The City Council of the City of Aledo met in Regular Session in the Community Room at the Aledo Fire Station building. 

MAYOR HAGLOCH called the meeting to order at 6:31 P.M. The roll was called, whereupon the following answered present:

Aldermen ILA BERTRAND, TERRY BEWLEY, MICHAEL CHAUSSE, BARRY COOPER, DENNIS DIXON, JIM HOLMES, CHRIS KOPP, and LINDA SARABASA. Mayor CHRISTOPHER HAGLOCH.

Also present was CHRISTOPHER SULLIVAN, City Administrator / Chief of Police; JUSTIN BLASER, Director of Public Works & Utilities, and JAROD DALE, City Clerk.

The media was represented by Jim Taylor, WRMJ.

COMMITTEE OF THE WHOLE

Public Comment: No Report.

Communication & Correspondence: ALD. Chausse reported communication was received from local resident, Ann Runyon. ALD. read aloud correspondence regarding senior-type housing in Aledo and is as follows:

“Something for the Council to think about with all the housing discussions there is not adequate housing in Aledo for those of us between, ages 50 – 65, who need housing with neighbors but not in need of assisted living. Any change of trying to attract development for senior type environment for ages 55-plus? There are a lot of us locally who could use the safety of neighbors in a dorm-like setting, especially as people are widowed in their advancing years – Ann Runyon.”

Requests & Petitions: No Report.

Public Works Activity Report:

∙ Streets: Clearing of recent snow event with snow piles hauled from the downtown area; ordered 175 tons of salt; and attended a budget meeting for F/Y21. 

∙ Gas: JULIE’s; continue to move materials from the gas house to the PW garage; performed re-reads and manual reads; one (1) CO call related to an ice-covered intake on furnace; YMCA kitchen rough-in inspection completed; final plumbing inspection done at the old library building; budget meeting for F/Y21; OQ and weld testing completed; and assisted Street Division regarding the recent snow event.

∙ Water: Assisted Street Division regarding recent snow event; check slow sewer on NE 6th Avenue; water samples completed; locate buried manholes in Sponsler Subdivision Third Addition; budget review; and assisted ION with projects at WTP.

∙ Cemetery: Two (2) funerals occurred. Inventory and assist Street Division. 

∙ DPW: research conducted regarding Sponsler Subdivision with communication held with IDNR for an assessment of the pond. A property code hearing was held on 1/12 with a majority of properties that were cited having significant progress, however there is one (1) property that has not made any progress. The property is located at 106 SW 3rd Street and the hearing officer has agreed to continue the case with the stipulation that the property has to be 50% remediated by the February 9th code hearing. DPW also met with the property owner at the former Farmer’s Grain & Coal facility to review demolition specifications. The property owner is currently working on obtaining estimates for the demolition of the structures. ZBA Case No. 2021-01 was held on 1/14 to review the request to rezone from a R-2 Residential to B-2 Commercial. E-cycle and paint collection resumed with city staff manning the service on 1/7.

Aledo Police Department Activity Report: ADMINISTRATOR/CHIEF Sullivan reported the Department is in the transition period from the old Records Management System to the new one. We are tracking all of our incidents to be submitted into the National, and State of Illinois, National Incident-Based Reporting System, which became mandatory as of January 1, 2021.

Officer Christie is progressing through his field training rapidly. He will begin supervised solo patrols in early February. Officer Mattson is attending the Southwestern Illinois Basic Police Academy in Belleville, Illinois. His test scores have been excellent. The class has not been impacted by COVID-19 shutdowns so far. Officer Waldrup has completed his first week of academy training at the Macon County Law Enforcement Training Center in Decatur.

Officer Tom Bennett, who is a full-time deputy with the Mercer County Sheriff’s Department and a part-time officer for the City of Aledo Police Department, was injured last week. He responded to a roll-over traffic accident a couple of weeks ago. He was injured rescuing people who were trapped in the vehicle. Officer Bennett will be off for several weeks at least. If his injury requires surgery, he may be off for a period of months. He is waiting for an MRI and a consultation to determine the treatment he will need. Officer Bennett was working in his capacity as a Mercer County Sheriff’s Deputy at the time of his injury.

In the early morning hours of Wednesday, January 13, 2021, on the last day of the previous legislature’s term, a 764-page bill was presented to the Illinois Senate. They were apparently able to read the entire bill, research its impact on the State, seek input from impacted parties, and fully debate the legislation in approximately one (1) hour before passing it. The bill then went to the Illinois House where it was passed less than half an hour before the end of the terms of the sitting representatives.

