Mayor Rayapati called the meeting to order at 6:00 p.m. in Council Chambers.

Presentation

Neighborhood Partnership Committee June 2023 Neighbor of the Month Awards. KJ Whitley, Community Development Manager presented the following awards:

• Mike and Sharon Scott, 2009 15th Street A - Residential Award

River Bend Food Bank Sub-Recipient Award, $300,000. KJ Whitley, Community Development Manager, provided an overview of CDBG-CV funding (presentation attached). The City is providing $300,000 to the River Bend Food Bank over the next 3 years. Whitley introduced Nancy Renkes, River Bend Food Bank President & CEO, who explained that the organization is very grateful for the donation. Renkes shared the continuing effects of the COVID-19 pandemic, including high food costs and decreasing donations. Jana Fleming, Program & Volunteer Coordinator, shared information about programs and how the funds will be spent, with $200,000 being allocated to the SouthPark Mall Food Pantry. Funds will also be used for small pantry food purchasing, with $100,000 disbursed to nine (9) Moline partner agencies for food budget supplementation.

2022 Comprehensive Annual Financial Report. Carol Barnes, Finance Director, introduced Jason Coyle, a partner with Baker Tilly US, LLP. Coyle presented the report, indicating that everyone should review it if possible. The City has several longer-term leases and should look at the life of such leases and account for those as receivables. Assets and investments for the IMRF Pension Fund exceed any liabilities, so the City is in a good financial position and will continue to contribute appropriately to the IMRF pension. For Police Pension and Fire Pension Funds, they are currently funded at 60 percent, which is in part due to the market conditions in 2022. When looking at TIF expenditure audits, there were no findings to report. In the single audit, which occurs when more than $750,000 of federal funding is spent, there were no findings to report. Coyle shared that they look at any risks that the City needs to address as it relates to audit procedures and make any recommendations. Mayor Rayapati thanked the City staff for keeping us in compliance and producing positive audit results.

At 6:33 p.m., Mayor Rayapati recessed the Committee-of-the-Whole meeting and called the City Council meeting to order for a public hearing.

Public Hearing

Mayor Rayapati called the public hearing to order at 6:33 p.m., for the tax increment redevelopment plan and project for the Eastgate TIF Redevelopment Project Area. Bob Vitas, City Administrator, provided a history for the benefit of public attendees, stating that the TIF being considered tonight will impact Parr Instruments’ ability to redevelop property and expand its business. Founded in Moline, Parr is a major employer in the community and has elected to stay in Moline pending the creation of the proposed TIF district to assist them. The TIF will promote growth, supporting public improvements and retaining and attracting business. Moline has had 13 TIF districts, two of which have been retired. Carol Barnes, Director of Finance, added that TIF districts start with the base of existing property values, and they take advantage of the increment that might occur over the twenty-five (25) year period for potential redevelopment, and that it is not an additional tax to residents.

Public Comment - Speak in favor: Jim Nelson, Parr Instruments President and Chief Operations Officer, spoke about flooding and safety hazards that have caused difficulties for the company. Parr Instruments plans to more than double their size, as well as renovate existing buildings.

Alexandra Elias, Renew Moline, expressed that TIFs are a nationally accepted and necessary tool to focus investment in the community. It allows for physical improvements that wouldn’t be possible otherwise. She announced support for this TIF.

Name not stated/did not sign in: He asked about 48th Street and 5th Avenue area and the reason for stopping there. Administrator Vitas indicated that he would answer such questions at a later time, but that this hearing is related to the specifically proposed Eastgate TIF area.

Public Comment - Speak against: There were no public speakers in opposition of the proposed Eastgate TIF.

Mayor Rayapati adjourned the public hearing and reconvened the Committee-of-the-Whole meeting at 6:49 p.m.

Public Comment

Name not stated/did not sign in: She shared that residents find the concept of a TIF difficult to understand, and they have many questions regarding what will occur residentially. Mayor Rayapati asked her to reach out to Alderperson Pat O’Brien to gain clarity on the project.

Questions on the Agenda

Mayor Rayapati stated that the oath of office for appointment of Kimberly Banning to the position of City Clerk, effective May 31, 2023, was pulled from the agenda due to personal illness.

