1. Council Bill/General Ordinance 3033-2019
An Ordinance amending Chapter 20, “Motor Vehicles and Traffic,” of the Moline Code of Ordinances, Appendix 10 thereof, “PARKING PROHIBITED AT ANY TIME,” by repealing Forty-third Street, on the east side, from Fifth Avenue to Seventh Avenue, and replacing it with Forty-third Street, on the east and west sides, from Fifth Avenue to Seventh Avenue.
Explanation: Parking is prohibited on the east side of 43rd Street, from 5th Avenue to 7th Avenue. The Traffic Committee has now received a request to prohibit parking on the west side of 43rd Street, from 5th Avenue to 7th Avenue. The vehicles currently parking on 43rd Street create line of sight issues for eastbound 5th Avenue traffic. Prohibiting parking on the west side will eliminate the line of sight issue. The Traffic Committee reviewed the request and recommends prohibiting parking on both the east and west sides of 43rd Street, from 5th Avenue to 7th Avenue.

2. Council Bill/General Ordinance 3034-2019
An Ordinance amending Chapter 20, “Motor Vehicles and Traffic,” of the Moline Code of Ordinances, Appendix 10 thereof, “Parking Prohibited at Any Time,” by including Fifth Avenue, on the north side from Twenty-fourth Street east 25 feet; and Fifth Avenue, on the south side from Twenty-fifth Street east 25 feet.
Explanation: The Traffic Committee received a request for “No Parking Here to Corner” signs at the following intersections: the northeast corner of 24th Street and 5th Avenue, and the southeast corner of 25th Street and 5th Avenue. This request was made due to safety concerns because of the line of sight issues at each of these intersections. Prohibiting parking will provide drivers with a better view of approaching traffic. The Traffic Committee reviewed the request and recommends prohibiting the parking. Additional documentation attached.

3. Council Bill/General Ordinance 3035-2019
An Ordinance amending Chapter 20, “Motor Vehicles and Traffic,” of the Moline Code of Ordinances, Appendix 10 thereof, “Parking Prohibited at Any Time,” by including Eighth Street, on the east side, 60 feet south of Eleventh Avenue for a distance of 46 feet.
Explanation: The Traffic Committee received a request to install “No Parking Between Signs” at the midblock pedestrian crossing across 8th Street, south of 11th Avenue, at the set of stairs from the east parking lot to the William Butterworth Center entrance. Patrons are having difficulty seeing oncoming traffic due to parked vehicles. Prohibiting parking will provide a safer means to cross 8th Street for the patrons of the William Butterworth Center. Traffic Committee reviewed the request and recommends prohibiting parking. Additional documentation attached.

4. Council Bill/General Ordinance 3036-2019
An Ordinance levying and assessing taxes for the City of Moline, Illinois, for the tax levy year 2019, collectible 2020, and enacting an ordinance relating to the same subject matter.
Explanation: Annually, the City of Moline levies a tax on all real property within the City. It is collectible the following year and utilized as a revenue source for the budget. The recommended 2019 Tax Levy is $15,903,100. No public hearing is required as the levy is less than 105% of the previous year.
Fiscal Impact: The levy must be passed and filed with the Rock Island County Clerk in order to extend property taxes for the municipal portion of the property tax bill; it will fund a portion of the 2020 budget.
Public Notice/Recording: This ordinance must be filed with the Rock Island County Clerk by the last Tuesday in December 2019.
5. Council Bill/General Ordinance 3037-2019
An Ordinance levying a special Ad Valorem Tax within the City of Moline, Illinois, Special Service Area #5 of the City of Moline, Illinois, for the tax levy year 2019, collectible 2020, and enacting an ordinance relating to the same subject matter.
Explanation: On November 15, 2005, the City Council adopted Ordinance No. 4068-2005 to establish a Special Service Area. As provided by the Special Service Area Act, the services are to be provided through a levy of an annual property tax. For 2019, a levy of $117,475 is required to fund the 2020 budget. No public hearing is required as the levy is less than 105 percent of the previous year.
Fiscal Impact: Special services provided will be paid by the property owners within the established Special Service Area #5.
Public Notice/Recording: This ordinance must be filed with the Rock Island County Clerk by the last Tuesday in December 2019.
6. Council Bill/General Ordinance 3038-2019
An Ordinance levying a special AD VALOREM TAX within the City of Moline, Illinois, Special Service Area #6 of the City of Moline, Illinois, for the tax levy year 2019, collectible 2020, and enacting an ordinance relating to the same subject matter.
Explanation: On July 15, 2008, the City Council adopted Ordinance No. 4034-2008 to establish Special Service Area #6. As provided by the Special Service Area Act, the services are to be provided through a levy of an annual property tax. For 2019, a levy of $269,255 is required to fund the 2020 budget. No public hearing is required as the levy is less than 105 percent of the previous year.
Fiscal Impact: Special services provided will be paid by the property owners within the established Special Service Area #6.
Public Notice/Recording: This ordinance must be filed with the Rock Island County Clerk by the last Tuesday in December 2019.
7. Council Bill/General Ordinance 3039-2019
An Ordinance making Appropriations for Corporate Purposes for the Fiscal Year beginning January 1, 2020, and ending December 31, 2020.
Explanation: This is the annual Appropriation Ordinance, which is required to be passed by State Statute. This ordinance allows the City to expend funds during the fiscal year 2020.
Fiscal Impact: This ordinance is necessary as an authorization granted by the City Council to make expenditures and to incur obligations during the fiscal year 2020.
Public Notice/Recording: The Finance Department will file the ordinance with the Rock Island County Clerk.
8. Council Bill/General Ordinance 3040-2019
An Ordinance approving the Marquis Harbor-West Business District Plan; and designating the Marquis Harbor-West Business District; and establishing the Marquis Harbor-West Business District within theCity of Moline.
Explanation: As part of the Lease Agreement for the proposed Captain’s Table Restaurant to be constructed at Marquis Harbor, the City has agreed to establish a Business District pursuant to the Illinois Business District Development and Redevelopment Business District Law. As an initial step in this process, the City is obliged to adopt the Business District Plan, which describes the proposed Business District, the proposed development project objectives, project costs, and how the Business District will assist with certain eligible project costs. The City conducted a public hearing on November 19, 2019. The Ordinance will also designate and establish the Marquis Harbor-West Business District in relation to the adoption of said Business District Plan. Additional documentation attached.

