Explanation:

1. A Resolution authorizing Information Technology staff to renew software support and maintenance package with Lucity. Inc. (Don Goff, Information Technology Manager)

Explanation: Funds are budgeted to renew Lucity, Inc’s software and support maintenance package. The City of Moline has utilized Lucity (formerly GBA Master Series) for the last 12 years as an enterprise work order and asset management system that links to the City’s Geographic Information System (GIS). It is utilized in the Water, WPC, Parks & Engineering divisions. The Water & WPC divisions heavily rely on Lucity for day to day administration of work orders between personnel in the office and field, as well as essential preventative maintenance management for City infrastructure. 2. A General Ordinance amending Chapter 35 “Zoning And Land Development” of the Moline Code of Ordinances, Section 35-3304 “Office Districts,” Section 35-3305 ““ORT” Office/Research Park And Technology District” and Table 35-3408 “Principal Commercial Land Uses,” “Land Use Regulations.” (Shawn Christ, Land Development Manager)

Explanation: The Plan Commission reviewed the zoning code as part of the City Council’s request and found the proposed amendments to allow limited sales and service as a permitted use in ORT, B-1, NC, B-2, B-3 and B-4 Districts and as a special use in O-1 District; and to modify the Purpose and Intent and the Defining Characteristics of the O-1 District to be in conflict with the Comprehensive Plan and difficult to justify approval of and therefore, recommended denial to the City Council. 3. A Resolution authorizing the Mayor and City Clerk to execute an agreement to accept funding and to do all things necessary to execute all assurances and certifications to the Illinois Housing Development Authority for the Abandoned Residential Property Municipal Relief Program Round 3 in the amount of $40,000.00; and authorizing the Planning and Development Department to begin work upon the execution of the agreement between the City and the Illinois Housing Development Authority to accept funding for the Abandoned Residential Property Municipal Relief Program Round 3 in the amount of $40,000.00, and to do all things necessary to implement said program requirements. Explanation: The City of Moline Planning and Development Department previously applied for and has received a $40,000.00 Abandoned Residential Property Municipal Relief Program (APP) Grant from the Illinois Housing Development Authority. This grant will assist with the maintenance or demolition of abandoned residential properties within the City of Moline. These grant funds may be used for securing, maintaining, demolishing, or rehabilitating abandoned homes. This grant will assist with the remove dangerous and dilapidated residential homes throughout the community. Additional documentation attached.

4. Ordinances amending Chapter 35, “Zoning And Land Development,” of the Moline Code of Ordinances, Section 35-4218, “Sidewalks,” Chapter 28, “Streets And Sidewalks,” Section 28-3104, “Duty Of Abutting Owner To Maintain,” and Section 28-3200, “When Required; Engineer’s General Responsibility; Temporary Certificate Of Occupancy; Variances.” (Scott Hinton, City Engineer)

Explanation: Staff proposes three amendments to the Code of Ordinances related to sidewalks. Revisions to Section 35-4218 reflect the City Council’s direction on new sidewalk installations for new development and for infill locations. Revisions to Section 28-3104 eliminate unenforceable requirements placed on abutting property owners. Revisions to 28-3200 eliminate conflicts with the revised Section 35-4218. 5. A Special Ordinance authorizing the Mayor and City Clerk to execute an Amendment to Development and Economic Incentive Agreement between the City of Moline and Dolan Commons, LLC for the development project and to execute any necessary agreements referenced therein; and authorizing all appropriate City officers and staff to do all things necessary to complete each of the City’s responsibilities pursuant to said agreement. (Maureen Riggs, City Attorney)

Explanation: The City and Developer Dolans Commons, LLC executed a Development and Economic Incentive Agreement (“Development Agreement”) on August 23, 2016, whereby Developer had certain responsibilities to construct the Development Project as defined therein. Due to delays in financing and other construction delays, the Developer will not be able to meet the deadlines set forth in the Development Agreement. Developer is nearing completion of the redevelopment of the building at 2727 Avenue of the Cities, which is part of the Development Project, but is requesting additional time to complete its obligations pursuant to the Development Agreement. The City considers the request to be reasonable given that Developer has made significant progress toward the redevelopment. The Amendment breaks down the incentive to be given to Developer by phase completed. The City believes that the Redevelopment Project to be located on the Property and the fulfillment generally of the terms of this Amendment to Development and Economic Incentive Agreement are in the vital and best interests of the City and its residents.
