its Mayor; and Silvis, by
and through its Mayor, hereby agree as follows: 1. The parties to this agreement
agree to work cooperatively to establish a consolidated PSAP in accordance with
the Act. 2. Before a consolidated PSAP can be established, the parties understand
and agree that certain steps need to be taken. All parties to this agreement agree
to participate as a partner in the proposed intergovernmental cooperative venture
to establish a consolidated PSAP that will be considered to be a “public safety
agency” as defined by the Act. 3. In order to establish a consolidated PSAP, a feasibility
study needs to be performed to determine staffing levels needed and to determine
the proportional share of costs to be allocated among the parties based on call
volume. The parties agree to share the cost of the feasibility study based on the
each party’s pro rata share as to be determined by the study or as otherwise agreed
to by the parties. 4. All other costs of implementation shall also be shared pro
rata as determined by the feasibility study or as otherwise agreed to by the parties.
5. Each municipality electing to participate in this joint consolidated PSAP shall
provide input and information necessary to establish a consolidated PSAP. Such input
and information shall be provided in a timely manner. 6. The parties agree to begin
discussions with their respective bargaining units that will be affected by this
joint venture. 7. The parties agree to proceed with establishing the administrative
and operational framework to implement an intergovernmental cooperative venture
for the operation and maintenance of a centralized and combined PSAP. 8. The parties
agree that the consolidated PSAP will be located on the 3rd floor of the Milan Municipal
Building in Milan. 9. The parties agree that this agreement shall relate solely
each to the other, and shall not be in benefit of any third party, nor shall it
be construed as a practice or procedure available to any other person or entity
excepting the parties herein, and said agreement must be executed by the parties
by December 14, 2016, or they will not be considered to be parties to this agreement
or the intergovernmental cooperative venture so described herein. 10. Should any
party wish to terminate its participation in the establishment of a consolidated
PSAP, it may do so upon thirty days written notice to all of the parties and upon
payment of all outstanding costs incurred to date along with any consequential costs
resulting from termination of the Agreement, such as equipment costs and administrative
costs that were incurred in anticipation of the participation of the terminating
party, up to the time of termination. 11. This agreement shall remain in full force
and effect until replaced by the agreement actually establishing the consolidated
PSAP or terminated by written agreement of all of the parties. 12. This instrument
contains the entire agreement between Moline, East Moline, Milan, and Silvis with
respect to the transaction contemplated in this agreement. The parties agree there
are no other terms or conditions of this agreement, either oral or written, other
than those stated herein. TO EVIDENCE THIS AGREEMENT, the parties have executed

ORDINANCE LEVYING and assessing taxes for the City of Moline, Illinois, for the
tax levy year 2016 collectible in the year 2017, and enacting an ordinance relating
to the same subject matter. _______________ WHEREAS, the City of Moline levies an
annual tax on all real property located within the City to be collected the following
year and utilized as a revenue source for the City’s budget; and WHEREAS, this ordinance
sets forth the City’s tax levy for 2016, collectible in 2017. NOW, THEREFORE, BE
IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOLINE, ILLINOIS, as follows: Section
1 – That the total amount of appropriations for all corporate purposes legally made
to be collected from the tax levy of the current fiscal year is hereby ascertained
to be the sum of Fifteen Million, Two Hundred and Eighty-Nine Thousand Nine Hundred
Twenty Dollars and no cents ($15,289,920). Section 2 – That this Council hereby
determines that the amount of money estimated to be necessary to be raised by taxation
upon the taxable property within the City of Moline, Illinois, for general corporate
and special municipal purposes is $14,801,470, and the levy for general corporate
fund purposes and levies for separate special fund purposes are set forth and designated
as follows: Police Pension Fund $4,029,962 Fire Pension Fund $4,890,673 Illinois
Municipal Retirement Fund $ 480,490 Park Fund $2,973,500 Library Fund $2,915,295
Total Tax Levy $15,289,920 Section 3 – That the estimated amount determined to be
necessary to be levied in Section 1 above is One Hundred Three and 3/10 percent
(103.3%) of the amount of property taxes extended upon the tax levy of the preceding
year. Section 4 – That the total amount of Fifteen Million, Two Hundred and Eighty-Nine
Thousand Nine Hundred Twenty Dollars and no cents ($15,289,920) ascertained above
be and is hereby levied and assessed on all property subject to taxation within
the City of Moline, Illinois, according to the value of said property as assessed
and equalized for State and County purposes for the current fiscal year. Section
5 – That this levy ordinance is adopted pursuant to the procedures set forth in
the Illinois Municipal Code, 65 ILCS 5/8-3-1 et seq., and Chapter 2, Sec. 2-2304
of the Moline Code of Ordinances; provided, however, that any tax rate limitation
of substantive limitation as to tax Council Bill/General Ordinance No. 3030-2016

shall not be applicable to the ordinance pursuant to Section 6 of Article VII of

WHEREAS, City Administrator Lewis J. Steinbrecher submitted his resignation effective
November 8, 2016; and WHEREAS, the City of Moline has a satisfactory relationship
with GovHR USA, having utilized the same company when it was called The PAR Group
for several past successful recruitments. NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF MOLINE, ILLINOIS, as follows: That the Mayor and City
Clerk are hereby authorized to accept a proposal from the executive search consultant,
GovHR USA, Northbrook, Illinois, to begin a search for candidates for the position
of City Administrator for the City of Moline; provided, however, that said proposal
is in substantially similar form and content to that attached hereto and incorporated
herein by this reference thereto as Exhibit A and has been approved as to form by
