Explanation

     1. A Resolution approving of a payment to the Illinois Department of Transportation (IDOT)

          related to the City’s share of I-74 Bridge Contract 64E26. (Scott Hinton, City Engineer)

Explanation: An Agreement between the Moline City Council and the State of Illinois was executed on

August 14, 2017, detailing the City of Moline’s cost sharing obligations of the Illinois Department of

Transportation’s (IDOT) Contract 64E26, I-74 Bridge from 7th Avenue to south of Avenue of the Cities.

The Agreement stated that the City of Moline would reimburse IDOT for 80% of the City’s share of the

contract upon award. A Resolution for Improvement was approved by the City Council on August 1,

2017, to use Motor Fuel Tax (MFT) funds for this purpose and to designate Section #17-00269-00-PV

as the MFT Section number. The City’s obligation at award is $587,609.14 with $470,087.31 (80%)

due at this time. The remainder will be billed to the City upon completion of the project when the City’s

total obligation is known. Additional documentation attached.

Fiscal Impact:                   Funds are not budgeted for this expense; however, $470,087.31 is

                                          available in MFT Reserves for this project.

     2. A Resolution authorizing approval of a Change Order with Civil Constructors for Project

          #1274, 16th Street Viaduct Pier Repairs and 52nd Avenue Bridge Deck Replacement, in the

          amount of $14,310.16. (Scott Hinton, City Engineer)

Explanation: In order to make final payment to the contractor and close out the contract, a change

order is needed in the amount of $14,310.16. The change order reflects final quantities constructed and

additional temporary support structures necessary to complete the work. The change order increases the

original contract value of $884,802.02 by 1.6% to $899,112.18. Additional documentation attached.

     3. A Special Ordinance designating the Prospect Park Pavilion, located at 1580 34th Avenue,

          Moline, Illinois, as a locally designated landmark. (Jeff Anderson, City Planner)

Explanation: The City of Moline received an application from Michael Carton requesting designation

of the Prospect Park Pavilion, located at 1580 34th Avenue, as a historic landmark. After holding a

public hearing, the Historic Preservation Commission recommended approval of the nomination.

     4. A Resolution approving the remote electronic attendance of Second Ward Alderman David

          Parker, Jr., at the Committee-of-the-Whole and City Council meetings of January 9, 2018,

          due to other City business. (Maureen Riggs, City Attorney)

Explanation: Alderman Parker has indicated that he will be tending to other City business as a board

member for the Moline Housing Authority on January 9, 2018, but would like to attend the Committeeof-the-

Whole and Council meetings electronically. Per Section 2-2200(e) of the Code of Ordinances,

any member of the City Council may attend and participate in any open or closed meeting of the City

via remote electronic attendance provided that such attendance is in compliance with the rules set forth

within said section and any other applicable laws. Absence due to other City business meets one of the

prerequisites under which electronic attendance is allowed. A quorum must be established and

physically present at the meeting site following the roll call for the meeting to allow the electronic

attendance to proceed at the meeting. No costs to the City are anticipated for Alderman Parker’s remote

electronic attendance, which will be via teleconference. During Alderman Parker’s remote electronic

attendance, he shall be allowed to participate in the same capacity as those City Council members

physically present at the meetings. This item will also appear on the City Council Agenda on December

19, 2017, under “Items Not on Consent.”

     5. An Ordinance amending Chapter 31, “TAXATION,” of the Moline Code of Ordinances,

          Article I., “HOTEL-MOTEL TAXES,” by repealing Sections 31-1101(a) and 31-1102A in

          their entirety and enacting in lieu thereof new Sections 31-1101(a) and 31-1102A dealing

          with the same subject matter. (Mayor Acri)

Explanation: In November, 2017, the City of Moline approved a change to the ordinance to levy and

impose the seven percent (7%) tax to include any person who rents a hotel or motel room for more than

thirty (30) consecutive days or to a person who works and lives in the same hotel or motel effective

January 1, 2018. Some Moline hotels have already negotiated contracts for long term stays and these

hotels will be negatively affected by the ordinance change. This amendment would grandfather existing

contracts for stays in excess of 30 days and not require payment of the tax for any contracts that were

executed prior to December 5, 2017, for such stays. This exception expires on June 30, 2018. This item

will also appear on the City Council Agenda on December 19, 2017, under “Items Not on Consent” for

first reading.
