1. Council Bill/General Ordinance 3003-2020
An Ordinance amending Chapter 26, “POLICE,” of the Moline Code of Ordinances, Section 26-2318, “UNIFORMS,” subsection (b), to authorize the Chief of Police sole responsibility for decisions pertaining to Moline Police personnel uniforms, with the exception of the uniform allowance set annually by the City Council; and ratifying all prior actions of Chief of Police Darren Gault pertaining to Moline Police personnel uniforms.
Explanation: Section 26-2318(b) of the Moline Code of Ordinances allows the Chief of Police (“Chief”) to appoint and regulate the style and quality of uniforms for all police department members by and with the approval of the Committee-of-the-Whole of the City Council; subsection (d) provides for a uniform allowance to be set annually by the City Council. Due to various timing issues, including term restrictions of grants available for uniform purchase, manufacturing, and the City’s budgeting process, the Chief recently deemed it prudent to make certain uniform related decisions without prior consent of the Committee-of-the-Whole. The Code of Ordinances allows the Chief to have control and be responsible for all police equipment belonging to the City and to cause a record of all transactions and expenditures to be kept; allowing the Chief the authority for decisions pertaining to the police personnel uniforms will align with these duties. This ordinance will amend Section 26-2318, subsection (b), to authorize the Chief sole responsibility for decisions pertaining to Moline Police personnel uniforms; the exception of the uniform allowance set forth annually by the City Council under subsection (d) will remain unchanged. Further, Chief Darren Gault and Corporation Counsel seek ratification of all prior actions by Gault pertaining to Moline Police personnel uniforms.

2. Council Bill/Special Ordinance 4002-2020
A Special Ordinance providing for financing by the City of Moline, Illinois, for the water main in TIF #7 Airport Business Park, by authorizing issuance of $281,831 in a Revenue Anticipation Note and purchase of same by the Water Fund of the City of Moline, Illinois, appropriating monies for said purposes, and authorizing execution of any related documents.
Explanation: On January 7, 2020, City Council approved TIF #7 to borrow $631,908 from Water and WPC Funds in proportional amounts to the amounts spent on each project for each utility as part of the 2020 adopted budget.
Fiscal Impact: Reduction of $281,831 to Water Fund Reserves

4. Council Bill/Resolution 1010-2020
A Resolution authorizing the Mayor and City Clerk to execute a contract with Miller Trucking & Excavating Company for Project #1333, 2020 Trenchless Water Main Project, in the amount of $361,008.00.
Explanation: Project #1333, 2020 Trenchless Water Main Project, includes the replacement of water main at two dead end, red water locations of 15th Avenue, west of 3rd Street, and 30th Street Court, south of 27th Avenue. Bids were opened and publicly read on January 21, 2020, for Project #1333 with the following results:

5. Council Bill/Resolution 1011-2020
A Resolution ratifying the approval of a policy agreement with UnitedHealthcare Insurance Company to provide a fully insured prescription drug plan (Employer Group Waiver Plan – “EGWP”) for Medicare- eligible retirees and retirees’ dependents for a one-year period commencing January 1, 2018, and a one- year renewal period commencing January 1, 2019; and authorizing the Human Resources Manager to formally execute the policy agreement.
Explanation: Resolution No. 1151-2019, approved December 10, 2019, authorized the Human Resources Manager to execute a policy agreement with UnitedHealthcare Insurance Company (“UnitedHealthcare”) to provide a fully insured prescription drug plan (Employer Group Waiver Plan – “EGWP”) for Medicare-eligible retirees and retirees’ dependents for a one-year period commencing January 1, 2020.
The City implemented the EGWP with UnitedHealthcare, effective January 1, 2018, pursuant to recommendation by TrueNorth Companies, the City’s health benefit consulting service, and following presentation and City Council approval of Resolution No. 1196-2017; said resolution for reinsurance coverage for medical and prescription drug benefit claims included the intent to shift to an EGWP based upon a projected net cost savings of $120,327 to the Retiree Health Fund in 2018 under the EGWP. The City Council found the EGWP to be in the best interest of the City based on the cost savings estimate and that it offered no change in benefits, and Council gave authority to City staff to proceed pursuant to Resolution No. 1196-2017; however, the policy agreement for the EGWP was not independently and formally brought before Council for approval and execution. The term of the policy agreement for the EGWP effective January 1, 2018, is for one year with a one-year renewal period commencing January 1, 2019. The implementation of the EGWP saved the City an estimated $407,041 in 2018 and $302,519 in 2019 based on decreased claims costs and elimination of the need for stop loss coverage for the effected group. City staff and Corporation Counsel seek ratification in approving the EGWP based upon Council’s direction to proceed, and to authorize the Human Resources Manager to formally execute the policy agreement dated January 1, 2018. 6. Council Bill/Resolution 1012-2020
A Resolution authorizing the Mayor and City Clerk to execute and attest to an agreement with Federal Signal Corporation for the purchase and installation of equipment for the upfitting of twenty-one (21) 2020 Ford Police Interceptor Utility units in the amount of $235,327.92.
Explanation: Fleet maintenance staff has purchased 21 new utility vehicles for the Police Department. City staff published a Request for Proposal (RFP) for the purchase and installation of Police specific equipment and electronics for upfitting to complete the units and deploy them for service. The lowest, most responsible and responsive proposal was submitted by Federal Signal Corporation in the amount of $235,327.92. Federal Signal Corporation can also guarantee to have all units completed within 45 business days from initial vehicle pick up. Additional documentation attached.
Fiscal Impact: Funds are budgeted in the following accounts: $141,000 in Contractual Repairs #448-0846-437.04-25; $520,000 in Vehicle Parts #448-0846-437.06-68.

