Second Reading Ordinances:

1. Council Bill/General Ordinance 4041-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic; and authorizing the use of public right-of-way in conjunction with the Moline Halloween Parade, sponsored by Moline Dad’s Club/Moline Little League Softball, to be held on Sunday, October 15, 2017.

Explanation: This annual event sponsored by Moline Dad’s Club/Moline Little League Softball, has been reviewed and approved by the Special Events Committee for Sunday, October 15, 2017. The estimated number of persons to be in attendance is 500+.

Fiscal Impact: $662 estimated expense – traffic control

2. Council Bill/General Ordinance 4042-2017

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic; and authorizing the use of public right-of-way in conjunction with the Bierstube Oktoberfest to be held on two consecutive weekend dates of Friday and Saturday, September 29 and September 30, 2017, and Friday and Saturday, October 6 and October 7, 2017.

Explanation: This annual event has been held by the Bierstube since 2006, and this year’s event has been reviewed and approved by the Special Events Committee for Friday and Saturday, September 29 and 30, 2017, and Friday and Saturday, October 6 and 7, 2017. The estimated number of persons to attend is 2,500.

Fiscal Impact: Approximately $100 for barricade delivery and pickup

Resolutions

3. Council Bill/Resolution 1152-2017

A Resolution authorizing certain minutes and portions of minutes of Executive Sessions of the City Council to be maintained as confidential until further reviewed by the City Council; and authorizing the remainder of said Executive Session Minutes referenced herein to be made available for public inspection.

Explanation: The City Council of the City of Moline is required by statute to periodically meet to review the minutes of all closed sessions (Executive Sessions) to determine the appropriateness of retaining said minutes as confidential or conversely disseminating said minutes to the public. Such a meeting took place on August 22, 2017. The City Council has found that certain minutes of the Executive Sessions for past meetings should be released with the exception of those requiring continued confidential treatment.

4. Council Bill/Resolution 1155-2017

A Resolution authorizing the Mayor and City Clerk to execute a surrounding property owners consent form granting the City’s consent for a Class B Tavern liquor license to be issued for 525 14th Street, Moline.

Explanation: Teresa Dopler wishes to apply for a Class B Tavern liquor license for an establishment to be located at 525 14th Street, Moline. This location previously held a Class B Tavern liquor license in 2012 and is currently vacant. Per Section 4-3202(a) of the Moline Code of Ordinances, no liquor license of any class, except a special event license, shall be issued unless a majority of the surrounding property owners are obtained. This surrounding area includes property owners within a 150 foot radius from the center of the front of the premises, and, if the property abuts a residentially zoned parcel or parcels, the consent of the majority of the residential property owners within a 500 foot radius from the building for which the license is sought; the 500 foot radius does not apply to this location. The total number of affected surrounding properties is 11 and the number of consents required is six.

The City owns the surrounding property at 1401 6th Avenue, as shown on the attached map; it is the City’s Parking Lot M. Additional documentation attached.

5. Council Bill/Resolution 1156-2017

A Resolution authorizing the Mayor and City Clerk to execute, on behalf of the City of Moline, a Subordination Agreement with Sachin S. Nunnewar for property located at 3421 77th Street Court, Moline.

Explanation: The City previously entered into a mortgage with Sachin S. Nunnewar for property located at 3421 77th Street Court. Sachin S. Nunnewar is now refinancing its mortgage in order to purchase the adjacent vacant lot and is seeking a Subordination Agreement. Additional documentation attached.

6. Council Bill/General Ordinance 3018-2017

An Ordinance amending Chapter 22, “Offenses – Miscellaneous,” of the Moline Code of Ordinances, by repealing Section 22-4103, “Discharge Of Weapons,” in its entirety and enacting in lieu thereof one new Section 22-4103 relating to the same subject matter.

Explanation: It is in the City’s best interest to control the population of deer within City limits due to deer-related traffic accidents. To further this interest, the City Council desires to permit bow and arrow hunting of deer within City limits.

Fiscal Impact: TBD – permit fee revenue and administrative expense

7. Council Bill/General Ordinance 3019-2017

An Ordinance amending Chapter 28, “Streets And Sidewalks,” of the Moline Code of Ordinances, by repealing Section 28-2303 in its entirety.

Explanation: Council reviewed the City permit fee for newspaper dispensing devices at the Committee-of-theWhole Meeting on September 19, 2017. City staff recommends eliminating said fee since it is no longer collected, and the newspaper dispensing devices have become obsolete.

8. Council Bill/General Ordinance 3020-2017

An Ordinance amending Chapter 11, “Fire Prevention And Protection,” of the Moline Code of Ordinances, Section 11-2116, “Fees,” by repealing subsection (a)(9) in its entirety.

Explanation: The First Responder fee was first approved by Council on May 1, 2015. The purpose of this fee was to recover costs related to providing the service. During the 2017 Fee Review, staff recommended eliminating this fee since it has a negative effect on marketing and development of the City of Moline.

Fiscal Impact: Decrease of $50,000 annually

9. Council Bill/General Ordinance 3021-2017

An Ordinance amending Chapter 11, “Fire Prevention And Protection,” of the Moline Code of Ordinances, Section 11-1101.1, “Fees,” by repealing subsection (d) in its entirety and enacting in lieu thereof one new subsection (d) dealing with the same subject matter.

Explanation: The pyrotechnic inspection and permit fees were approved by City Council on August 27, 2002, to ensure public safety at pyrotechnic events by regulating, inspecting, and enforcing City ordinances. Staff recommends increasing the $45.00/hour rate to $55.00/hour for on-site personnel costs.

Fiscal Impact: Increase $400 annually

10. Council Bill/General Ordinance 3022-2017

An Ordinance amending Chapter 11, “Fire Prevention And Protection,” of the Moline Code of Ordinances, Section 11-1101.1, “Fees,” by repealing subsection (g) in its entirety and enacting in lieu thereof one new subsection (g) dealing with the same subject matter.

Explanation: The language in the Quantity Ranges chart of Chapter 11, Section 11-1101.1 of the Moline Code of Ordinances was misleading. The appropriate changes have been made

14. Council Bill/Special Ordinance 4043-2017

A Special Ordinance declaring the City-owned property at 1151 26th Street Moline surplus and authorizing the Mayor and City Clerk to execute an Agreement for Sale of Real Estate and do all things necessary to convey the property to Moline Community Development Corporation, an Illinois Not-ForProfit Corporation.

Explanation: As a result of City Council goal setting, the Moline Community Development Corporation (MCDC) was created in 2008. Part of MCDC’s mission is to provide quality housing for low to moderate income families and to foster neighborhood improvement. The City recently took possession of an abandoned, single-family home at 1151 26th Street after it was donated by then owner Wells Fargo Bank N.A. Wells Fargo, when donating the property, also gave the City $7,500.00 to be used towards the demolition or rehabilitation of the property. To provide momentum to MCDC’s efforts, MCDC is interested in rehabilitating the single-family home on the lot and selling it to a qualified family. MCDC has offered to purchase the property for $1.00. Under the terms of the proposed Agreement, the $7,500.00 donated to the City by Wells Fargo would be given to the MCDC to use in the rehabilitation. The rehabilitation and sale of the single-family home at this location will restore the blighted property and increase the property tax base in the future. Additional documentation attached.

Fiscal Impact: Lower property maintenance expenses and increase the property tax base in the future.
