Second Reading Ordinances

1. Council Bill/General Ordinance 3050-2018

An Ordinance amending Chapter 15, “GARBAGE AND TRASH,” of the Moline Code of Ordinances, Sec. 15-2203, “SPECIAL EXCEPTIONS,” by including 3518, 3602, and 3610 37th Avenue.

Explanation: The City of Moline requires refuse collection to occur in the public right-of-way. City authorized garbage or recycling trucks cannot collect refuse on private property without a special exception from the City Council. Public Works has received interest from Brad and Paula Greeno for the City to collect trash and recycling at the properties they own at 3518, 3602, and 3610 37th Avenue. These are three condominium properties with a total of twelve units. Staff has verified that City trucks can access the back of the properties and the property owner has signed a hold harmless agreement to insure that the City is not liable for damage to the private parking lot. 2. Council Bill/General Ordinance 3051-2018

An Ordinance amending Chapter 5, “AMUSEMENTS,” of the Moline Code of Ordinances, Section 5-1105, “LOCATIONS PROHIBITED OR RESTRICTED,” by repealing said section in its entirety and enacting in lieu thereof one new Section 5-1105 entitled “RESTRICTIONS ON LOCATIONS AND ADVERTISING,” relating to the same subject matter.

Explanation: The City adopted Council Bill/General Ordinance 3019-2012 in July, 2012, to allow video gaming terminals in licensed establishments within the City and to allow the City and eligible establishments to pursue video gaming as a potential revenue source. The proliferation of video gaming establishments in the City has caused concern by City officials and residents due to the deleterious effects of gambling. The City Council seeks to counter the negative effects of gambling by limiting the advertising of such establishments so as not to entice people to these establishments any more than they already are or may be, while still allowing video gaming device operators the opportunity to continue their businesses. This ordinance will set forth the restrictions for advertising by and for all video gaming establishments that possess a City of Moline Class K liquor license.

3. Council Bill/Resolution 1151-2018

A Resolution amending Budget Resolution #1183-2017 by authorizing changes to various line items in the budget for FY 2018.

Explanation: Budget amendments are compiled periodically throughout the fiscal year, and presented to City Council for approval. These amendments are proposed to reflect recent changes to the current budget that avoid any adverse affect to the City’s legal budgetary compliance. Additional documentation attached.

4. Council Bill/Resolution 1152-2018

A Resolution authorizing the purchase of four (4) V-Box Salt Spreaders with Pre-Wet Systems from Bonnell Industries Inc. for the amount of $117,280.

Explanation: The current main route V-Box Salt Spreaders are sixteen to eighteen years old and were scheduled to be replaced in 2015. With good maintenance, staff was able to extend the life of these units for three (3) years. They have now reached the end of their useful life. Specifications were developed for stainless steel V-Box Spreaders with Pre-Wet Systems, and an RFP was published. The most responsive and responsible proposal was received from Bonnell Industries Inc., Dixon, Illinois for the amount of $117,280. These V-Box Spreaders will be used by the City’s new main route tandem trucks. Staff is also requesting that the current equipment to be disposed of by the Fleet Manager through the legal disposal process that is most advantageous to the City, whether sealed bid, auction, negotiation, or otherwise. 5. Council Bill/General Ordinance 3049-2018

An Ordinance amending Chapter 20, “MOTOR VEHICLES AND TRAFFIC,” of the Moline Code of Ordinances, Appendix 18 thereof, “TWO-HOUR PARKING RESTRICTIONS IN NONMETERED ZONES,” by including Two-Hour Parking at Ben Butterworth Memorial Parkway Lot Numbers 3201 and 3301, between the hours of 8:00 a.m. to 5:00 p.m., Monday to Friday.

Explanation: Complaints were initially received from park users as to the over-parking of Western Illinois University students in the park’s lots across from the college. At the March 22, 2018 Park Board meeting, staff recommended to Park Board the placement of temporary signage at Lots 3201 and 3301 to reduce the allotted parking time to 2 hours. The Public Works Director has authority, per City Code, to hold a six-month trial period in such cases. On May 3, 2018, signs were installed at the lots. Between August 1 and October 9, seventy-two courtesy tickets and sixteen actual tickets were issued. Staff has observed a decrease in college parking usage, allowing open space for park users. Staff is requesting City Council approval to make the 2-hour parking restriction at Lots 3201 and 3301 permanent.

6. Council Bill/Resolution 1153-2018

A Resolution authorizing the Human Resources Manager to execute a policy with UnitedHealthcare-BP to provide reinsurance coverage for medical and prescription drug benefit claims for a one-year period commencing on January 1, 2019.

Explanation: UnitedHealthcare-BP currently provides specific and aggregate reinsurance for the City’s medical and prescription drug benefit plans for active employees and their dependents, as well as retirees under 65 years of age and retirees’ dependents under 65 years of age. Expected annual costs for reinsurance total $325,422. The proposal reflects an 18.28 percent increase from 2018 rates. Additional documentation attached.

7. Council Bill/General Ordinance 3052-2018

An Ordinance amending Council Bill/General Ordinance No. 3042-2018, which amended the new Quad Cities Enterprise Zone within the Cities of East Moline, Moline, Rock Island and Silvis, Illinois, the Village of Milan, Illinois, and the County of Rock Island, Illinois, to commence January 1, 2019, as established by Council Bill/General Ordinance No. 4050-2017, adopted November 28, 2017; and amending the corresponding Quad Cities Enterprise Zone Intergovernmental Agreement between the Cities of East Moline, Moline, Rock Island and Silvis, Illinois, the Village of Milan, Illinois, and the County of Rock Island, Illinois, by adding new territory to the Quad Cities Enterprise Zone; and authorizing the Mayor and City Clerk to execute an Amendment to the Enterprise Zone Intergovernmental Agreement between the jurisdictions.

Explanation: The Cities of East Moline, Moline, Rock Island and Silvis, the Village of Milan, and the County of Rock Island, Illinois (collectively, “Jurisdictions”), each adopted a 2017 ordinance for the establishment of a new Quad Cities Enterprise Zone (“EZ”) and executed an Intergovernmental Agreement between the Jurisdictions to designate the EZ territory. The City’s establishing ordinance is Council Bill/Special Ordinance No. 4050-2017. An amendment to that ordinance to delete and add territory to the EZ was approved pursuant to Council Bill/General Ordinance No. 3042-2018 on November 13, 2018.

This second amendment will add a Deere and Company parcel located within the County of Rock Island to the EZ. The addition of this territory to the EZ boundaries will meet qualifications of the Illinois Enterprise Zone Act, and a public hearing regarding an amendment to add territory to the EZ was held pursuant to the Act on December 3, 2018, so that a joint application may be forwarded to the Illinois Department of Commerce and Economic Opportunity (“DCEO”) for proposed approval and certification by January 1, 2019. Additional documentation attached; the attachment to this item contains the ordinance exhibits, including the amendment to intergovernmental agreement. Consideration is requested to accommodate the EZ schedule for its implementation on January 1, 2019. CONSIDERATION REQUESTED.

8. Council Bill/Special Ordinance 4060-2018

A Special Ordinance providing for the temporary financing by the City of Moline, Illinois for a fence for the new dog park by authorizing issuance of $50,000 in a Revenue Anticipation Note and purchase of the same by the General Fund of the City of Moline, Illinois, appropriating monies for said purposes, and authorizing execution of any related documents. (Kathy Carr, Finance Director)

Explanation: On October 23, 2018, City Council directed the TIF #3 Fund to issue a Revenue Anticipation Note to be purchased by the General Fund.

Fiscal Impact:                    $50,000 reduction of General Fund Reserves
