Explanation

1. A Resolution authorizing the Mayor and City Clerk to execute and attest to a collection service agreement with Diversified Adjustment Service Inc. (Keith Verbeke, Finance Manager)

Explanation: Routinely, every five years, the Finance Department solicits proposals for contracted services. The last awarded contract for collection services was executed in 2014. Collection services are used once City staff has exhausted all efforts in attempting to collect outstanding balances. Requests for proposals were solicited, and eight proposals were received and reviewed by a Finance selection committee. Diversified Adjustment Service Inc. submitted the most responsive and responsible proposal. The attachment to this item includes the RFP tabulation. Additional documentation attached.

2. A Resolution authorizing the Mayor and City Clerk to execute and attest to an agreement with Express Services Inc., doing business as Express Employment Professionals, for temporary and seasonal staffing services for a one-year period commencing March 1, 2020. (Alison Fleming, Human Resources Manager; Leah Miller, Human Resources Specialist)

Explanation: Express Services Inc., doing business as Express Employment Professionals, currently provides administrative services to fulfill temporary and seasonal staffing needs of City departments and also provides the insurance and liability coverage requested. The agreement, which includes a 0% increase to the current mark-up rate of 32.5%, will be for a one-year period commencing March 1, 2020. This is the first renewal of a two-year agreement with Express Services Inc. The last Request for Proposals was issued in November 2017, and it garnered proposals from two other companies. Although pricing is not the only consideration, Express Services Inc. provided the most cost effective proposal at that time. With no increase to the mark-up rate proposed for 2020 and an excellent level of customer service, staff recommends a one-year renewal. Additional documentation attached.

3. An Ordinance amending Chapter 35, “ZONING AND LAND DEVELOPMENT,” of the Moline Code of Ordinances, by enacting one new Division 8, “ADULT USE CANNABIS BUSINESSES.” (Derke Price, Corporation Counsel)

Explanation: The State of Illinois enacted the Cannabis Regulation and Tax Act in June 2019 to legalize recreational cannabis for adult use only and to regulate the use in a manner similar to alcohol. The term “adult” refers to any person 21 years of age or older. The Act became effective January 1, 2020. The proposed amendment will enact a new division to the Code of Ordinances for the City’s regulation of adult use cannabis businesses and the process for zoning approvals. It will also establish overlay areas within the City of Moline for cannabis dispensaries. Those areas are identified on corresponding maps. A public hearing was held during the January 8, 2020, Plan Commission Meeting, and the Plan Commission unanimously approved the amendment. The attachment to this item is a draft version of the proposed text amendment and maps of the overlay areas referenced herein and in the amendment. Additional documentation attached.

4. An Ordinance amending Chapter 26, “POLICE,” of the Moline Code of Ordinances, Section 26-2318, “UNIFORMS,” subsection (b), to authorize the Chief of Police sole responsibility for decisions pertaining to Moline Police personnel uniforms, with the exception of the uniform allowance set annually by the City Council; and ratifying all prior actions of Chief of Police Darren Gault pertaining to Moline Police personnel uniforms. Explanation: Section 26-2318(b) of the Moline Code of Ordinances allows the Chief of Police (“Chief”) to appoint and regulate the style and quality of uniforms for all police department members by and with the approval of the Committee-of-the-Whole of the City Council; subsection (d) provides for a uniform allowance to be set annually by the City Council. Due to various timing issues, including term restrictions of grants available for uniform purchase, manufacturing, and the City’s budgeting process, the Chief recently deemed it prudent to make certain uniform related decisions without prior consent of the Committee-of-the-Whole. The Code of Ordinances allows the Chief to have control and be responsible for all police equipment belonging to the City and to cause a record of all transactions and expenditures to be kept; allowing the Chief the authority for decisions pertaining to the police personnel uniforms will align with these duties. This ordinance will amend Section 26-2318, subsection (b), to authorize the Chief sole responsibility for decisions pertaining to Moline Police personnel uniforms; the exception of the uniform allowance set forth annually by the City Council under subsection (d) will remain unchanged. Further, Chief Darren Gault and Corporation Counsel seek ratification of all prior actions by Gault pertaining to Moline Police personnel uniforms. 5. A Resolution authorizing the Mayor, Chief of Police and City Clerk to execute and attest to a Memorandum of Understanding between the City of Davenport Police Department and the City of Moline Police Department setting forth the terms for access to the National Integrated Ballistic Information Network (NIBIN) under the control of the Davenport Police Department. (Darren Gault, Chief of Police)

Explanation: The City of Davenport Police Department and the City of Moline Police Department wish to execute a Memorandum of Understanding to permit authorized Moline Police Department personnel access to the NIBIN system under the control of the Davenport Police Department through its partnership with the U.S. Department of Justice, Bureau of Alcohol, Tobacco, Firearms and Explosives. Access to this system will allow for the collection, timely analysis, and dissemination of gun crime data to enhance the efforts of law enforcement to integrate resources to reduce firearms violence and to identify shooters and refer them to prosecution. 6. A Resolution authorizing the Mayor and Chief of Police to execute an Equitable Sharing Agreement and Certification between the Federal Government and the Moline Police Department setting forth the requirements for participation in the Equitable Sharing Program and certifying all receipts and expenditures of federal forfeiture funds, property and interest during the last fiscal year. Explanation: The Federal Government requires that the Police Department annually enter into a formal agreement and provide certification of receipts and expenditures of federal forfeiture funds and property. Additional documentation attached.

7. A Resolution authorizing the Mayor and City Clerk to execute and attest to a Law Enforcement Services Agreement between the City of Moline and Universal Protection Service, LLC, d/b/a Allied Universal Security Services, setting forth the terms for assignment of uniformed police officers to the SouthPark Mall complex for the period January 1, 2020, through December 31, 2020. (Darren Gault, Chief of Police)

Explanation: This item concerns an annual agreement for the assignment of uniformed police officers to the SouthPark Mall police substation. In part, the proposed agreement provides a total number of hours that a police officer will be present in the mall and provides for Universal Protection Service, LLC to reimburse the City the sum of $127,000. Staffing will be accomplished by allocating hours and days off among the three officers assigned to the program. Additional documentation attached.