Informational

June 2023 Status & Information Report. Bob Vitas, City Administrator, invited questions from Council on the report. Mayor Rayapati noted that the Public Art Commission is working on community art enhancements within the City, including a downtown mural. There were three (3) tobacco licenses recently issued, and she discussed the idea of limiting the number of licenses in the future. Mayor Rayapati also clarified that the City is not considering moving to 2:00 a.m. liquor licenses; rather, additional 3:00 a.m. license requirements will be enacted instead. Margaret Kostopulos, Corporation Counsel, clarified that this item should not have appeared in the Status & Information report. Alderperson Timion inquired about the 19th Street redevelopment of bike lanes, and Vitas shared that the project is progressing as expected.

15.2 1106-2023 A Resolution approving a final change order with Miller Trucking & Excavating, for Project #1376, US Route 6 Water Main Crossing, in the amount of $6,780.70.

15.3 1107-2023 A Resolution A Resolution approving a request for a street light at 28th Avenue, between 4129 and 4135 28th Avenue.

15.4 1108-2023 A Resolution authorizing the Director of Engineering to purchase traffic signal mast arms from The Lighting Digest for the 2023 Capital Improvement Project #1370, 16th Street and Avenue of the Cities Intersection Reconfiguration, for the amount of $72,972.73.

15.5 1109-2023 A Resolution authorizing the Mayor and City Clerk to execute and attest to an agreement with Hutchison Engineering, Inc. for engineering design for Motor Fuel Tax (MFT) Section 23-00292-00-RP, 34th Street Reconstruction from 4th Avenue to University Drive.

15.6 1110-2023 A Resolution authorizing the Mayor and City Clerk to execute and attest to a contract with Centennial Contractors of the Quad Cities, Inc., for Project #1432, Floreciente Streetscaping Phase 3, in the amount of $75,000.

15.7 1111-2023 A Resolution authorizing the Mayor and City Clerk to execute and attest to a licensing agreement with 3Bros Hospitality LLC dba Pour Bros Craft Taproom, 1209 4th Avenue, for the Dog Days of Summer Car Show scheduled for Saturday, June 10, 2023.

15.8 1112-2023 A Resolution authorizing the Mayor and City Clerk to execute and attest to a Second Amendment to Amended Lease Agreement to extend the Lease with Catfish Charlie’s by two (2) months, for May and June of 2023, to honor Paragraph 25.5 of the Amended Lease, which sets forth a “Force Majeure” Clause.

15.9 1113-2023 A Resolution authorizing the Community & Economic Development Department to apply to the Illinois Housing Development Authority (IHDA) for the Strong Communities Program (SCP) Round 2 Grant, in the amount of $556,160 for the City; and authorizing staff to do any and all things necessary to apply for the Strong Communities Program (SCP) Round 2 Grant.

Resolutions

17.1 1114-2023 A Resolution authorizing the Fleet and Facilities Manager to purchase a commercial remote control mower for the amount of $64,912.50, utilizing HGACBuy contract #Q05428-1.

Approved. Alderperson Schmidt, seconded by Alderperson Timion, moved to approve Council Bill 1114- 2023. Bob Vitas, City Administrator, said this equipment will save staff time and increase safety. Alderperson Schmidt appreciated the way this was approached in a fiscally responsible manner. Motion carried on roll call with the following vote: ayes: Alderpersons Macias, Razzaque, Timion, Finch, O’Brien, Castro, Schmidt and Murphy; nays: none.

17.2 1115-2023 A Resolution authorizing a variance to Chapter 34, “WATER AND SEWERS,” Section 3300, “When Required,” of the Moline Code of Ordinances to grant a variance to Section 34, “WATER AND SEWERS,” Section 2101, “APPLICATION FOR WATER SERVICE CONNECTIONS,” of the Moline Code of Ordinances, waiving the requirement at this time that 3740 31st Street be required to extend a public water main across the frontage of said property; granting the petitioner/property owner permission to make a service line connection to the public main at on 38th Avenue until such time as the water main is extended by others across this frontage; and, as a condition of approval, requiring the petitioner/property owner (and successors and assigns) to agree to voluntarily connect to said water main at such time as the water main is so extended to serve said property and to pay at that time the equitable share of such public main extension attributable to said property and to record these obligations against the property.

17.3 1116-2023 A Resolution authorizing the Mayor and City Clerk to execute and attest to a pre annexation agreement with Seema Antony (and successors and assigns) pursuant to a request for water service connection at 3740 31st Street, which is outside the City corporate limits and presently ineligible for annexation.

Approved. Alderperson Schmidt, seconded by Alderperson Timion, moved to approve Council Bill 1116- 2023. Motion carried on roll call with the following vote: ayes: Alderpersons Macias, Razzaque, Timion, Finch, O’Brien, Castro, Schmidt and Murphy; nays: none.