9. Council Bill/General Ordinance 3041-2019
An Ordinance establishing the certain business district taxes in the Marquis Harbor-West Business District; and imposing the certain business district taxes in the Marquis Harbor-West Business District.
Explanation: As part of the Lease Agreement for the proposed Captain’s Table Restaurant to be constructed at Marquis Harbor, the City has agreed to establish a Business District pursuant to the Illinois Business District Development and Redevelopment Business District Law. 10. Council Bill/General Ordinance 3042-2019
An Ordinance amending Chapter 34, “Water and Sewers,” of the Moline Code of Ordinances, Section 34-2121, “Charges and Collections,” by enacting one new subsection (j) to allow for an exemption of charges for customers who are directly affected by red water.
Explanation: City staff has been actively working to resolve the red water problem since it became a Council goal in 2015. At the October 22, 2019, Committee-of-the-Whole meeting, Council authorized a waiver of the use charge for water used by customers directly affected by the discoloration issue. Staff has developed an amendment to Section 34-2121 of the Code of Ordinances to allow for exemption of such charges for customers who are directly affected. This exemption would be in effect for all utility bills issued after January 1, 2020, and would remain in effect until such time as mains are replaced or the problem is solved by chemistry changes. In either event, the exemption would be removed beginning with the first utility bill issued after analysis indicates iron concentrations are reduced to appropriate levels.
Fiscal Impact: Reduction to the Water Fund Revenues of approximately $12,500

11. Council Bill/Resolution 1157-2019
A Resolution amending Budget Resolution No. 1155-2018 by authorizing changes to various line items in the budget for FY 2019; and authorizing Finance Director to do all things necessary to complete said changes.
Explanation: Budget amendments are compiled periodically throughout the fiscal year and presented to City Council for approval. These amendments are proposed to reflect recent changes to the current budget to avoid any adverse effect to the City’s legal budgetary compliance. The amendments as presented reflect the final budget amendments for 2019. Additional documentation attached.

12. Council Bill/Resolution 1158-2019
A Resolution authorizing the Mayor and City Clerk to execute and attest to a contract with Total Maintenance Inc. (TMI), Bettendorf, Iowa, to provide HVAC – Total Service and Preventative Maintenance for a five-year period commencing January 1, 2020, and ending December 31, 2024, for a total amount of $662,823.
Explanation: The current 5-year HVAC Total Coverage Maintenance Agreement with Total Maintenance Inc. (TMI) expires on December 31, 2019. The agreement provides for HVAC system service and maintenance for nine City buildings. City staff published a Request for Proposals (RFP) and TMI submitted the most responsible and responsive proposal. TMI offers a savings of 4 percent when paid annually, therefore, it provided the lowest cost proposal. The term of the agreement will be for a five-year period commencing January 1, 2020, and ending December 31, 2024. The cost per year from 2020 through 2024 with the 4 percent savings is $126,730, $129,585, $132,500, $135,480, and $138,528, for the total amount of $662,823. Additional documentation attached.

