3. Council Bill/General Ordinance 3016-2018

An Ordinance amending Chapter 28, “STREETS AND SIDEWALKS,” Section 28-3200, “WHEN REQUIRED; ENGINEER’S GENERAL RESPONSIBILITY; TEMPORARY CERTIFICATE OF OCCUPANCY; VARIANCES.”

Explanation: Staff proposes three amendments to the Code of Ordinances related to sidewalks. Revisions to 28-3200 eliminate conflicts with the to be revised Section 35-4218.

4. Council Bill/General Ordinance 3017-2018

An Ordinance amending Chapter 20, “MOTOR VEHICLES AND TRAFFIC,” of the Moline Code of Ordinances, Appendix 2 thereof, “LEFT TURN RESTRICTION INTERSECTION,” by removing 41st Street at 16th Avenue, westbound turning southbound, on school days when children are present.

Explanation: Traffic Committee reviewed request and recommends approval.

5. Council Bill/General Ordinance 3018-2018

An Ordinance amending Chapter 20, “MOTOR VEHICLES AND TRAFFIC,” of the Moline Code of Ordinances, Appendix 2A thereof, “RIGHT TURNS ONLY,” by including 41st Street and 16th Avenue, westbound turning northbound, on school days when children are present.

Explanation: Traffic Committee reviewed request and recommends approval.

6. Council Bill/Special Ordinance 4007-2018

A Special Ordinance closing certain streets more particularly described herein to vehicular traffic and authorizing the use of public right-of-way in conjunction with the Annual QC Kiwanis Bags Tournament, sponsored by Moline Kiwanis, to be held on Saturday, April 28, 2018.

Explanation: The Special Events Committee has reviewed and approved this annual event to be held on

Saturday, April 28, 2018. The estimated number of persons to attend is 150-200.

A Resolution authorizing the Mayor and City Clerk to execute a Contract with Needham Excavating Inc. for Project #1285, 18th Street B, South of Avenue of the Cities.

Explanation: Bids were opened and publicly read on April 3, 2018 for Project #1285 with the followingresults:

8. Council Bill/Resolution 1052-2018

A Resolution authorizing the ceding of 2018 Home Rule Volume Cap. (Kathy Carr, Finance Director)

Explanation: Under Section 146 of the Internal Revenue Code of 1986, the City is allocated an annual per capita amount for private activity bond use, which in 2018 totals $4,565,715. The Illinois Private Activity Bond Allocation Act provides that a home rule unit of government may transfer its allocation to any other home rule unit of government, the State of Illinois or any agency of the State, or any non-home rule unit of government.

The City Council has adopted a Volume Cap Policy regarding the use, transfer, or reservation of the City’s volume cap allocation. The policy, along with the history of Moline’s allocations, is included in the attachment.

Private Activity Bonds (PABs) are tax exempt bonds issued on behalf of certain businesses engaged in manufacture or production of tangible personal property. A wide variety of businesses can qualify under the guidelines to finance the acquisition of fixed assets such as land, buildings, or equipment. They may also be used for renovation and new construction, as well as construction or renovation of residential units that meet income guidelines. Because the bonds are exempt from federal income tax, they typically command competitive interest rates and may be combined with other tax credit programs to stimulate projects.

The Quad Cities Regional Economic Development Authority (QCREDA) is the only agency to request the City’s 2018 Volume Cap and has a mutually beneficial relationship with the City, County, and other regional development authorities to best utilize this resource for the benefit of the region.

If the City does not obligate this allocation by May 1, it is automatically turned over to the State of Illinois for reallocation to other entities statewide. Additional documentation attached.

9. Council Bill/Resolution 1053-2018

A Resolution authorizing the Mayor and City Clerk to execute a Road Salt Purchase Agreement for 2018-2019 Season with the City of Davenport.

Explanation: The City agrees to purchase 2,000 tons of salt and a reserve supplemental order of 5,000 tons of salt with the Quad City Joint Salt Bid, with the City of Davenport as the agent for said purchase. By participating in this contract a lower cost per ton has been experienced. The City agrees to purchase 25 percent of this supplemental order by March 1, 2019. Additional documentation attached.

Fiscal Impact: Sufficient funds are budgeted, Account No. 010-0844-431.06-30.

10. Council Bill/Resolution 1054-2018

A Resolution authorizing the Mayor and City Clerk to execute a Subordination Agreement for a Mortgage held against 425 18th Street, Moline, through the Façade Program; and authorizing City staff to do any and all things necessary to fulfill the terms of the Mortgage held against 425 18th Street, Moline.

Explanation: The City currently has a recorded Mortgage against that property for a façade grant that was given to Bermes Properties Incorporated. Through the Façade Program, the loan is forgivable after five years with the condition that the property stay maintained until 2022, when the loan is expected to be forgiven. Staff is comfortable with subordinating given the fact that the City will remain in second position, while taking into consideration that there is still sufficient equity in the building in the event the loan defaults prior to 2022. Approval of this item would authorize execution of the Subordination Agreement for 425 18th Street and allow staff to do any and all things necessary to fulfill the terms of the period of the

Mortgage. Additional documentation attached.

11. Council Bill/Special Ordinance 4008-2018

A Special Ordinance authorizing the Mayor and City Clerk to execute an agreement with the QC Legends Soccer Club to lease the 48th Street Field at Green Valley Park for the operation of a soccer program.

Explanation: QC Legends Soccer Club desires to Lease the 48th Street Field at Green Valley Park for the purpose of operating a soccer program. The term of said lease shall run from April 1, 2018, through March 31, 2020. The Park and Recreation Board supports the agreement and believes that this agreement will enhance services for residents. Additional documentation attached.

Fiscal Impact: City of Moline will receive $250.00 income annually for the lease term and a

$5.00 fee per participant.

12. Council Bill/Special Ordinance 4009-2018

A Special Ordinance authorizing the Mayor and City Clerk to execute a Lease Agreement with the Quad City Music Guild, for a lease term of April 1, 2019, through March 31, 2039.

Explanation: The Moline Park and Recreation Board and the Quad City Music Guild previously entered into a lease agreement dated March 1, 2000, for a twenty-year term ending March 31, 2020 for premises described therein. The parties mutually desired to review the lease prior to its expiration. The parties have agreed to make certain changes to the lease and enter into a new twenty-year lease effective April 1, 2019, which will terminate and replace their current lease agreement. The Park and Recreation Board recommends approval of the new lease. Additional documentation attached.

Fiscal Impact: Annual rent paid by Music Guild will be equal to the amount the City pays in

insurance premium to insure the premises, with such amount varying annually.
