Resolutions

1. Council Bill/Resolution 1003-2020

A Resolution authorizing approval of Change Order #1 with Walter D. Laud Inc. for Project #1312, 10th Avenue Reconstruction, in the amount of $11,419.85.

Explanation: In order to make the final payment to the contractor and close out the contract, a change order is needed in the amount of $11,419.85. This change order increases the original contract value of $1,382,944.45 by 0.8% to $1,394,364.30. The change order reflects actual quantities constructed and includes additional costs for pavement extensions, old water main and service maintenance during construction, and unanticipated storm sewer costs along 10th Avenue. 2. Council Bill/General Ordinance 3001-2020

An Ordinance amending Chapter 34, “WATER AND SEWERS,” of the Moline Code of Ordinances, Section 34-2139, “WASTE OF WATER,” pertaining to the City’s sewer use ordinance, by amending its current text to subsection (a) and enacting one new subsection (b).

Explanation: At the December 10, 2019, Committee-of-the-Whole meeting, the City Council discussed giving relief to customers when unusually high water usage is due to defect in pipes, faucets, or other fixtures. This amendment allows the City Administrator to adjust water and sewer charges in these situations.

Fiscal Impact: Discounted rate of 20% of the full water/sewer charge for the balance of the volume in the current invoice remaining after deducting the average volume based on three invoices immediately preceding the disputed invoice.

Resolutions

3. Council Bill/Resolution 1004-2020

A Resolution authorizing the Community and Economic Development Department, on behalf of the City of Moline, to apply to the Illinois Housing Development Authority (“IHDA”) for an Illinois Affordable Housing Trust Fund Single Family Rehabilitation (SFR), Round 3 with Roof Only Option (SFR-R) and Disaster Contingency Award (DCA) Grant in the amount of $435,000; and authorizing City staff to do any and all things necessary to apply to the Illinois Housing Development Authority (“IHDA”) for an Illinois Affordable Housing Trust Fund Single Family Rehabilitation (SFR), Round 3 with Roof Only Option (SFR-R) and Disaster Contingency Award (DCA) Grant.

Explanation: The City has a list of households waiting to participate in the Community Housing Services Program and is currently working through forty plus active applications, which demonstrates a need for additional resources for owner-occupied housing rehabilitation in the City. The Illinois Affordable Housing Trust Fund Single Family Rehab Program (SFR), Round 3 with Roof Only Option (SFR-R) and Disaster Contingency Award (DCA) program will assist low-income and very low-income homeowners with repairs to their homes and will also remove health and safety hazards by repairing or replacing costly maintenance items. The City is requesting $435,000 for the SFR/SFR-R Program. Each eligible property would receive assistance up to a maximum of $45,000. The City’s use of the grant funds will support the City’s continued partnership with neighboring communities. Additional documentation attached.

First Reading Ordinances

4. Council Bill/General Ordinance 3002-2020

An Ordinance amending Chapter 4, “ALCOHOLIC LIQUOR,” of the Moline Code of Ordinances, by amending Sections 4-3302 to 4-3307, 4-3309, 4-3310 and 4-3315, regarding the retail sale of single serving containers of certain alcoholic liquors.

Explanation: The City adopted Council Bill/General Ordinance No. 3028-2019 on November 19, 2019, to enact a new section, Section 4-4110, to regulate the retail sale of single serving containers of certain alcoholic liquors in their original packaging. The restricted sales apply to any holder of a City of Moline Class A, AA, B, C, CC, CCC, D, E, F, FF, G, H or K liquor license. The ordinance language regarding minimum quantities has resulted in questions from liquor licensees, and Corporation Counsel has determined that certain language regarding minimum quantities in the above-referenced sections should be removed to avoid confusion. This ordinance will remove all specific references of “fifty-one milliliters or larger” from those sections to align with the new Section 4-4110.

5. Council Bill/Special Ordinance 4001-2020

A Special Ordinance authorizing the Mayor and City Clerk to execute and attest to a Consent Agreement between the City of Moline and USCOC of Greater Iowa, LLC, a Delaware limited liability company, to permit a modification of equipment on City-owned property located at 1531 17th Avenue, Moline.

Explanation: The City of Moline has a Water Tank Lease Agreement with USCOC of Greater Iowa, LLC (hereinafter “USCOC”) to allow antennae facilities on City premises located at 1531 17th Avenue. USCOC has notified the City that it would like to modify the existing equipment at the site. USCOC is proposing to remove three (3) antennas and three (3) radio units and replace them with six (6) new antennas and nine (9) new radio units at the same mount height. Corporation Counsel has reviewed this request and determined that the Lessee is exercising its rights in the Water Tank Lease Agreement and that an amendment of the existing lease is not required. Additional documentation attached.