7. Council Bill/General Ordinance 3004-2020
An Ordinance amending Chapter 35, “ZONING AND LAND DEVELOPMENT,” of the Moline Code of Ordinances, by enacting one new Division 8, “ADULT USE CANNABIS BUSINESSES;” and by amending Table 35-2200.1, pertaining to non-administrative development review, by adding “Special Use Permit Adult Use Cannabis” to the table’s list of procedures.
Explanation: In June 2019, the State of Illinois enacted Public Act 101-0027, the Cannabis Regulation and Tax Act (the “Act”), effective January 1, 2020, to regulate the cultivation, sale, possession, and consumption of cannabis in Illinois. The Act authorizes the sale and consumption of cannabis for recreational purposes for adult use only in a manner similar to alcohol. The term “adult” refers to any person 21 years of age or older. Pursuant to the Act, the City is authorized to regulate adult use cannabis businesses, such as dispensaries, cultivation centers, infusers, transporters, processers, and craft growers (collectively, “Cannabis Business Establishments”); enact reasonable zoning ordinances or resolutions regulating Cannabis Business Establishments; enact ordinances governing the time, place, manner, and number of Cannabis Business Establishments to be located within the City, including certain minimum distance limitations; enact ordinances to prohibit or significantly limit Cannabis Business Establishments’ locations; regulate Cannabis Business Establishments through the use of special use permits; and regulate the on-premises consumption of cannabis at or in a Cannabis Business Establishment.
This ordinance will enact a new division to Chapter 35 of the Code of Ordinances for the City’s regulation of adult use cannabis businesses and the process for zoning approvals. It will also establish four cannabis dispensary overlay districts within Moline; the overlay districts will allow for the construction, operation, maintenance, repair and replacement of a single cannabis dispensary within each overlay district. A public hearing was held during the January 8, 2020, Plan Commission meeting, and the Plan Commission unanimously approved the ordinance amendment to proceed; the amendment was presented at the January 21, 2020, Committee-of-the-Whole meeting.
This ordinance has been revised to incorporate amendments made by Council following its first reading on February 4, 2020. Those changes include separation of the Airport / John Deere Road Corridor, increasing the number of cannabis dispensary overlay districts from three to four; clarification that following public hearing on a special use permit application for adult cannabis use, the Plan Commission shall make a recommendation to the City Council concerning the application; and a revision to the measurement to be used for the 100’ distance limit between a residence in a residential district and a cannabis business establishment. The attachment to this item contains maps of the cannabis dispensary overlay districts that will be contained in the ordinance, and a second Uptown Corridor map showing the 100’ separation from dispensary to building, as requested by Council at the January 21, 2020, COW meeting. First Reading Ordinances
8. Council Bill/Special Ordinance 4004-2020
A Special Ordinance vacating a 1,100 square foot platted drainage and utility easement at 6041 34th Avenue and 6053 34th Avenue, Moline.
Explanation: Brad Bagby of BM Bagby Inc. has requested that a platted drainage and utility easement lying on 6041 and 6053 34th Avenue be vacated so that the property may be developed. Mr. Bagby would like to construct two three-plex residential structures at the site. City Utilities staff and other private utility companies have been notified and have expressed no objections to vacating the easement. Additional documentation attached.

9. Council Bill/Special Ordinance 4005-2020
A Special Ordinance amending Special Ordinance Nos. 4034-2018 and 4001-2019 for financing by the City of Moline, Illinois, by revising the issuance date, principal and source funding for the Revenue Anticipation Note and purchase of same by the Water Pollution Control Fund of the City of Moline, Illinois, appropriating monies for said purposes, and authorizing execution of any related documents.
Explanation: On August 14, 2018, City Council approved a Revenue Anticipation Note for $800,000 to be issued by the Park Fund and to be purchased by the General Fund to partially finance the rebuilding of the Captain’s Table Restaurant. The note was dated December 1, 2018, with interest at 3.50%. On January 22, 2019, City Council approved an amendment to the Revenue Anticipation Note, updating the note date to April 1, 2019. On July 23, 2019, City Council approved a contract with Bush Construction Company for the Captain’s Table Building Construction, increasing Revenue Anticipation Note funding from the General Fund from $800,000 to $1,174,995. Due to a delay in construction and changes to funding, this note requires another amendment. In order to reduce the interest expense to the Park Fund, the transfer will not commence until insurance proceeds have been applied and depleted. Additional documentation attached.