City Attorney Walton, and his partner Josh Herman, are carefully reviewing the new law and will be assisting this Department in changing all of its policies and practices to conform to the new mandates. I did a very cursory review of the new law on Wednesday and Thursday. It will take several months to properly determine what needs to be done, how to do it, and what training will be necessary to make certain all officers fully understand the changes.

Administration Report: 353 Court, LLC provided a memo updating the City Council regarding their contracted services for Economic Development with the City for F/Y 2020:

City Treasurer’s Report: The Treasurer’s Report has been marked exhibit “B”, attached hereto and made a part of these minutes.

Mayor’s Report: MAYOR Hagloch reported Lou Powell is planning to begin construction and rehab of the Gun Report building in Spring, 2021. Permitting is currently being completed and submitted to the building department. WJ Albertson is currently placing furnishings in the old library building and should be completed soon. A tour to be scheduled with the elected officials to see the each of the refurbished properties with a final date to be determined in February, 2021.

Committee Report:

ALD. Cooper reported the Public Property, Streets & Sidewalks Committee met on January 11th to review a request for the City to consider improvements be done in Sponsler’s Subdivision that would potentially tie into a possible sale of property to a new developer. The Committee also reviewed the PW Garage building rehabilitation project and engineering quotes.

ALD. Chausse reported the Ordinance & Police Committee met on January 11th to discuss and review the amendment to the permitting and fee requirements for the operation of golf carts and neighborhood vehicles in the City and to review an ordinance regarding home kitchen operations in the City. Both items are listed on the agenda for approval.

ORDINANCE NO. 01, SERIES OF 2021; AN ORDINANCE REGARDING HOME KITCHEN OPERATIONS IN THE CITY OF ALEDO: (FIRST READING)

7-9-2: HOME KITCHEN OPERATIONS

(a) Subject to all applicable city ordinances, including, without limitation, land use and zoning regulations and privilege taxes, the statutory provisions contained within the Illinois Food Handling Regulation Enforcement Act (410 ILCS 625/3.6) regarding home kitchen operations, as now or hereafter amended are hereby adopted by reference as if fully set forth herein.

(b) The direct sale of baked goods as described in the Illinois Food Handling Regulation Enforcement Act is hereby authorized, provided the following conditions are satisfied:

a. Monthly gross sales do not exceed $1,000.

b. The baked goods are non-potentially hazardous baked good, as described in Section 3.6(a-5) of the Act.

c. A notice is provided to the purchaser that the product was produced in a home kitchen.

d. The food package is affixed with a label or other written notice is provided to the purchaser that includes:

i. the common or usual name of the food product; and

ii. allergen labeling as specified in federal labeling requirements by the United States Food and Drug Administration.

e. The food is sold directly to the consumer by the home owner or a family member.

f. The food is stored in the residence where it is produced or packaged.

Motion was made by ALDERMAN CHAUSSE and seconded by ALDERMAN BERTRAND to waive the 2nd reading for Ordinance No. 01, Series of 2021; An Ordinance regarding Home Kitchen Operations in the City of Aledo. A Roll call vote was recorded as follows:

YES: Chausse, Cooper, Dixon, Holmes, Sarabasa, Bertrand, and Bewley. NO: None. ABSTAIN: Kopp. Motion carried. 7 yeas, 0 nays, 1 abstention.

ORDINANCE NO. 02, SERIES OF 2021; AN ORDINANCE AMENDING PERMITTING AND FEE REQUIREMENTS FOR THE OPERATION OF GOLF CARTS AND NEIGHBORHOOD VEHICLES IN THE CITY OF ALEDO: (FIRST READING)

Section 9-10-2 of the Aledo City Code entitled “Permits” is hereby stricken in its entirety and replaced as follows:

9-10-2: PERMITS:

(A) Permit Required.

a. No resident of Aledo shall operate a motorized golf cart or NV without obtaining a permit from the City of Aledo Police Department as provided in this section.

b. Valid, current permits issued to residents of Mercer County, Illinois by Mercer County or any other municipality within Mercer County shall be honored by the City of Aledo and such permit-holders shall not be required to separately obtain a permit from the City of Aledo; provided, however, that such non-residents shall at all times have such permit or other evidence thereof available for presentation upon request by City officials and provided further that such non-residents shall at all times comply with the provisions of Title 9, Chapter 10 of the Aledo City Code, except as set forth in this Section 9-10-2.

c. Non-residents who do not have a valid, current permit from another municipality within Mercer County shall not operate a motorized golf cart or NV without obtaining a permit from the City of Aledo Police Department as provided in this section.

(B) Golf cart or NV owners must complete an original permit application or renewal permit application, as appropriate, which may be obtained from the City of Aledo Police Department. The completed forms will be maintained by the City of Aledo Police Department.

