1. Council Bill/General Ordinance 3009-2019
An Ordinance amending Chapter 20, “MOTOR VEHICLES AND TRAFFIC,” of the Moline Code of Ordinances, Section 20-6104, “SOLICITING RIDES OR BUSINESS,” by repealing said section in its entirety.
Explanation: Section 20-6104 of the Moline Code of Ordinances prohibits a person from standing in a roadway or in the proximity of a roadway for the purpose of soliciting rides, employment or business, and/or contributions. There is now question as to the constitutionality of panhandling ordinances in Illinois and other states. The City therefore wishes to repeal its ordinance related to these activities.

2. Council Bill/Resolution 1030-2019
A Resolution authorizing approval of a revision to the 2019 Infrastructure Improvement Program by removing the resurfacing of 6th Street from 4th Avenue to the railroad tracks and adding the resurfacing of 25th Street from 6th to 7th Avenues.
Explanation: The 2019 Infrastructure Improvement Program includes the asphalt resurfacing of 6 th Street from 4 th Avenue to the railroad tracks. After further consideration, City staff believes 6th Street will be used extensively by drivers trying to avoid the downtown construction congestion. As such, staff proposes to delay the resurfacing of 6th Street and substitute 25th Street from 6th to 7th Avenues in its place. The estimated cost of resurfacing both locations is approximately equal.

3. Council Bill/Resolution 1031-2019
A Resolution authorizing the City Engineer to purchase poles and mast arms from Electrical Resource Management for the 25th Street and River Drive traffic signals.
Explanation: The 2019 Infrastructure Improvement Program includes the installation of traffic signals at the intersection of 25th Street (University Drive) and River Drive. City staff is currently soliciting bids and will bring a contract for Council’s consideration in the near future. Staff expects a long lead-time for delivery of the traffic signal poles and mast arms, so proposes to purchase these items direct and provide them to the contractor for installation. Staff sought prices from the three suppliers in this area of the country, received two, and found Electrical Resource Management (ERM) to be the lowest. Additional documentation attached.

4. Council Bill/Resolution 1032-2019 A Resolution authorizing the Mayor and City Clerk to accept seven (7) Deeds of Dedication for public right-of-way more particularly described herein to allow construction to proceed on Project #1311, 33rd Avenue Reconstruction, 41st Street East to Dead End.
Explanation: A Deed of Dedication for public right-of-way is necessary and has been executed by Kathy S. Peterson, Power of Attorney for Doris Peterson, 3218 41st Street; Kathy S. Peterson, Trustee under the Kathy S. Peterson Living Trust, 4105 33rd Avenue; Emily E. Spencer, 4111 33rd Avenue; Lorraine Spillum, Trustee of the Lorraine Spillum Trust, 4115 33rd Avenue; Carol L. 5. Council Bill/Resolution 1033-2019
A Resolution authorizing the ceding of 2019 Home Rule Volume Cap.
Explanation: Under Section 146 of the Internal Revenue Code of 1986, the City is allocated an annual per capita amount for private activity bond use, which in 2019 totals $4,434,255. The Illinois Private Activity Bond Allocation Act provides that a home rule unit of government may transfer its allocation to any other home rule unit of government, the State of Illinois or any agency of the State, or any non-home rule unit of government. The City Council has adopted a Volume Cap Policy regarding the use, transfer, or reservation of the City’s volume cap allocation. The policy, along with the history of Moline’s allocations, is included in the attachment.
Private Activity Bonds (PABs) are tax-exempt bonds issued on behalf of certain businesses engaged in manufacture or production of tangible personal property. A wide variety of businesses can qualify under the guidelines to finance the acquisition of fixed assets such as land, buildings, or equipment. They may also be used for renovation and new construction, as well as construction or renovation of residential units that meet income guidelines. Because the bonds are exempt from federal income tax, they typically command competitive interest rates and may be combined with other tax credit programs to stimulate projects.
The Quad Cities Regional Economic Development Authority (QCREDA) is the only agency to request the City’s 2019 Volume Cap and has a mutually beneficial relationship with the City, County, and other regional development authorities to best utilize this resource for the benefit of the region.
If the City does not obligate this allocation by May 1, it is automatically turned over to the State of Illinois for reallocation to other entities statewide. Additional documentation attached.

6. Council Bill/Resolution 1034-2019
A Resolution authorizing the purchase of an IBAK HD Ready 3D Camera System with a 14-foot cargo box from Jet Vac Environmental for the amount of $298,384.00.
Explanation: The current sewer pipe inspection camera system has reached the end of it reliable life. Funds are budgeted to replace this unit, and City staff developed specifications and published a Request for Proposal (RFP). The most responsive and responsible proposal was received from Jet Vac Environmental, Island Lake, Illinois, for the amount of $298,384.00. The Public Works Department has owned a portion of each of the 17,000 plus sewer laterals since 1992, but has not had accurate mapping records for these pipes. Staff also has not had the capability to inspect the lateral from outside the house in the past and needed to rely on outside vendors to perform this task. This unit raises the level of service to the customer with its lateral launch camera, which launches into the lateral from inside the sewer main. This will allow for mapping and condition assessment of these WPC Division assets and ultimately lead to greater control of inflow and infiltration. This system will also be equipped with a CNG site generator to operate cleanly and quietly in the City’s neighborhoods.
Fiscal Impact: $226,115.76 remains available in account #448-0867-437.07-03 for this purchase. The balance, $72,268.24 from WPC Reserves, account #320-0000-300.00.