A Resolution adopting a budget for corporate purposes for the Fiscal Year 2020.
Explanation: This resolution adopts the Fiscal Year 2020 Budget. The budget provides the guidelines for incurring expenditures, financial reports and fiscal controls during the year. Additional documentation attached.

14. Council Bill/Resolution 1160-2019
A Resolution authorizing the implementation of a Road Diet Policy for the City of Moline; and authorizing City staff to do all things necessary to implement a Road Diet Policy that provides general guidelines for implementation of said policy and changes to the Moline Code of Ordinances, which shall be brought before the City Council for final approval and adoption in January, 2020.
Explanation: Council approved the implementation of a Road Diet at the Committee-of-the-Whole meeting on December 10, 2019. Council directs staff to do all things necessary to implement a Road Diet Policy for the City of Moline that provides general guidelines for implementation of said policy and changes to the Code of Ordinances, which shall be brought before the City Council for final approval and adoption in January, 2020. First Reading Ordinances
15. Council Bill/General Ordinance 3043-2019
An Ordinance amending Chapter 4, “Alcoholic Liquor,” of the Moline Code of Ordinances, Section 4-3208(e), by increasing the application fee and the annual fee for a Class K Video Gaming Establishment liquor license; and Chapter 5, “Amusements,” of the Moline Code of Ordinances, Section 5-1103(b), by increasing the annual fee for a video gaming Terminal Operator license.
Explanation: The City adopted Council Bill No. 3019-2012 in July 2012 to allow video gaming terminals in licensed establishments within the City and to allow the City and eligible establishments to pursue video gaming as a potential revenue source. A “licensed establishment” is a licensed retail establishment where alcoholic liquor is drawn, poured, mixed or otherwise served for consumption on the premises. The City adopted Council Bill No. 3029-2018 in July 2018 to enact a Class K video gaming establishment liquor license for businesses whose principal purpose is video gaming with the majority of their annual revenues being derived from said activity; a Class K video gaming establishment liquor license application fee is $3,000 and the annual license fee is $1,400. In addition, the City adopted Council Bill No. 3053-2018 in December 2018 to institute a new license for video gaming terminal operators to help regulate video gaming within the City; the license requires a terminal operator to pay an annual fee of $1,000 for each video gaming terminal the operator places (by sale, lease or rent) with a licensed establishment within the City.
The Council and City staff have determined that the licensing and monitoring of video gaming in the City requires considerable staff time and resources in the Executive, Finance, and Police Departments, and the current fee structure does not accurately capture the costs of providing the services. Furthermore, the City continues to seek and implement ways to better regulate video gaming and to address on-going concerns regarding same among City officials and residents. The City Council finds and declares that it is in the best interests of the general health, welfare and safety of the City and its residents to amend the fees referenced herein. The proposed amendments are as follows: 1) increase the Class K video gaming establishment liquor license application fee from $3,000 to $8,000; 2) increase the Class K video gaming establishment liquor license annual fee from $1,400 to $5,000; and 3) increase the video gaming terminal operator license annual fee for each terminal from $1,000 to $1,200.
Staff seeks consideration of this item so that notice regarding the increases may be provided with the Finance Department’s January 2020 license renewal notices to applicable licensees. Explanation: The current franchise agreement with MidAmerican Energy Company was granted on April 27, 1994, for a period of 25 years. MidAmerican Energy Company seeks to enter into a new agreement with the City for the right and non-exclusive franchise to acquire, construct, erect, maintain and operate an electric system in the City and to furnish and sell electric energy to the City and its inhabitants for a period of 25 years. 8. Council Bill/Special Ordinance 4017-2019
A Special Ordinance requesting the County Clerk to not extend 2019 taxes for payment of all principal and interest on City of Moline General Obligation Corporate Purpose Bonds.
Explanation: Annually, the City of Moline instructs the County Clerk not to extend property taxes for municipal bonds. Principal and interest on all City General Obligation Bonds are paid from other revenue sources. The 2019 abatement ordinance must be filed with the County Clerk by the last day of January 2020. Additional documentation attached.
Fiscal Impact: This ordinance must be passed and filed by the last day of January 2020 or the County Clerk will extend additional property taxes for 2019 tax bills, collectible in 2020.
