Resolutions

1. Council Bill/Resolution 1034-2020

A Resolution authorizing the Mayor and City Clerk to execute and attest to an Agreement with Strand Associates Inc. for professional engineering services required to model and analyze hydraulic data related to the River Drive sanitary sewer interceptor in an amount not to exceed $67,800.

Explanation: The Illinois Environmental Protection Agency issued a non-compliance advisory to the City in 2009 related to hydraulic overloads of the sanitary sewer collection system caused by wet weather conditions. Since the advisory was issued, the City has undertaken a number of initiatives to mitigate overflows. Treatment plant improvements that allow a greater flow of wastewater into the plant in wet weather conditions have been constructed. In addition, interceptor relocations related to I-74 Bridge construction resulted in re-contouring of the interceptor for reduced head losses.

With these improvements in place, it is appropriate to perform a more focused analysis on the River Drive sanitary sewer interceptor downstream of the 39th Street pumping station to determine if improvements may be made to remove certain restrictions in that piping, while also modeling hydraulic simulations of improved conditions downstream in the more developed areas of downtown. Strand Associates Inc. has previously performed similar work for the City. Additional documentation attached.

2. Council Bill/Resolution 1035-2020

A Resolution authorizing the Mayor and City Clerk to execute and attest to a contract with Davenport Electric Contract Company for Project #1339, Video Detection Systems Installation, in the amount of $51,749.49.

Explanation: Bids were opened and publicly read on March 3, 2020, for Project #1339, with the following results:

Davenport Electric Contract Company submitted the lowest and the most responsible and responsive bid. Project #1339 includes installation of previously purchased video detection systems at the following City intersections: 19th Avenue and 1st Street A; 19th Avenue and 7th Street; 19th Avenue and 12th Street; 12th Avenue and 41st Street; 12th Avenue and 48th Street; 12th Avenue and 53rd Street. Other work shall include furnishing and installation of PVC conduit and electric cable, installation only of provided signage, and furnishing and installation of signal heads and pedestrian signal heads. The sole source procurement for traffic signal equipment upgrade in the amount of $112,832.00 was previously approved by the Interim City Administrator and discussed as an informational item at the Committee-of-the-Whole meeting on February 4, 2020. Pavement striping will take place as part of this project and will be installed as part of the annual pavement striping program. Additional documentation attached.

3. Council Bill/Resolution 1036-2020

A Resolution authorizing the Mayor and City Clerk to execute and attest to an Agreement with MidAmerican Energy Company for installation of electric service to the water tank site located at the former Oak Glen Home property in an amount not to exceed $73,807.69.

Explanation: In 2018, the City entered into an intergovernmental agreement with the Sheriff of Rock Island County and the County of Rock Island to acquire abandoned water tanks located at the former Oak Glen Home, Coal Valley, for the purpose of extending the City’s water service to City-owned real estate within proximity to the tanks. City staff has begun efforts to refurbish the water tanks, which includes establishment of electric service to the site; existing service is obsolete and cannot be used. MidAmerican Energy Company is the exclusive electric service provider to the area, and the conductors and transformer installed will be owned by MidAmerican as part of its network. This agreement with MidAmerican includes installation of the conductors and transformer needed to power pumping facilities and other appurtenances at the site. City staff expects to contract separately for the installation of required conduits. The City is the recipient of an Illinois Department of Commerce and Economic Opportunity grant in the amount of $60,000.00 that may be used toward this work. An amount of $85,000.00 is also budgeted in account #310-1718-434.08-45, Water Contracts. Additional documentation attached.

4. Council Bill/Resolution 1037-2020

A Resolution establishing certain practices and procedures for the City of Moline during the COVID-19 state of emergency.

Explanation: On March 9, 2020, J.B. Pritzker, Governor of the State of Illinois, issued a disaster proclamation declaring a state of emergency as a result of the spread of the COVID-19 virus. On March 12, 2020, Pritzker issued an Executive Order encouraging social distancing to fight the spread of COVID-19. In furtherance of the goal of social distancing, the City of Moline desires to establish practices and procedures for the duration of the state of emergency declared by the Governor that shall be in force and effect unless otherwise ordered by the Mayor, the Governor or federal authorities under their powers concerning emergencies.

5. Council Bill/Resolution 1038-2020

A Resolution rescinding the Intergovernmental Agreement entered into between the Department of Healthcare and Family Services and the City of Moline pursuant to Council Bill/Resolution No. 1133-2019; and authorizing the Mayor and City Clerk to execute a revised Intergovernmental Agreement between the Illinois Department of Healthcare and Family Services and the City of Moline to allow the City to be eligible for supplemental payments for covered ambulance services pursuant to the terms of the Intergovernmental Agreement; and authorizing all appropriate City of Moline officers and staff to do all things necessary to complete each of the City’s responsibilities pursuant to the Intergovernmental Agreement.