7. Council Bill/Resolution 1035-2019
A Resolution authorizing the purchase of a 2019 Ford F-450 Cab and Chassis Truck from Reynolds Motor Company for the amount of $34,075.24.
Explanation: Funds are budgeted to replace the current WPC pipe inspection camera system chassis. City staff developed specifications for a cab and chassis for the new camera system and box. These specifications were published in a Request for Proposal (RFP), and the only proposal received was from Reynolds Motor Company, East Moline, Illinois, for the amount of $34,075.24. This chassis will be fueled by CNG to operate at a lower cost and help reduce emissions. Staff also is seeking approval to dispose of the old unit in a manner that is most advantageous to the City. 8. Council Bill/Resolution 1036-2019
A Resolution authorizing approval of a sole source purchase of a compressed natural gas (CNG) fuel conversion system for a 2019 Ford F450 Chassis from Venchurs Vehicle Systems for the amount of $24,809.00.
Explanation: A cab and chassis is budgeted for the WPC camera system vehicle, and City staff has determined that fueling this unit on CNG will reduce the operating costs of the unit. City staff requested a quote from Venchurs Vehicle Systems in Adrian, Michigan, for this system. The City has been using Venchurs as a CNG system provider since 2014, and they provided a quote in the amount of $24,809.00. Venchurs is approved by Ford as the CNG system provider for our area. The City’s current Fleet has 22 of these CNG systems installed, and they have been very reliable. Additional documentation attached.

9. Council Bill/Resolution 1037-2019
A Resolution authorizing the Mayor and City Clerk to apply for a State Highway Permit from the Illinois Department of Transportation and to execute the necessary forms in conjunction with the St. Mary’s Easter Procession, scheduled for Friday, April 19, 2019.
Explanation: This event sponsored by St. Mary’s Church of Moline, Illinois includes areas of the City of Moline and requires temporary lane closures within the City. Section 4-408 of the Illinois Highway Code authorizes the Illinois Department of Transportation (IDOT) to issue permits to local municipalities to temporarily close portions of State highways along event routes for such public purposes. Local approval of use of these routes is necessary before permission can be sought from IDOT. This is the first year for this event. The estimated number of persons to attend is 100.

A Resolution to employ the services of Lisa Kotter as City Administrator of the City of Moline and authorizing the Mayor and City Clerk to execute a Letter of Agreement between the City of Moline and Lisa A. Kotter.

11. Council Bill/General Ordinance 3010-2019
An Ordinance amending Chapter 8, “BUILDINGS AND OTHER CONSTRUCTION AND BUILDING SERVICES,” of the Moline Code of Ordinances, to revise the annual contractor license and registration dates, by amending Section 8-1400, “GENERAL CONTRACTOR LICENSE,” by repealing subsection (c) in its entirety and enacting in lieu thereof one new subsection (c) relating to the same subject matter; Section 8-1401, “ELECTRICAL CONTRACTOR LICENSE AND REGISTRATION,” by repealing subsections (b)(5) and (8) in their entirety and enacting in lieu thereof new subsections (b)(5) and (8) relating to the same subject matter; Section 8-1402, “MECHANICAL CONTRACTOR LICENSE,” by repealing subsections (e) and (i) in their entirety and enacting in lieu thereof new subsections (e) and (i) relating to the same subject matter; and Section 8-1405, “SEWER SERVICE AND MAINTENANCE BUSINESS LICENSE,” by repealing subsection (d) in its entirety and enacting in lieu thereof one new subsection (d) relating to the same subject matter.
Explanation: Chapter 8 of the Code of Ordinances currently defines the annual contractor license and registration period as being from May 1 to April 30. This time-period is problematic for both the contractors and City staff as the registration renewal process takes place during the busy spring construction period. City staff proposes to change the current annual contractor registration period from to January 1 to December 31 in an effort to better serve our customers. Staff proposes this change take effect on May 1, 2019, and that the 2019 registration fees be prorated for eight months. Additional documentation attached.

12. Council Bill/General Ordinance 3011-2019
An Ordinance amending Chapter 31, “TAXATION,” of the Moline Code of Ordinances, Article I, “HOTEL-MOTEL TAXES,” by repealing said article in its entirety and enacting in lieu thereof one new Article I, “HOTEL AND VACATION RENTAL TAXES,” relating to the same subject matter.
Explanation: Chapter 31, Article I, of the Moline Code of Ordinances, pertains to the imposition, transmittal and collection of taxes on hotels and motels within the City. City staff has reviewed the trend of vacation rentals and bookings through online companies such as Airbnb, VRBO, Expedia, and others, and determined that the City’s ordinance should be amended to allow the City to capture taxes resulting from such vacation rentals. This ordinance will amend the article’s current definitions and other provisions for hotel and motel taxes to include taxation of vacation rental units. This ordinance will also amend Sec. 32-1100, currently reserved for future use, to add the Special Service Area No. 7 hotel tax imposed by Council Bill/Special Ordinance No. 4063-2018, adopted January 8, 2019.
