Resolutions

1. Council Bill/Resolution 1001-2019

A Resolution approving PMA Financial Network Inc. and PMA Securities Inc. to provide investment services and authorizing the execution of the declaration of trust establishing the Illinois Public Reserves investment Management Entity Trust.

Explanation: The City of Moline has been a client of PMA’S since July 1994. PMA has a new investment platform, called IPRIME, which is a AAA rated money market fund that will serve as the liquidity vehicle for the City of Moline and the rest of the investment portfolio platform will remain the same.

2. Council Bill/Resolution 1002-2019

A Resolution authorizing the Mayor and City Clerk to execute a Law Enforcement Services Agreement between the City of Moline and Universal Protection Service, LLC, d/b/a Allied Universal Security Services, setting forth the terms for assignment of uniformed police officers to the SouthPark Mall complex for the period January 1, 2019 through December 31, 2019.

Explanation: This concerns an annual agreement for the assignment of uniformed police officers to the SouthPark Mall police substation. In part, the proposed agreement provides a total number of hours that a police officer will be present in the mall, and provides for Universal Protection Service, LLC to reimburse the City of Moline the sum of $127,000. Staffing will be accomplished by allocating hours and days off among the three officers assigned to the program. Additional documentation attached.

Fiscal Impact:                  Reimbursement of $127,000.

3. Council Bill/Special Ordinance 4000-2019

A Special Ordinance granting a temporary modification to Section 28- 3200(a) and Section 35-4218 of the Moline Code of Ordinances to delay the installation of sidewalks for property located at 900 36th Avenue, Moline.

Explanation: RE/MAX Center, LLC has applied for permits to build an office building on a vacant property at 900 36th Avenue. They have also applied for a temporary modification to delay installation of public sidewalk due to lack of connectivity to distant sidewalks and a topographic issue making sidewalk construction difficult. In review of the application, staff identifies that the nearest sidewalk is 900 feet away. There is an 8-10 feet slope along the road which is not ideal for sidewalk construction. Staff has found that in 1989 the City Council granted a sidewalk variance to the Blackhawk Property Addition and additional sidewalk variances have been granted to neighboring properties throughout the years. Most recently, the Cardiovascular Medicine property at 1100 36th Avenue was granted a sidewalk variance by the City Council. This missing sidewalk link was identified as low priority during the July 2016 sidewalk assessment. Additional documentation attached.

4. Council Bill/General Ordinance 3000-2019

An Ordinance amending Chapter 7, “ANIMALS AND FOWL,” of the Moline Code of Ordinances, Section 7-1105, “BEEKEEPING,” by repealing subsections (b)(2)a.2., (c)(6) and (d)(1) in their entirety and enacting in lieu thereof new subsections (b)(2)a.2., (c)(6) and (d)(1), dealing with the same subject matter.

Explanation: The City Council adopted Council Bill/General Ordinance No. 2032-2018 on August 17, 2018, to amend Section 7-1105 of the Code of Ordinances to allow the keeping of honey bees within the City of Moline. Following the initial stage of implementation and upon resident request, City staff has re-reviewed the ordinance and determined that certain changes will improve both the ordinance and its licensing procedure. This amending ordinance would remove the signage requirement for bee hives from subsection 7-1105(c)(6); signage is not required by the Illinois Department of Agriculture, and staff has determined that it is not necessary and its removal may help prevent theft of hives or other unwanted attention to the hives. This ordinance would also change the annual license term from August 1 through July 31 to April 1 through March 31, as beekeeping season begins in mid-April.

5. Council Bill/General Ordinance 3001-2019

An Ordinance amending Chapter 34, “WATER AND SEWERS,” of the Moline Code of Ordinances, Section 34-2101, “APPLICATION FOR WATER SERVICE CONNECTIONS,” by repealing subsection (1) in its entirety and enacting in lieu thereof one new subsection (1) dealing with the same subject matter, and by repealing subsection (2) in its entirety and consecutively renumbering the remaining subsections of Section 34-2101; and Section 34-3308, “APPLICATION FOR SEWER SERVICE CONNECTIONS,” by repealing subsection (1) in its entirety and enacting in lieu thereof one new subsection (1) dealing with the same subject matter, and by repealing subsection (2) in its entirety and consecutively renumbering the remaining subsections of Section 34-3308.

Explanation: Currently, water and sewer connection fees are charged based on frontage length. For water connections, the standard rate is $20 per frontage foot. Sewer connections are charged at a rate of $25 per frontage foot. Council discussed utility connection fees and directed staff to recommend changes at the Committee-ofthe-Whole Meeting on December 17, 2018. Staff researched utility revenue and the connection fees of neighboring communities and determined that a reduced, flat fee could promote more property development within the City. At the January 8, 2019, Committee-of-the-Whole Meeting, the City Council authorized amending the Code so that properties without existing infrastructure are still required to extend public mains at the property owner’s cost, but owners are no longer required to pay a connection fee.

6. Council Bill/Special Ordinance 4001-2019

A Special Ordinance amending Special Ordinance 4034-2018 for the financing by the City of Moline, Illinois by revising the issuance date for the Revenue Anticipation Note and purchase of the same by the General Fund of the City of Moline, Illinois, appropriating monies for said purposes, and authorizing execution of any related documents. (Kathy Carr, Finance Director)

Explanation: On August 14, 2018, City Council approved a Revenue Anticipation Note for $800,000 to be issued by the Park Fund and to be purchased by the General Fund to partially finance the rebuilding of the Captain’s Table Restaurant. The notes were dated December 1, 2018, with interest at 3.50%. With the delay of the project, the note needs to be amended. Additional documentation attached.

Fiscal Impact:                  Reduced interest expense to the Park Fund

7. Council Bill/Special Ordinance 4002-2019

A Special Ordinance awarding certain contracts for treatment chemicals to be used by the Department of Public Works for the calendar year 2019, and authorizing the Utilities General Manager to execute the necessary contract documents for purchase of said treatment chemicals in the quantities needed.

Explanation: Treatment chemicals used by the water and wastewater treatment plants are purchased through the Bi-State Regional Commission’s Joint Purchasing Program via a sealed bid process. City staff recommends awarding the annual contracts for chemicals to the lowest responsive and responsible bidders that meet specifications for each treatment chemical. Polymer and phosphate chemicals are an exception to this, however. Polymer and polyphosphates are specialized chemicals with proprietary formulas and are specifically permitted at each plant by Illinois Environmental Protection Agency (IEPA) based on efficiency and performance testing. In the case of these two chemicals, staff recommends continued use of treatment chemicals from the current vendors, until such time as bench and plant scale testing determines that satisfactory performance can be obtained from alternate treatment chemicals procured at a lower cost and until any related operating permit changes have been authorized by the IEPA.
