Hampton Township Board of Trustees met May 21.

Here is the minutes provided by the Board:

The regular meeting of the Charter Township of Hampton Board of Trustees was called to

order at 7:00 p.m. by the Supervisor in the Boardroom of the Hampton Township

Administrative Offices.

The pledge of allegiance was given to the flag.

The invocation was read and a moment of silence observed.

Present: Klass, Wisniewski, Hugo, Wright, Samyn, Close, DeWyse

Absent: None

Also Present: Leadford, Benchley, Hewitt, VanDenBoom, Weiler & 9 people in audience

Motion by Hugo seconded by Klass that the minutes of the May 7, 2018 regular meeting be

approved as printed and that the reading of the minutes be waived. Motion carried.

Motion by Wisniewski seconded by DeWyse to recess to closed session to discuss labor issues.

Ayes: Wisniewski, DeWyse, Klass, Hugo, Wright, Samyn, Close

NayS: None

Motion carried.

The Board recessed to closed session at 7:03 p.m.

Motion by Wisniewski seconded by Hugo to return to regular order of business at 8:08 p.m.

Ayes: Wisniewski, Hugo, Klass, DeWyse, Samyn, Wright, Close

Nays: None

Motion carried.

Motion by Hugo seconded by Wisniewski that the Police Report for April 2018 be received.

Motion carried.

Auditors Report:

Motion by Klass seconded by Wisniewski that the following warrants be approved for payment:

#3074 - #3077 Building Fund 1,537.15

#3737 - #3742 Sewer Fund 13,112.20

Motion by Hugo seconded by Klass to approve the labor contract, dated March 1, 2018 to July 31, 2019, between the Charter Township of Hampton and Hampton Township Firefighters Association Local 1831, AFL-CIO.

Ayes: Hugo, Klass, Wisniewski, DeWyse, Samyn, Wright, Close

Nays: None

Motion carried.

Motion by DeWyse seconded by Wisniewski to approve the labor contract, dated March 1, 2018 through July 31, 2021, between the Charter Township of Hampton and the General

Services Administration, Teamsters Local 214-GSA.

Ayes: DeWyse, Wisniewski, Hugo, Klass, Samyn, Wright, Close

Nays: None

Motion carried.

Motion by Wisniewski seconded by DeWyse to approve the labor contract, dated March 1, 2018 through July 31, 2021, between the Charter Township of Hampton and the

Department of Public Works, Teamsters Local 214-DPW.

Ayes: Wisniewski, DeWyse, Hugo, Klass, Samyn, Wright, Close

Nays: None

Motion carried.

Motion by Hugo seconded by DeWyse to approve the Memorandum of Understanding for

DPW Summer Hours. Summer hours to start Memorial Day. Motion carried.

Motion by Wisniewski seconded by Hugo that Ordinance No. 40-1, Solicitors, Peddlers, and

Transient Merchants Ordinance, be adopted as follows:

Solicitors, Peddlers, And Transient Merchants

Ordinance/Amended

An Ordinance to amend Township Ordinance 40 for the purpose of repealing that portion of the Ordinance which classifies the violation thereof as a misdemeanor, and to instead designate violation of Ordinance 40 as a municipal civil infraction.

Now Therefore, The Board Of Trustees Of The Charter Township Of Hampton,

Bay County, Michigan Hereby Ordain:

That Ordinance 40, the Solicitors, Peddlers, and Transient Merchants Ordinance, be amended to delete current paragraph 10 which specifies that any person who shall violate any of the provisions of Ordinance 40 shall be subject to a fine of not more than One Hundred Dollars ($100.00) or imprisonment in the County Jail not to exceed ninety (90) days, or both such fine and imprisonment, to instead read as follows:

10 Penalty. Any person who violates this Ordinance is responsible for a Municipal civil infraction and may be ordered to pay a civil fine, as those fines shall be determined from time to time, pursuant to Ordinance 64, which is the Municipal Civil Infractions Ordinance for the Charter Township of Hampton. Violation of this Ordinance shall be deemed to be a Class 2 violation, pursuant to Sec. 7 of Ordinance 64.

This Ordinance amendment shall take effect immediately upon publication following

adoption by the Township Board of Trustees.

Motion by Klass seconded by DeWyse that Ordinance No. 63-1, Finn Road Park Boat Launch

Ordinance, be adopted as follows:

Finn Road Park Boat Launch Ordiance

An Ordinance to amend Township Ordinance 63 for the purpose of repealing that portion of the Ordinance which classifies the violation thereof as a misdemeanor, and to instead designate violation of Ordinance 63 as a municipal civil infraction.

Now Therefore, The Board Of Trustees For The Charter Township Of Hampton,

Bay County, Michigan Hereby Ordains:

That Ordinance 63, the Finn Road Park Boat Launch Ordinance, be amended to delete current Section 5 which specifies that any person who shall violate any of the provisions of Ordinance 63 shall be subject to a fine or not more than One Hundred Dollars ($100.00) or imprisonment in the County Jail not to exceed ninety (90) days, or both such fine and imprisonment, to instead read as follows:

Section 5. Penalty.

Any person, firm, or corporation who violates this Ordinance is responsible for a municipal civil infraction and may be ordered to pay a civil fine, as those fines shall be determined from time to time, pursuant to Ordinance 64, which is the Municipal Civil Infractions Ordinance for the Charter Township of Hampton. Violation of this Ordinance shall be deemed to be a Class 2 violation, pursuant to Sec. 7 of Ordinance 64.

This Ordinance shall take effect immediately upon publication following adoption by the Township Board of Trustees.

Motion by Hugo seconded by DeWyse that the following budget adjustment be approved:

Decrease: 101-890-956.000 Contingency $5,200

Increase: 101-753-970.000 RailTrail/Nature Trail Capitol $5,200

Ayes: Hugo, DeWyse, Klass, Wisniewski, Samyn, Wright, Close

Nays: None

Motion carried.

Attorney Report:

Hewitt had no report.

Engineer Report:

Bartow was not present.

Standing Committee Reports:

There were no standing committee reports.

Officer/Trustee Reports:

Motion by DeWyse seconded by Hugo that the April financial reports be received from the Clerk. Motion carried.

Motion by Hugo seconded by Klass that the revenue reports be received from the Treasurer as follows:

4/30/18 – 5/04/18 Water Fund $ 280,522.37

Building Fund 3,028.60

General Fund 7,841.65

$ 291,392.62

5/07/18 – 5/11/18 Water Fund $ 115,055.46

Building Fund 3,297.50

General Fund 354,942.25

Klass asked if it was working chipping just one day a month.

Supervisor addressed: road projects; Weadock Plant demolition update; 100 Club meeting and grant to Fire Department for a “mustang suit”; water advisory meeting update; and the Memorial Day Service at the Veterans’ Memorial.

Open To The Public:

Wayne Esterhai, Center Road, questioned the amendments to the Peddlers & Boat Launch Ordinances.

Public portion of the meeting was closed.

Motion by Hugo seconded by Klass that the meeting adjourn. Motion carried. The meeting

adjourned t 8:26 p.m.
