1061-2023 A Resolution establishing the number of cannabis business establishments allowed in the City of Moline, Illinois.
Approved. Alderperson Moyer, seconded by Alderperson Timion, moved to approve Council Bill 1061- 2023. Alderperson Waldron stated that we do not need one license, and we certainly do not need two licenses in the City. Motion carried on roll call with the following vote: ayes: Alderpersons Macias, Wendt, Timion, Moyer, O’Brien; nays: Alderpersons Williams and Waldron.

Second Reading Ordinances
3008-2023 An Ordinance approving a Special Use Permit for a Cannabis Dispensary (Bolden Investments I, LLC – 4301 44th Avenue, John Deere Road Corridor).
Adopted. Alderperson Moyer, seconded by Alderperson Timion, moved to approve Council Bill 3008- 2023. Alderperson Wendt noted that a provision exists in Illinois state law that limits cannabis advertising within 1,000 feet of a school, playground, park or arcade. Wendt indicated that such locations exist within 1,000 feet of the proposed dispensary. There is an exemption to allow just the name of the licensed business to be displayed on the building. No window advertising, interior advertising. Wendt expressed concern for its proximity to QC Entertainment (bowling and arcade) and the school on the other side of that. Dan Bolin, Corporation Counsel, stated that the definition of advertising includes any promotion of the business, indicating that state law provides a list of examples that are exterior in nature. Alderperson Wendt read the definition of advertising and the referenced list from statute: “including but not limited to newspaper, radio, internet, electronic media, television advertising, distribution of flowers and circulars, billboard advertising, and the display of window and interior signs”. Signage with the business name is allowable on the outside of the building. The Act goes further to prohibit a cannabis business from placing or maintaining an advertisement of cannabis or cannabis-infused products in any form or through any medium within 1,000 feet of the perimeter of school grounds, playgrounds, recreational facility, a childcare center, a public park or library, or a game arcade that restricts patrons to being at least 21 years of age. Mayor Rayapati thanked Council for their thoughts, and mentioned that enforcement of signage will be clarified and followed up by staff. Bob Vitas, City Administrator, confirmed that the City would be sure to follow all state laws. Motion carried on roll call with the following vote: ayes: Alderpersons, Macias, Wendt, Timion, Moyer, and O’Brien; nays: Alderpersons Williams and Waldron.