Explanation: The Illinois Department of Healthcare and Family Services (HFS) has submitted an application to the Centers for Medicare and Medicaid Services to change the methods and standards of payment to a “Participating Municipal Ambulance Provider” (Provider) for covered ambulance services as defined in the Intergovernmental Agreement (IGA). The City of Moline’s Fire Department is a Provider.

In anticipation of the application approval by the Centers for Medicare requesting an agency cost report and an executed IGA from those Provider

the program. The City received this information in late September, and submission of an initial cost report and an executed IGA were completed on October 8, 2019. The City received a new IGA in March to replace and rescind the previous IGA signed in 2019 with a deadline of March 30, 2020, in order to be eligible for funding. The IGA has been revised because changes have been made between the State of Illinois and the Center for Medicaid Services to review a new State Plan Amendment that will accompany the IGA. The City therefore seeks to complete execution of the revised IGA for submission of the documents to HFS by its March 30, 2020, deadline to be eligible for 2020 funding.

In sum, HFS is proposing a payment method that will allow a Provider to receive supplemental payments above the fee schedule rates currently received if the cost to provide the covered ambulance services exceeds the current fee schedule. If the new funding method is approved, each Provider will be eligible to receive the difference between the actual costs for transport and the fee schedule. A Ground Emergency Medical Transport (GEMT) Reimbursement program will be adopted, and HFS and the City would evenly split the enhanced reimbursement revenue. As part of the program, the Fire Department will be required to submit a new cost report annually as directed by HFS. This item is appearing on the March 24, 2020, City Council agenda under “Items Not on Consent” to allow City staff time to complete submission of an initial cost report and an executed IGA to HFS by the above-referenced March 30, 2020, deadline. Fiscal Impact: To be determined; potential for enhanced revenue for providing City covered ambulance services is dependent upon HFS’s application approval by the Centers for Medicare and Medicaid Services.

6. Council Bill/Resolution 1039-2020

A Resolution authorizing the Mayor and City Clerk to execute and attest to a Memorandum of Understanding between Quad Cities Running Club Inc. and the City of Moline setting forth the terms for annual funding for the Quad Cities Marathon and designating Centre Station, 1200 River Drive, Moline, as the Marathon’s start and finish line location, with said Memorandum of Understanding to be in effect for a period of fifteen years.

Explanation: The City of Moline and Quad Cities Running Club Inc. (“QCRC”) wish to execute a Memorandum of Understanding whereby QCRC agrees to set Centre Station, 1200 River Drive, Moline, Illinois, as the designated location of the start and finish lines of the Quad Cities Marathon (“Marathon”) for a fifteen-year term. The City of Moline will install and maintain additional electrical service outlets and amenities at Centre Station, 1200 River Drive, Moline, at a cost not to exceed $20,000, with the provision that, if prior to the end of the MOU’s fifteen-year term, QCRC discontinues the Marathon or moves the Marathon’s start and finish lines from Moline without the mutual consent of the City, then QCRC shall reimburse the City

for the full $20,000 cost. The City of Moline will provide annual funding in the amount of $10,000 for the Marathon event each year for which this MOU remains in effect. A co-branded festival event will be coordinated and administered by Moline Centre Main Street and held on the Friday evening of the Marathon weekend. When there is a ticketed event occurring at the TaxSlayer Center on the Friday evening of the Marathon weekend, QCRC and its sponsor and vendor partners shall wait until 11:59 p.m. on that Friday to commence their set-up and logistical activities within the TaxSlayer Center , and the City of Moline shall pay QCRC $2,500 as full and complete compensation for any additional costs and inconvenience suffered by QCRC and its sponsor and vendor partners from said delay in set-up and logistical activities for the Marathon. The Special Event Committee has approved the proposed terms of the MOU. Additional documentation attached.

Fiscal Impact: $10,000 annually for fifteen years, to be paid from the Tourism Fund ($50,000 annual allocation for special events)

7. Council Bill/Resolution 1040-2020

A Resolution approving a City of Moline policy entitled Telework Policy and Procedure.

Explanation: The City of Moline is a home rule unit of government and has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs. On March 9, 2020, J.B. Pritzker, Governor of the State of Illinois, issued a disaster proclamation declaring a state of emergency as a result of the spread of the COVID-19 virus. On March 12, 2020, Governor Pritzker issued an Executive Order encouraging social distancing to fight the spread of COVID-19. The City of Moline is concerned about the health and safety of its employees to the same extent as it is about its residents, and it is the goal of City of Moline officials to reduce the risk of COVID-19 exposure to its employees to the greatest extent possible and consistent with state and federal emergency orders. The objective of the Telework Policy and Procedure is to implement and provide guidelines to allow City staff to work from a remote location during the state of emergency period; eligible employees would be those whose positions allow them to complete work from a remote location pursuant to the terms of the policy. The City finds that this policy is in the best interest of the City of Moline and in the best interest of the public health, safety and welfare. Additional documentation attached.