Non-Consent Agenda

First Reading Ordinances

18.1 3019-2023 An Ordinance amending Chapter 22, “OFFENSES - MISCELLANEOUS,” of the Moline Code of Ordinances, by repealing Chapter 22 in its entirety and enacting in lieu thereof one new Chapter 22 dealing with the same subject matter. Mayor Rayapati encouraged alderpersons to ask questions and discuss first reading ordinances, and then a motion should be made to advance the ordinance for second reading. Alderperson Schmidt inquired about the swimming language changes requested at the May 16, 2023 City Council meeting. Jonathon Fox, Califf Harper, clarified that this section referred to property owners whose property abuts to the river could contract with the City to enforce the “no swimming ordinance” on their private property. Fox shared there may be contracts that exist between the City and these individual private property owners, which is why it was left in. Alderperson Schmidt moved to amend Section 22-1108(b) to provide an explanation of the provision.

Seconded by Timion. Motion to amend carried on roll call with the following vote: ayes: Alderpersons Macias, Razzaque, Timion, Finch, O’Brien, Castro, Schmidt and Murphy; nays: none.

Advanced. Alderperson O’Brien, seconded by Alderperson Timion, moved to advance Council Bill 3019-2023 to second reading as amended. Motion carried on roll call with the following vote: ayes: Alderpersons Macias, Razzaque, Timion, Finch, O’Brien, Castro, Schmidt and Murphy; nays: none.

18.2 3020-2023 An Ordinance amending Chapter 26, “POLICE,” of the Moline Code of Ordinances, by repealing Chapter 26 in its entirety and enacting in lieu thereof one new Chapter 26 dealing with the same subject matter.

Advanced. Alderperson Schmidt, seconded by Alderperson Macias, moved to advance Council Bill 3020-2023 to second reading. Motion carried on roll call with the following vote: ayes: Alderpersons Macias, Razzaque, Timion, Finch, O’Brien, Castro, Schmidt and Murphy; nays: none.

18.3 3021-2023 An Ordinance Approving the Tax Increment Redevelopment Plan and Project for the Eastgate TIF Redevelopment Project Area. Vitas said he would be willing to meet with Council in the evening regarding this. Schmidt shared he has been in discussions with the School Board, who is generally supportive.

Advanced. Alderperson O’Brien, seconded by Alderperson Timion, moved to advance Council Bill 3021-2023 to second reading. Motion carried on roll call with the following vote: ayes: Alderpersons Macias, Razzaque, Timion, Finch, O’Brien, Castro, Schmidt and Murphy; nays: none.

18.4 3022-2023 An Ordinance designating the Eastgate TIF Redevelopment Project Area.

Miscellaneous Business

Mayor Rayapati shared that a special City Council meeting will be held on Monday, June 12, 2023, to share information about strategic planning. She thanked City staff and partners at Mercado on Fifth for the first two successful events of the season. Pre-planning will begin for the Dia de los Muertos Parade. Mayor Rayapati thanked alderpersons who have attended events as Mayor Pro Tem over the past few weeks.

Alderperson Macias thanked staff for their resourcefulness and quick response to a resident request for repair of alley potholes.

Alderperson Timion attended a ribbon cutting for the Channel Cat’s new dock.

Alderperson Castro shared that she attended a Black Hawk College press conference regarding MAP grant funding. Governor Pritzker was in attendance. The funding would ensure that in-need students could attend community college debt-free. Castro recently attended a ribbon cutting at Hotworx Moline and an assembly at Washington Elementary School on Friday, June 2, 2023, where she accepted a birdhouse that was decorated for the City.

Alderperson Schmidt stated that there will be a work session at the Moline Public Library on Thursday, June 8, 2023, regarding the proposed skate park amenities. Schmidt also pointed out that the Pride Party will occur in downtown Moline on June 17, 2023, and encouraged all to attend.

Bob Vitas, City Administrator, reported that he is pleased that Parr Instruments is interested in remaining in Moline. He commended the City’s Finance Department for their work on the budget, the recent audit, and other projects.

Alderperson Murphy, seconded by Alderperson Schmidt, moved for Executive Session, for the purpose of discussion of Collective Negotiating Matters-5 ILCS 120/2(C)(2), Property Acquisition-5 ILCS 120/2(C)(5), and Pending, Probable or Imminent Litigation-5 ILCS 120/2(C)(11).
