Second Reading Ordinances

1. Council Bill/General Ordinance 3044-2019

An Ordinance granting MidAmerican Energy Company, its successors and assigns, the right and non- exclusive franchise to acquire, construct, erect, maintain and operate in the City of Moline, Rock Island County, Illinois, an electric system, and to furnish and sell electric energy to the City of Moline and its inhabitants for a period of twenty-five (25) years.

Explanation: The current franchise agreement with MidAmerican Energy Company was granted on April 27, 1994, for a period of 25 years. MidAmerican Energy Company seeks to enter into a new agreement with the City for the right and non-exclusive franchise to acquire, construct, erect, maintain and operate an electric system in the City and to furnish and sell electric energy to the City and its inhabitants for a period of 25 years. The attachment to this item is the proposed ordinance. Additional documentation attached.

2. Council Bill/General Ordinance 3045-2019

An Ordinance granting MidAmerican Energy Company, its successors and assigns, the right and non- exclusive franchise to acquire, construct, erect, maintain and operate in the City of Moline, Rock Island County, Illinois, a natural gas system, and to furnish and sell natural gas to the City of Moline and its inhabitants for a period of twenty-five (25) years.

3. Council Bill/Special Ordinance 4017-2019

A Special Ordinance requesting the County Clerk to not extend 2019 taxes for payment of all principal and interest on City of Moline General Obligation Corporate Purpose Bonds.

Explanation: Annually, the City of Moline instructs the County Clerk not to extend property taxes for municipal bonds. Principal and interest on all City General Obligation Bonds are paid from other revenue sources. The 2019 abatement ordinance must be filed with the County Clerk by the last day of January 2020. Additional documentation attached.

Fiscal Impact: This ordinance must be passed and filed by the last day of January 2020, or the County Clerk will extend additional property taxes for 2019 tax bills, collectible in 2020.

Resolutions

4. Council Bill/Resolution 1001-2020

A Resolution authorizing the Mayor and City Clerk to execute Licensing Agreements for 2020 permit approved applications for use of public right-of-way or City-owned property.

Explanation: Since 2013, the City Council has approved an annual resolution to allow staff to administer and approve all licensing agreements for the upcoming year and for the Mayor and City Clerk to execute those approved licensing agreements without each agreement being presented separately to the City Council. Staff has found that this streamlined process has improved customer service by minimizing construction delays and staff time involved with the requests. Staff is recommending approval of a similar resolution for 2020. The attachment to this item is a list of 2019 approved licensing agreements and a licensing agreement template for the 2020 agreements. Additional documentation attached.

5. Council Bill/Resolution 1002-2020

A Resolution authorizing the IT Manager to accept and execute a quote for purchase of a Datrium DVX Hyperconvergence system with cloud DR from Mindsight Inc. at a price of $206,778.69; and authorizing the IT Manager and staff to do all things necessary to complete the system purchase and implementation.

Explanation: This purchase will further enhance and improve the City of Moline’s datacenter reliability, speed, growth, backup, and disaster recovery system while saving the City $110,000 over the next 5 years. The IT Manager researched ways of improving the City’s datacenter to further improve security, reliability, speed, protection against ransomware and disaster recovery options, and selected Datrium DVX as the best solution for the City. Bids were sought for purchase and implementation of this solution, and Mindsight Inc. provided the lowest and most responsive bid. Additional documentation attached.

Fiscal Impact: $206,778.69 purchase price. $50,000 budgeted in account #443-0425-417.04-27; $20,175 budgeted in account #443-0425-417.04-22; $136,603.69 from IT Reserves.

First Reading Ordinances

6. Council Bill/General Ordinance 3001-2020

An Ordinance amending CHAPTER 34, “WATER AND SEWERS,” of the Moline Code of Ordinances, Section 34-2139, “WASTE OF WATER,” pertaining to the City’s sewer use ordinance, by amending its current text to subsection (a) and enacting one new subsection (b).

Explanation: At the December 10, 2019, Committee-of-the-Whole meeting, the City Council discussed giving relief to customers when unusually high water usage is due to defect in pipes, faucets, or other fixtures. This amendment allows the City Administrator to adjust water and sewer charges in these situations.

Fiscal Impact: Discounted rate of 20% of the full water/sewer charge for the balance of the volume in the current invoice remaining after deducting the average volume based on three invoices immediately preceding the disputed invoice. Public Notice/Recording: N/A