(C) The initial cost and the renewal cost of a permit shall be pursuant to Title 13, "Schedule of Fees", of this Code, to cover the costs of implementing and maintaining this chapter, and shall be paid to the City of Aledo by the applicant.

(D) All permits expire on December 31st of each year regardless of the date on which the original permit was issued.

(E) After completion of the original permit application and payment of the requisite original permit fee, the applicant shall present the golf cart or NV to the Chief of Police, or his designee, for an inspection to determine whether the golf cart or NV may be operated on a City street. If the applicant and golf cart or NV are qualified under the terms and conditions of this chapter, a license shall be issued to the applicant which must be kept on/in the vehicle at all times. Inspections shall not be required for renewal of permits.

(F) Insurance coverage and a valid driver’s license shall be verified as in effect by the Police Department when issuing or renewing a permit.

(G) The Police Department shall issue a sticker as visible proof of compliance, which shall be valid until December 31 of the year of registration, and which must be displayed on the "slow moving" emblem located at the rear of the golf cart or NV at all times.

Section 3: Section 13-1-1 of the Aledo City Code entitled “Schedule of Fees” is hereby amended as follows (additions are indicated by bold/underline and deletions by strikeout):

The following fees are hereby established, which shall be charged and collected by the City:

RESOLUTION NO. 01R, SERIES OF 2021; A RESOLUTION APPROVING PURCHASE OF MOTOR AND PUMP FOR WATER WELL NO. 06 IN AMOUNT OF $29,979.00:

Motion was made by ALDERMAN COOPER and seconded by ALDERMAN HOLMES to approve Resolution No. 01R, Series of 2021; A Resolution approving Purchase of Motor and Pump for Water Well No. 06 in amount of $29,979.00; for purchase and installation of replacement pump, motor, and replacement sub-cable from Cahoy Pump Service, 24568 150th Street – Suite 200, Sumner, IA 50674. A Roll call vote was recorded as follows:

YES: Kopp, Sarabasa, Bertrand, Bewley, Chausse, Cooper, Dixon, and Holmes. NO: None. Motion carried. 8 yeas, 0 nays.

MOTION APPROVING AN EXTENSION OF THE AGREEMENT BETWEEN HOMEFIELD ENERGY AND THE CITY OF ALEDO FOR A THREE-YEAR TERM:

Motion was made by ALDERMAN DIXON and seconded by ALDERMAN KOPP to approve an Extension of the Agreement between Homefield Energy and the City of Aledo for a Three-Year term beginning February, 2021 thru February, 2024. A Roll call vote was recorded as follows:

YES: Sarabasa, Bertrand, Bewley, Chausse, Cooper, Dixon, Holmes, and Kopp. NO: None. Motion carried. 8 yeas, 0 nays.

STANDING COMMITTEE REPORTS: A Public Property, Streets & Sidewalks Committee meeting to be held scheduled in the near future to discuss Brad Krstic request regarding Breezy Acres Subdivision.

ALD. Bertrand reported Water / WasteWater applications to be reviewed by staff on 1/22. A copy of the applications to be forwarded to the personnel committee by City Clerk Dale.

OLD BUSINESS: ALD. Chausse reported he had spoken with Mr. Heartt, Ag teacher at Mercer County High School, and DPW Blaser to contact the teacher to schedule high school students who could assist in manning the e-cycle and paint drop-off site every 1st & 3rd Thursdays of each month. Plans would be to schedule the students in the afternoon for the remainder of the school year, if approved.

ALD. Holmes inquired if the candidates who are running during the Consolidated Election to be held on April 6th, 2021 has been published. CITY CLERK Dale reported the ballot will be certified by the City Clerk’s office, to the Mercer County Clerk, on or before 1/28. Write-in Candidates have until 2/4 to file intent to be on a ballot with the County Clerk as well.

ALD. Sarabasa inquired on the status of development proposal requests submitted by Matthew Dowis regarding Sponsler Subdivision. MAYOR Hagloch reported Mr. Dowis did receive a 10-day extension regarding the purchase of property but would reach back out to the developer soon.

ALD. Sarabasa inquired on the status of the Farmer’s Grain & Coal property and demolition of bins. DPW Blaser reported the property owner is soliciting bids at this time to demolish the bins.

NEW BUSINESS: No Report.

ADJOURNMENT: There being no further business, motion was made by ALDERMAN KOPP and seconded by ALDERMAN SARABASA that the meeting be adjourned. A Unanimous voice vote followed in agreement. Meeting was adjourned at 6:47 P.M.
